After keeping quiet on this for what has felt like an eternity, the reason we’ve started talking about it now is because we think there’s a really important story here. A story whose scope and importance spreads so much wider than just a local beauty salon closure in Nottingham. A story about corporate bullying and how these massive multinational giants claim to be so ethically responsible on the one hand, yet on the other are putting small independent companies out of business and contributing to the decline in our city centres and high streets.

Yes we’ve been talking about this all weekend. And yes, we’re going to carry on talking about it this week as well. Because guess what L’Oreal – nkd’s worth it too!

If you’ve been reading anything about our legal battles with L’Oreal you’ll know how much of an impact this has had on nkd ( ) with the December 2023 closure of our flagship Nottingham salon and the repercussions on our wider nkd ( ) family.

It’s no small feat for any small business to have to find the best part of £30,000 to fight a fight that should never have happened in the first place. We firmly believe that we’ve been put in an impossible situation, where we had to decide between walking away from the brand we’ve spent the previous decade and a half building up or having to take on one of the largest companies in the world. The injustice of this has been hard to come to terms with.

As a small business we are passionate about supporting other small businesses. We’re part of that community and will continue to be so despite the efforts of massive corporations like L’Oreal to quash the little guys.

And if this is happening to us, it will be happening to many other small businesses too, maybe ones who don't have the funds (or the energy) to fight back or are too scared of massive companies like L'Oreal and their tactics.

Right, serious question everyone – in fact we’ll do a little poll in our stories.

We want to know if you can tell the difference between the two images portrayed below? Could you ever get an eyeshadow palette mixed up with a body or intimate wax, even if the brand names for each contained 3 of the same letters but were actually different words?

Hmmmm, no, us neither.

L’Oreal have said that if we continue to call ourselves nkd ( ) then their customers could get so confused by the similarities between these two brands and may actually change their purchasing habits as a result, which would cause L’Oreal to lose out on sales!

Yes, they’ve really said that. Errrrr, despite the fact that nkd has been trading as nkd ( ) since 2009 – which is actually the year before Urban Decay’s NAKED first eyeshadow palettes went on sale in the UK, in 2010.

What is possibly even more bizarre than this, is the number of other brands that ARE successfully trademarked in the UK, which actually include the word NAKED in their brand name AND who operate in the field of cosmetics and/or make up.

In our opinion this makes it very clear that no single entity – not even the giant that is L’Oreal – can (nor should be able to) lay claim to a single word across such a huge market and industry, let alone derivatives and other versions of that word. What do you think?
