It's not everyday you have to go through the Court system to recover money you are owed, and for most it can be a very stressful situation. A lot of our claimants are usually in this same position and have never used the County Court or High Court systems before.

This was the case for one of our recent claimants, where we managed to successfully recover their money in full. It is great to hear the positive feedback of the good work of our operations team who made the process much easier and straightforward, and our Enforcement Agents were able to recover the full amount owing! 💷

It is always a good feeling to finish a days work, knowing that the work you have done has helped someone!

This particular client of ours was in the process of working on one of their car parks in the midlands, which has sadly been empty since the pandemic, though prior to this, was being used daily. Then a group of arrived in 13 Caravans and accompanying vehicles, putting a stop to it.

Our had successfully moved the encampment on within 24hrs of instruction, by firstly serving them a notice to leave which was ignored, meaning a team of Enforcement Agents had to return and move them on.

Now the car park is secure and can be finished for the return of customers' use! ☑️

❗❗ GOVERNMENT EXTEND BAN ON COMMERCIAL PROPERTY EVICTIONS AND RENT COLLECTIONS ❗❗

Yesterday, the UK Government announced a significant extension for the ban on Commercial Property Evictions (known as Forfeiture of Lease) and requirements surrounding Commercial Rent Collection (known as Commercial Rent Arrears Recovery). Though an extension was expected, a further 9 months was a big surprise and extremely disappointing to say the least and it will have a huge detrimental effect on Commercial Landlords throughout the Country, on top of the already damaging financial effect they have suffered!

❗❗ LANDLORDS CAN STILL TAKE ACTION TO RECOVER BOTH PROPERTY AND MONEY ❗❗

Currently, there is nothing preventing Commercial Landlords going through the County Court to obtain either a money Judgment to collect outstanding Rent Arrears or an Order for Possession to regain their Commercial Property. We have seen positive results from some of our clients who have already taken this route. Recently we were contacted by a client of ours in the Hospitality sector who operate across the Country; they had 10 Caravans invade their car park at one of their sites in the area making it very difficult for members of the public to make use of these critical, and often emergency stops. They quickly made contact with us and used our online instruction service for us to remove the encampment from their land.

One of our Enforcement Agents were on site within 1 hour of instruction and served the 20+ Travellers with a notice to vacate the land within 2 hours. Due to the detrimental impact the encampment was having on the running of our clients business and, more importantly preventing members of the public the ability to make full use of their services we had to act quickly to restore these services. Our Enforcement Agent waited on site for the 2 hours timeframe to lapse and a team of Agents then joined to carry out an Eviction under Common Law.

After a little resistance from the family, not wanting to leave as they had only just arrived earlier that day, our team of Agents had successfully regained possession of our clients land within 5 hours of them arriving. ✅

The manager of this particular site was very grateful to our Agents for their work that day due to the level shoplifting and criminal damage taking place, so much so, they treated our Agents to a meal of their choice from the services! 🍔

We would like to send our condolences to Her Majesty Queen Elizabeth II and the Royal Family for the loss HRH Prince Phillip, The Duke of Edinburgh who sadly passed away today aged 99. A beloved husband, father, grandfather and so much more to so many people around the world. RIP, Sir.

Another great review received by one of our recent claimants who was awarded a County Court Judgement against a Company who owed them money. Following this they approached us in order to use the Services of our Authorised High Court Enforcement Officer who had the Judgement uplifted to the High Court for Enforcement.

Following the expiry of our notice to the defendant (allowing them 7 days to pay), our Enforcement Agents attended the premises and collected full payment on behalf of the claimant!

Earlier this week, the Government announced a further extension to the ban on residential evictions (to 31/05/2021) and commercial evictions (to 30/06/2021) under Forfeiture of Lease.

Regulations relating to collecting commercial Rent through Commercial Rent Arrears Recovery (CRAR) have also been amended.

Here at Frank G Whitworth HCE, we are excited to share with you that our Operations Director, Andy Coates has recently been appointed by the Lord Chancellor as an Authorised High Court Enforcement Officer!

This is a huge academic and professional achievement for Andy and shows a high level of knowledge within the Enforcement Industry. Becoming an Authorised High Court Enforcement Officer is certainly not a simple course and we are very proud to have one of the most knowledgeable individuals in the industry as one of our own.

Andy joins our panel of HCEO's alongside Frank Whitworth and Kate Fellows and the High Court Enforcement Officers Association's other 47 Authorised members across the country.

We've officially completed the filming of our first Series and the 9th Series of the BBC One Documentary, The Sheriff's are Coming! It has been a long time in the making with the Coronavirus Pandemic putting a stop to Enforcement throughout the initial lockdown.

It has been a great experience for all of us with some fantastic feedback from the initial release of the first 2 Episode's back in September, though having a Camera crew following our Enforcement Agents does not change what we do; we still take pride in delivering the best service for our Claimants when Enforcing their County Court Judgements to collect the money they are rightly owed and we are grateful to be able to share our day-to-day work with you all.

We are excited for you all to see the action packed Series and just as excited to get back out on the road filming for the next one!

In the meantime, we will carry on doing what we do acting on behalf of our Clients and working with defendants as best as we can to try and help them during these unprecedented and very challenging times.

❗️ Eviction ban extended until 31st March at last minute ❗️

There are an estimated half a million Tenants in the UK in Rent Arrears or who have been served with an Eviction notice by their Landlords within the last month alone. This is only going to add to the already huge waiting lists in the County Court and the backlog of Evictions by County Court Bailiff's.

An Order for Possession can be converted into a High Court Writ of Possession through our High Court Enforcement Officer, AS SEEN ON THE BBC ONE SERIES THE SHERIFF'S ARE COMING, which is a much quicker route to regaining Possession of property.

Make sure you get your paperwork submitted now to prevent any unnecessary delays in Court and remember to request permission to Transfer your Order to the High Court for Enforcement!

Renters: Eviction ban in England extended until March Eviction notices, which were set to resume on 22 February, cannot now be served for another six weeks.

A client of ours in the Midlands area contacted us after a group of Travellers had gained unauthorised access to their land and set up camp.

We received instruction to remove the Travellers from their land using Common Law powers. With our same day, nationwide Enforcement Services we had an Enforcement Agent on site within 2 hours of receiving instruction. The Enforcement Agent made contact with the Travellers who he had dealt with previously in another Traveller Eviction. Whilst on site, our Agent advised that they must leave and served notice on the family of up to 25 Travellers. Under Common Law, Landowners are required to give the trespassers ‘reasonable time’ to vacate the Land, which can have varied opinions on what reasonable time is.

On this occasion, the Travellers failed to act upon the notice and were still occupying the land the following day, as a result our Agents returned to remove the family of Travellers. In this instance we had regained Possession of our Client’s Land within a couple of hours; the fact that we had dealt with the family previously and had built up a good level of rapport with them ensured a swift and efficient removal on this occasion, in turn meaning less costs to the Client!

This is a great example of a Landowner who acted fast to remove the unauthorised encampment, which has huge benefits, such as:

- Successfully regaining Possession of their land within a matter of hours as a pose to days or even weeks
- Minimising costs such as Waste Clearance which could rack up costs into their thousands alone, as a pose to hundreds
- Minimising damage to their Land
- Deterring this group, or other Traveller families from further encroachments onto the Land knowing the Landowner will not tolerate unauthorised encampments and will act quickly to remove them
