"A Farewell to Arms"
by Ernest Hemingway
*************************
It is a novel written by American author Ernest Hemingway,
Published in 1929 and realistic portrayal of war has its sway.
The novel tells the story of Frederic Henry, an American ambulance driver,
He was serving in the Italian army during World War I.
He meets and falls in love with Catherine Barkley, an English nurse,
Their relationship blossoms amidst the chaos and brutality of war time.
He experiences as he was on the Italian frontlines,
Witnessed the devastation and suffering which affected his relationship with Catherine.
In war Frederic is injured and transferred to a hospital in Milan,
Catherine died during childbirth, leaving Frederic devastated and alone.
The novel ends with Frederic coming to terms with his loss,
In the rain, despite the pain finding ability to move forward, he accepted the loss.
Love is ultimately overshadowed by war and tragic loss.
War is prominent throughout the novel which is nothing but the senselessness.
Hemingway in his style employed the "Iceberg Theory,"
By sparse dialogue & description heightening a sense of realism, emotionally.
Rain is used as a recurring symbol, representing cleansing,
Storrytelling about rebirth, & a sense of emotional release.
Catherine Barkley represents a more idealised version of femininity,
In the midst of chaos of war, she provided comfort and stability.
The novel remains a powerful and poignant portrayal of war, love, and loss,
Is realistic depiction of war & characterizations
of themes through concise prose.
The novel continues to resonate to remind the devastating impacts of war,
In the face of adversity, humanity exists by the enduring love power.

"Queen of Carbon Science,"
Mildred S. Dresselhaus
****************************
Mildred S. Dresselhaus's research helped to unlock the mysteries of carbon. In 1930, she was born to Polish immigrant parents in Brooklyn, New York. Dresselhaus died in 2017 at the age of 86.
She served as a member of the MIT faculty for 50 years. She was the first woman to ever attain the rank of full, tenured professor at the university. She was the first woman to win the National Medal of Science in Engineering. She was known nationally for her work to develop wider opportunities for women in science and engineering. In 1971, she and a colleague organized the first Women’s Forum at MIT in 1971. Two years later, she received a Carnegie Foundation grant to continue exploring ways to encourage women in science and engineering. She also supervised more than 60 doctoral candidates, leaving her mark on the field for years to come.
She was the author of eight books and 1,700 scientific papers.
Anantha Chandrakasan, head of MIT’s Department of Electrical Engineering says:
“Millie’s dedication to research was unparalleled, and her enthusiasm was infectious. For the past half-century, students, faculty and researchers at MIT and around the world have been inspired by her caring advice... She made such a huge impact on MIT, and her contributions will long be remembered.”
Dresselhaus originally intended to become a teacher. Rosalyn Yalow encouraged her to consider a career in physics. After studying under Nobel laureate Enrico Fermi at the Univeristy of Chicago, Dresselhaus came to MIT in 1960 and became a permanent member of the electrical engineering faculty in 1968. Over her long career, she made fundamental discoveries in the electronic structure of semi-metals. She wrote a definitive text on fullerenes, the spherical molecules better known as buckyballs; and was especially well-known for her research on nanomaterials. When Dresselhaus was awarded the Presidential Medal of Freedom by President Barack Obama in 2015, the White House described her as “one of the most prominent physicists, materials scientists, and electrical engineers of her generation.”
When she gave the keynote speech at 2015’s Rising Stars in EECS, a three-day workshop for female graduate students and postdocs, Dresselhaus focused on the importance of persistence, relating stories about her own graduate work with legendary physicist Enrico Fermi, whose program was notoriously difficult. “It was what you did that counted,” she said, “and that followed me through life.”

Art of cross examination
***************************
In civil or criminal case, the cross-examination of the witnesses plays a significant role to adduce and presentation of evidence and to prove the relevant facts.
Sections 135 to 166 of the Evidence Act, clarify aspects of the examination of witnesses:
The rules,
Principles,
How to check the credibility of witness,
What questions to be asked to the witness,
The procedure of examination, and
Other relevant things related to cross examination.
The constructive cross-examination can make the party lose or win the trial.
The cross-examination is a process of meticulous determination, hard work and common sense.
The structure of a cross-examination if arranged has sequential results in a case.
The art of cross-examination can be mastered only with constant training and practice.
So from experiences in 41 years practice I dare to give some tips to my new generation:
1. The objectives of Cross-Examination must be
I. To develop favourable matters that hasn't been said during examination.
ii. To reveal and establish that the statement provided by the witness is false.
iii. To establish any interest, the witness may have in the result of the trial.
iv. To establish that the witness has been coached and has memorized his testimony.
v. To reveal all the documents, that witness has attested to only that part which is not out of context.
vi. To check the witness's ability to hear, see, remember, and relate with the correctness of what he affirmed in his her examination-in-chief.
2. Remember that if a witness seems to be confused during his/her cross-examination, then the court has all the rights to ask questions to that witness.
3. Study your case in minutes and put everything in mind.
4. Look into witness’s eyes, no matter who he or she is.
5. Study the traits of the witness before questioning.
6. Never appear to him or her stressed and always act calmly.
7. Don't show your weakness,
8. Don't let the witness to use it against you.
9. Never ask a question immediately,
Wait a few seconds on your thought, then rcross-examine coldly and briefly.
10. Speak slowly, it shows your self confidence in what you are questioning.
11. Cross examination is an art. Try to appreciate other's work and learn the art of cross examination from experts of your mind.

Justice to ensure accountability of
Persons in power, India needs to fight for.
******************************************
Horrific details have emerged,
Of the heinous viral video from Manipur,
Where a mob of men was seen,
Parading women naked,
s*xually assaulting them, and
forcing them into a field.
The incident took place on May 4, and
The complaint that was filed
Regarding the incident by the village head,
It was registered as a FIR on May 18.
Unknown miscreants,
Around 900 to 1000 in number and
Suspected to be Meitei Youth Organisations members,
Of forced their way into the victims' village,
Carrying sophisticated weapons including rifles.
The violent mob went on to ransack and vandalise
All the houses in the village and looted them,
Following which they burnt them to the ground
Leaving the villagers homeless.
Fearing that they'd be killed by the mob,
5 villagers (two men and three women),
Managed to flee the scene and
Entered a forest to save themselves.
They were later rescued by the local police,
They were trying to reach the nearest police station,
The rescue party was blocked by a mob and
The 5 villagers were snatched from police custody
About 2 km away from Nongpok Sukmai Police Station.
The mob killed one of the men,
Forced to remove their clothes of all three women,
And strip naked in front of the mob,
One of the women was brutally gangraped
In front of the others and
As the younger brother of the victim
Tried to defend his sister's modesty,
He was murdered on the spot.
On May 18, complaint was made,
That village was attacked,
The victims for shelter fled,
The police rescued,
On the way when taken to police station,
Men and women were stopped,
Those persons were left to the mob,
Allegation is that it is arranged by the police.
By the mob, women are paraded naked,
Sexually assaulted,
Dragging by men towards a field,
Forcibly groping them in the field,
Forcibly paraded, publicly molested, and
Allegedly they were gang-raped.
On circulation of a leaked video sparked
national outrage,
By the public shock, Manipur police
to order an investigation to be made,
Till then, there was silence,
Two months after the state government and
police to take action prompted,
The operation to arrest more of
the perpetrators is ongoing, police said.
Women’s bodies become sites of male violence,
Especially during communally charged conflicts,
It is a long-known grim global reality, and
Neither is everyone fooled,
By social-media driven poison installed.
What we witnessed in Manipur,
It is a social and political dislocation of sort of deeper,
India’s social contract is melting,
The systems of violence in and around Manipur, and
The structures of silence around it.
The state imploded into civil strife, social cleavages,
Between Meitei and Zo-Kuki communities,
Two communities have turned into a de facto partition,
With well over a hundred dead,
Thousands displaced,
Many churches destroyed,
Properties burnt, and
A no-man’s land between the hills and
The Valley secured by the army to boot.
The state administration stands partitioned,
It brings shame to humanity,
Then the answer is that,
All state governments would ensure law and order,
And in all socially created erosions,
We find this is the answer of persons in power.
I saw the video of the public,
Brutal and utterly shameful assault by public.
I broke down.
Nothing can excuse or
Justify the sheer inhumanity,
Of what took place and
The incident also brings to the fore
Some deeper issues.
In Manipur, women have had
An important symbolic role in public life
And protests,
Whether it is the Imas of Ima Keithel (the women’s market) or
Meira Paibis or
Even the women who led the Nupi Lal (Women’s War)
Against the British.
However, the reality on the ground is different,
And women are subject to deep oppression.
And the other issue is that
Individuals have a conscience,
But imagined collectives don’t.
India’s social contract appears to be eroding,
India’s social contract seems to be weakening,
It is because wrongdoers are in power,
Those aren’t being held accountable for
Creating social tensions disturbing law and order.
Justice to the two survivors of this mob assault,
Only can be delivered, to ensure accountability
Of persons in power,
For which India needs to fight for.

Offence outraging modesty of a woman
********************************
Section 354—This provision makes outraging the modesty of a woman, a punishable offence. It was originally read:
“Whoever assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will thereby outrage her modesty, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”
With the passage of the Criminal Law (Amendment) Act, 2013, Section 354 was amended to make the punishment more stringent. The sentence was changed to not less than one year and up to five years. The offence is cognizable, which means the police can arrest without a warrant, non-bailable, which means that bail is not a right of the accused person and is granted at the discretion of the judge, and can be tried by any magistrate.
The words “assault” and “criminal force” (used in the Section) are defined in Sections 351 and 350 of the IPC, respectively. Section 351 says that whoever “makes any gesture”, or “preparation intending or knowing” that it’s likely to cause any person present to apprehend that he is “about to use criminal force to that person”, commits an assault. Section 350 says that criminal force is said to be used when someone “intentionally uses force” on “any person”, without their consent, to commit any offence or uses force intending or knowing that it’s likely to cause “injury, fear or annoyance to the person” on whom it is used.
Intention and knowledge are vital ingredients for the alleged act to fall under the purview of IPC Sections 354, 351, and 350.
The IPC does not define anywhere what constitutes an outrage to female modesty. The Apex court noted in its 2007 ruling in ‘Ramkripal vs. State of Madhya Pradesh” that the
“essence of a woman’s modesty is her s*x”.
The court also gave examples such as the act of pulling a woman, removing her saree, or requesting s*x, knowing her modesty might be outraged, as sufficient to fall under this section, even without any deliberate intention.
The possible punishment under Section 354 ranges from a jail term of up to five years or fine or both.

Offence of s*xual overtures

Section 354A of the IPC, which entails “physical contact and advances involving unwelcome and explicit s*xual overtures”; or demanding or requesting s*xual favours; or showing po*******hy against a woman’s will, or making s*xually coloured remarks. In 2013, the section was amended to say that anyone who s*xually harasses a woman by unwelcome physical contact, advances, a demand or request for s*xual favours, or showing her po*******hy can face up to three years imprisonment, a fine, or both. For those making s*xually coloured remarks against women, the punishment in this section could be imprisonment for up to a year, a fine, or both.
The offences under Section 354A are cognizable but bailable.

Offence of stalking
***************
Stalking under Section 354D IPC-- Before 2012, laws in India had no provision for punitive punishment in cases of stalking. It was only after the December 16, 2012 gangrape and murder case that stalking was made a “bailable offence.” Following this, the Criminal Law (Amendment) Act, 2013, was passed, making stalking a punishable offence under Section 354D of the IPC, with imprisonment of up to three years and a possible fine on conviction for first-time offenders. A second or subsequent conviction can result in up to five years of imprisonment along with a fine. Section 354D defines stalking by a man who “follows a woman and contacts, or attempts to contact” her “to foster personal interaction repeatedly despite a clear indication of disinterest” by her. Additionally, it extends the meaning of “stalking” to include monitoring “the use by a woman of the internet, email or any other form of electronic communication.”
An exception to this section can be claimed if a man was stalking to prevent or detect crime and was “entrusted with the responsibility of prevention and detection of crime by the state.” If the stalking was done “under any law or to comply with any condition or requirement imposed by any person under any law” or was justified in the particular circumstances as reasonable, the man will not be charged with the offence.
Section 354D is that the first offence is “bailable”. It implies the accused need not be produced before the court to seek bail and can walk to freedom from the police station itself.
The Justice Verma Committee, set up in the aftermath of the December 2012 case, had recommended that stalking be introduced as a non-bailable offence with one to three years in jail as punishment. Facing opposition from several parties, the Bill to make Section 354D a non-bailable offence was eventually modified to say that the first offence of stalking would be bailable while the subsequent offence would be “non-bailable” with an increased punishment.

Criminal intimidation
*******************
Section 506 entails punishment for criminal intimidation, which can extend to two years, a fine, or both.
Section 503 that defines the term “criminal intimidation” as threatening another person with “any injury to his person, reputation, or property, or to the person or reputation of any one in whom that person is interested” intending to cause him alarm to make him do or not do any act as a means of avoiding the “execution of such threat.”
Section 506 says that if a person threatens someone else to cause “death or grievous hurt” or “destruction of any property by fire”, or an “offence punishable with death or life imprisonment or imprisonment up to 7 years,” or “impute unchastity” or adultery “to a woman,” they will face up to 7 years imprisonment, a fine, or both.
This is a non-cognizable and bailable offence, meaning arrest requires a warrant, and bail can be granted.

Abetment of an offence
*****************
Section 109 of the IPC, says that “whoever abets any offence shall, if the act abetted is committed in consequence of the abetment, and no express provision is made by this Code for the punishment of such abetment, be punished with the punishment provided for the offence.”
Under Section 107 of the IPC, “abetment of a thing” has been defined as instigating a person to do a thing, engaging with one or more persons in a conspiracy to do a thing, or intentionally aiding “by any act or illegal omission, the doing of that thing.” An example of this is if A offers a bribe to a public servant, B, as a reward for him doing some favour for him in the course of his duty, and B accepts that bribe, then A has abetted the offence of bribing a public official. Whether this offence is cognizable, bailable, and its overall punishment is determined by the offence for which one stands accused of abetment.
