*3 Persons Drown To Death As Soil-excavation Machine Overturns, Falls into Ditch in Reasi*

Srinagar, Dec 10 Three persons died after a soil-excavation machine (JCP) overturned and fell into a ditch at Mahore in Reasi district on Saturday evening.

An official told that a soil-excavation machine working in Sungri nallah in Chassana overturned and fell into a ditch, resulting in on-spot death of three persons.

The official identified the trio as Natish Kumar (23) of Kalakote Rajouri, Rajinder Kumar (27) of Patnitop Udhampur and Hushayair Singh of Balmakote Reasi.

Confirming it, SDM Mahore Sayed Mazhar Ali Shah told that the trio died due to drowning.

Jammu, Dec 09 : In a petition filed and argued by Advocate Ankur Sharma seeking registration of FIR against ex-BJP Cabinet Minister Abdul Gani Kohli and others for construction of educational complex on 10 kanals of forest land at Nowabad Sunjwan, a Division Bench of Jammu & Kashmir and Ladakh High Court comprising Chief Justice N Kotiswar Singh and Justice Moksha Khajuria Kazmi has directed Deputy Commissioner Jammu to produce the Vigilance record and enquiry conducted by Tehsildar Bahu on the next date of hearing.

When the PIL came-up for hearing, Division Bench observed, “reply has been filed by Deputy Commissioner, Jammu in which it has been mentioned that a preliminary enquiry was conducted by the Vigilance Organization. However, no specific finding was given and it is on the instance of this court, the Deputy Commissioner Jammu directed the Tehsildar Bahu to personally conduct a demarcation on mission mode by preparing daily log of the proceedings who, accordingly, submitted a report on 30.05.2016”.

“The report of Tehsildar reveals that one Bee Enn Trust has constructed the College, Paramedical Institution and the ATM on Khasra No. 264 of village Channi Rama, Tehsil Bahu which is recorded under the ownership and cultivation of the State. The Bee Enn Trust has no entry in the Revenue records, as the said land continues to be shown under the ownership of the State. However, as per the communication of SVO, it appears that their enquiry has revealed that the Trust has occupied land in Khasra No. 356 at Village Sunjwan, which is also recorded under the ownership of State, but under the occupation of Forest”, the DB observed.

Division Bench also noted that in the affidavit filed by Divisional Commissioner, Jammu on 09.09.2020 it has been mentioned that Bee Enn College, falls under Khasra No. 264 of Village Channi Rama, Tehsil Bahu which is a State land not in Khasra No. 356 of Village Sunjawan Forest land.

“Since it has brought to the notice of this court that a petition has been filed by B. N. Public School being WP(C) No. 249/2023 which is also an institution connected with respondent. This court vide order dated 23.08.2023 had directed the Registry to scan the record of the writ petition and place the same on record”, the DB said, adding “the needful has not been done by the Registry. The hard copy of the same has been produced before us and on perusal of the same it is seen that the writ petition was filed for seeking quashment of circular No. 02-JK (Rev) 2023 dated 09.01.2023 issued by Union Territory of Jammu & Kashmir and Ladakh together with the notice No. TB/PS/2022-2923/02 dated 27.01.2023, issued by Tehsildar (Estate Officer), Assistant Collector 1st Class, Bahu Jammu whereby Abdul Gani Kohli has been asked to vacate State land measuring 16 Kanals falling under Khasra No. 264 (new) (356 old) of Village Channi Rama, Tehsil Bahu”.

“In the petition, the Single Judge vide order dated 10.02.2023 has observed that for the purpose of showing the fact that at the site there is a school, in which a sanction came to be accorded in favour of the B.N. Public School, Nawabad Bathindi upto Class 8th vide Government order No. 730-Edu of 2002 dated 24.04.2002. However, in the order, there is no reference to the fact that site of the school is on the State land, but it seems that perhaps by using the Government order it is the state land which came to be grabbed and building has been erected”, the DB further observed.

“The Single Judge though did not find a prima facie case for staying the order, however, granted interim protection to the effect that while Divisional Commissioner, Jammu was directed to retrieve the possession of the free land falling within the premises of the school except the school building and there shall be no demolition of any part of the school building in retrieving the possession. There shall be no obstruction caused on behalf of the petitioner or for that matter Abdul Gani Kohli in any manner whatsoever in the course of exercise by the official deputed to take over the possession of the rest of the land except school building”, the DB said.

Senior AAG S S Nanda submitted before the court that the land has already been retrieved leaving the school building. “We also noted that in the writ petition the respondents have not filed any affidavit”, DB observed.

Considering the fact that the present PIL has arisen out of writ petition bearing WP (C) No. 933/2015 which was converted to a PIL and the land in issue appears to be the same which is alleged to be a State land grabbed by certain persons unauthorizedly, the DB directed the Registry to tag the record of WP(C) No.

249/2023 along with the present PIL inasmuch as, the land, which is alleged to have been grabbed, appears to be same in this writ petition also. Accordingly, the DB issued direction to respondents in WP(C) No. 249/2023 to file their affidavits without fail and also directed Deputy Commissioner Jammu to produce the Vigilance record and enquiry conducted by Tehsildar Bahu on the next date of hearing.

The arrested accused have been identified as Shambu Ram s/o Bittu Ram r/o Bazigar Basti Swankha morh Vijaypur, Dharminder Singh s/o Baldev Raj r/o Bashat tehsil Chenani district Udhampur and Dhuni Chand s/o Sant Ram r/o Udhampur.

Shambu Ram is a r**e accused and has been arrested in case FIR No. 174/2023 u/s 376, 452, 323 IPC registered at Police Station Vijaypur on the written complaint of a woman.

Dharminder Singh has been arrested near infamous ‘Chitta‘ hotspot of Sarore, Bari Brahmana possessing he**in valuing rupees twenty two thousand approximately in case FIR No. 273 U/S 8/21/22/27-A/29 NDPS Act.

Dhuni chand is accused of causing death of a woman by negligent driving.

The arrests have been made by Police teams comprising by SHO PS Vijaypur Sandeep Charak, SHO PS Bari Brahmana Sumit Sharma and PSI Nirmal Singh under the supervision of SDPO Vijaypur Rohit Kumar, SDPO Bari Brahmana Rahul Nagar and Additional SP Samba Surinder Choudhary.

90 out of 230 newly-elected MLAs in MP have criminal cases: ADR report

Bhopal, Dec 7: As many as 90 out of the 230 newly-elected MLAs in Madhya Pradesh have criminal cases against them, according to a report released by Association for Democratic Reforms (ADR).

According to the report, 34 winning candidates out of 230, which is nearly 15 per cent, in the state have declared serious criminal cases against themselves.

Of these 90 MLAs having criminal cases, 51 belong to the BJP and 38 belong to the Congress.

In the 2018 Assembly polls, 94 MLAs had declared criminal cases against themselves, with 47 facing serious charges, the report said.

The report further noted that the number of women legislators in the state Legislative Assembly increased slightly in 2023.

In 2023, 27 women candidates won the assembly elections — six more than the 2018 tally.

In the 2018 Assembly polls, out of 230 MLAs, 21 MLAs, around nine per cent, were women. In 2013, a total of 30 women members were elected to the Assembly, the report said.

Although the number of women MLAs in the state is a bit higher than that of the last polls, the women’s representation in the state Assembly remained far behind the promised 33 per cent.

The incumbent BJP had given tickets to 27 women, and Congress to 30. Of the 57 women candidates, 47 per cent won.

BJP fared better as 21 of its candidates emerged victorious, a big jump from 2018 when only 14 of its 27 women candidates had won. Only six women candidates, who contested the election on Congress tickets, could manage to win the elections this time.

Also, female voter turnout rose by two per cent in the 2023 Assembly polls compared to 2018, when 74 per cent of women stepped out to exercise their franchise.

The report further revealed that 205 newly-elected MLAs in the state (89 per cent) are ‘crorepati’. Of these crorepati MLAs, 144 belong to the BJP while 61 are from the Congress.

The number of crorepati MLAs in the state has increased in comparison to that of the last Assembly polls when 187 MLAs were crorepatis.

BJP MLA from Ratlam city constituency in Ratlam district, Chetanya Kasyap is the richest MLA in the state whose total wealth is over Rs. 296 crores. Similarly, a BJP MLA from Vijayraghavgarh assembly seat in Katni district, Sanjay Satyendra Pathak is the second richest MLA having a wealth of over Rs. 242 crores followed by Congress MLA Kamal Nath who has a total wealth of over Rs. 134 crores, the report said.

Besides, 161 winning candidates are graduates or above educational qualifications. Similarly, 64 candidates have declared their educational qualification to be between class 5th pass and class 12th pass, while three winning candidates are diploma holders and two are just literate, the report added.

The proportion of MLAs with graduation degrees in the state was 44 per cent in 2018.

ADR is a non-profit organisation which discloses the criminal, financial, and educational background of the candidates contesting elections.–(IANS)

One person killed, 24 injured in minibus-car collision in Rajouri

Jammu, Dec 6: One person died and 24 others were injured in a collision between a minibus and a car in Rajouri district on Wednesday.

They said that the mini-bus ( JK11A-3415) was on its way to Rajouri from Manjakote when it had the collision with the private car (JK02 CP 2442). One person died and 24 others were injured in the accident which took place near Thandikassi area of the district this morning, a police official told. He said a case has been registered and further investigations taken up.

Bomb scare at DPS Jammu, search operation underway

Srinagar, Dec 6 A purported bomb scare at Delhi Public School Jammu has created widespread in and outside the institution since this morning, official sources said.

The sources informed that Bomb Disposal Squads alongside several contingents of security forces have reached Delhi Public School, at residency road Jammu, after a teacher of the institution received a bomb threat in a phone call.

"The teacher informed the school administration about the purported call, following which BDS was informed", they said.

"A search operation is underway at the educational institution, however there was no detection of any explosive devices or any suspicious or incriminating material", they said.

"The students continue to remain inside the institution", they further said.

*Top LeT terrorist, who conspired 2015 Udhampur attack, killed by 'unknown men' in Pakistan*

New Delhi, Dec 6: Amid a series of "phantom" attacks on the terrorists who had once attacked India, another most wanted Lashkar-e-Taiba (LeT) militant was gunned down by "unknown" men in Pakistan's Karachi.

According to media reports, Hanzla Adnan, who was believed to be the masterminded of the attack on a BSF convoy in Jammu and Kashmir's Udhampur in 2015, was killed outside his house on the intervening nights of December 2 and 3.

Adnan, who is also believed to be close to LeT chief Hafiz Saeed, the mastermind of the 26/11 Mumbai attacks, was secretly taken to a hospital in Karachi by the Pakistani Army, media reports claimed. According to the report, he succumbed to his injuries on Tuesday, December 5.

2015 Udhampur attack

According to the document tabled in the Parliament by the Ministry of Home Affairs, "On August 5, 2015, two Pakistani LeT terrorists, clad in civilian clothes, attacked a BSF convoy on the Jammu-Srinagar Highway near Narsoo Nallah, Tehsil Chenani, District. Udhampur."

"Two BSF personnel died in the attack and 14 BSF personnel were injured. One of the two militants involved in the attack was killed, while one was subsequently apprehended by the local people and the police. Interrogation of the captured terrorist revealed his identity as Md. Naveed Yakub @ Usman, Resident of Faisalabad, Pakistan," it noted.

Besides, he was also considered a mastermind of the Pampore attack wherein at least eight security personnel were killed.

Back-to-back killings in Pakistan
Notably, this was not the first time that a terrorist linked to the spread of terror in India was targeted by unidentified men on its own territory. According to multiple media reports, this was the 19th killing of a terrorist responsible for various attacks in India was shot dead in Pakistan in the past 20 months.

Earlier last week, Khwaja Shahid, who was believed to be the mastermind of the 2018 attack on Sunjuwan Army Camp in Jammu, was found beheaded in Pakistan-occupied Jammu and Kashmir (PoJK), days after he was reportedly abducted by unknown men.

In October, Daud Malik, who was also considered a trusted member of Masood Azhar, was killed in broad daylight in Waziristan. –(IndiaTv)

District Drug destruction committee headed by *SSP Udhampur Sh. Joginder Singh-JKPS* and comprising of *Addl. SP Udhampur Sh. Anwar Ul Haq-JKPS, SDPO Chenani Sh. Tahir Amin Sheikh and Sh. Darshan Singh Sr. PO Udhampur* , conducted the destruction of physcotrophic substance today.This consignment was seized in 20 different NDPS cases registered in District Udhampur. The destruction was done through incineration in M/S Anmol Healthcare Rakh Rara, Swankha Morh, Vijaypur, Samba.

During incineration 1387.830 kgs of poppy straw and 11.35 gms of Heroine has been incinerated by following all the codal formalities. The destruction was carried out by incineration in a controlled manner as provided under rules to avoid any harm to the environment.

In the entire process was completed in presence of EMIC Sh. Mohd. Saleem (NT Roun) and Sh. Deepak Abrol Divisional Officer JKPCC Samba (south).Before this the seized contraband was checked, weighted and tallied with the record. The entire proceedings,right from godown upto incinerator was duly videographed and kept under proper security.
Pertinently this huge quantity of the seized contraband substance has been destroyed under section 52-A of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Before this, On 31st May 2023, 1500 kg of Narcotics and psychotropic substances and on 22nd July 2023, 771 kg 934 grams of Narcotics and psychotropic substances were incinerated by Jammu and Kashmir Police District Udhampur.

*Amit Shah to move Bills on J&K Reservation Act, J&K Reorganisation Act on Day 2 of Lok Sabha*

New Delhi, December 5: The Bill to amend the Jammu and Kashmir Reservation Act 2004 and the Jammu and Kashmir Reorganisation Act 2019 is likely to be moved by Union Home Minister Amit Shah in the Lok Sabha on Tuesday.

The Jammu and Kashmir Reservation Act provides for reservation in appointment in state government posts, and admission to professional institutions, for certain reserved categories. The Bill provides for reservation in professional institutions for economically weaker sections.

The Jammu and Kashmir Reorganisation Act, 2019 provides for the reorganisation of the state of Jammu and Kashmir into the union territories of Jammu and Kashmir and Ladakh. The Bill increases the total number of seats in the Jammu and Kashmir Legislative Assembly from 83 to 90. It also reserves seven seats for Scheduled Castes and nine seats for Scheduled Tribes.

Moreover, on Tuesday, Krishan Pal for Ministry of Heavy Industries, Sanjeev Kumar Balyan for Ministry of Fisheries, Animal Husbandry and Dairying, Nityananad Rai for Ministry of Home Affairs, Sushri Shobha Karandlaje for Ministry of Agriculture and Farmers Welfare, Kailash Choudhary for Ministry of Agriculture and Farmers Welfare and Ajay Kumar for Ministry of Home Affairs will lay papers on the table.

The Secretary General will report a message from Rajya Sabha regarding the Post Office Bill, 2023.

Nisith Pramanik will be making a statement correcting a reply given on August 8 to an Unstarred question asked by MP Sushil Kumar Singh on Vibrant Village Programme. He will also give reasons for delay in correcting the reply.

On Monday, the first day of the Winter Session of Parliament saw two bills being passed. The Standing committee reports on 'The Bharatiya Nyaya Sanhita, 2023', 'The Bharatiya Nagarik Suraksha Sanhita, 2023', and 'The Bharatiya Sakshya Bill, 2023' were tabled in the two Houses. The reports were submitted to the Rajya Sabha Chairman Jagdeep Dhankhar on November 10 by Brij Lal, MP and Chairman of the Department-related Parliamentary Standing Committee on Home Affairs.

The report of Ethics Committee, which looked into cash-for-query allegations Trinamool Congress MP Mahua Moitra, was not tabled in the Lok Sabha though it was in the listed agenda.

Rajya Sabha passed the Bill to repeal the Indian Post Office Act, 1898 and to consolidate and amend the law relating to the post offices in India. The opposition members raised questions over some provisions of the bill and asked if the government wanted to create a "surveillance state". The government rejected the apprehensions of the members.

The bill was passed by a voice vote after a reply by the Minister for Communications, Electronics and Information Technology Ashwini Vaishnaw. The bill provides that Post Office shall provide such services as the Central Government may by rules prescribe and the Director General of Postal Services shall make regulations in respect of activities necessary to provide those services and fix the charges for such services. The bill provides India Post will not incur any liability with regards to its services, except any liability prescribed through rules.

Lok Sabha passed the Advocates (Amendment) Bill, 2023 which is in line with the government's policy of repealing all obsolete laws or pre-independence Acts which have lost their utility. The Government in consultation with the Bar Council of India has decided to repeal the Legal Practitioners Act, 1879. It has decided to amend the Advocates Act, 1961 by incorporating the provisions of section 36 of the Legal Practitioners Act, 1879 in the Advocates Act, 1961 so as to reduce the number of superfluous enactments in the statute book
The government has 21 Bills on its agenda for the session, including the bills to replace the IPC, the Indian Evidence Act and the CrPC.–(ANI)

*Filing of Application for Hajj-2024 Begins*

Srinagar, Dec 4: Hajj Committee of India has announced the start of filing of applications for Hajj pilgrimage from today.

The Committee, falling under Ministry of Minority Affairs, has informed that the Hajj-2024 will be organised under Hajj Policy-2023, dated 29.11.2023.

"The process of filing of applications for Haj-2024 through Haj Committee of India shall commence online from 04.12.2023 and will close on 20.12.2023", reads the notification, as per news agency Kashmir Scroll.

"The application forms, the notification reads, can be filled and submitted online at website of Haj Committee of India http://hajcommittee.gov.in or through the android mobile App 'Haj Suvidha'."

"Applicants are advised to read the Guidelines/Undertaking carefully before filling Haj Application Forms. Machine readable valid Indian International Passport issued before the closing date of application and valid upto 31.01.2025 is must", reads the notification further.

*28,522 murder cases registered in India in 2022, 78 every day: NCRB*

New Delhi, Dec 4: A total of 28,522 FIRs of murder were registered in 2022 – an average of 78 killings every day or more than three every hour – across India, down from 29,272 in 2021 and 29,193 in 2020, according to the latest NCRB data.

'Disputes' with 9,962 cases was the motive in highest number of murder cases in 2022 followed by 'personal vendetta or enmity' in 3,761 cases and 'gain' in 1,884 cases, said the data in the annual crime report of the National Crime Records Bureau, which functions under Union Ministry of Home Affairs.

The rate of murder per lakh population across the country stood at 2.1, while the charge sheeting in such cases was 81.5, according to the NCRB.

Uttar Pradesh saw the highest number of such FIRs at 3,491 in 2022 followed by Bihar (2,930), Maharashtra (2,295), Madhya Pradesh (1,978) and Rajasthan (1,834), with the top five states together accounting for 43.92 per cent of murder cases in the country, the data showed.

The top five states with the least number of murder cases in 2022 were Sikkim (9), Nagaland (21), Mizoram (31), Goa (44), and Manipur (47), according to the NCRB, which is tasked with collection and analysis of crime data.

Among Union Territories, Delhi, the national capital, registered 509 cases of murder in 2022 followed by *Jammu and Kashmir (99)*, Puducherry (30), Chandigarh (18), Dadra and Nagar Haveli and Daman and Diu (16), Andaman and Nicobar Islands (7), Ladakh (5) and Lakshadweep (Zero).

Across India in 2022, the murder rate was highest in Jharkhand (4), followed by Arunachal Pradesh (3.6), Chhattisgarh and Haryana (both 3.4), Assam and Odisha (both 3).

Uttar Pradesh (1.5), Bihar (2.3), Maharashtra (1.8), Madhya Pradesh (2.3) and Rajasthan (2.3) fared better in terms of crime per lakh population.

In terms of age, 95.4 per cent victims of murder were adults.

Of total murder victims, 8,125 were female and nine third-gender persons, with men constituting about 70 per cent of victims, according to the NCRB.

In a note of caution about the annual report, the NCRB said the primary presumption that the upward swing in police data indicates an increase in crime and thus a reflection of the ineffectiveness of the police is fallacious.

"Rise in crime' and 'increase in registration of crime by police' are clearly two different things, a fact which requires better understanding. Thus an oft-repeated expectation from certain quarters that an effective police administration will be able to keep the crime figures low, is misplaced," it stated.

"Increase in crime numbers in a state police data may in fact be on account of certain citizen centric police initiatives, like launching of e-FIR facility or women Helpdesks, etc.

"The increase or decrease in crime numbers, however, does call for a professional investigation of underlying factors pertaining to the local communities to suitably address the pertinent issues," it added.–(PTI)

CS office bids farewell to the outgoing Chief Secretary

JAMMU, NOVEMBER 30: The office of the Chief Secretary, J&K today bade farewell to the outgoing Chief Secretary, Dr. Arun Kumar Mehta on his superannuation at the Civil Secretariat, Jammu.

Speaking on the occasion Dr Mehta recalled his tenure as the Chief Secretary of Jammu and Kashmir and expressed his appreciation to the contribution and support provided by the staff of the office.

Dr. Mehta also acknowledged the contribution of the General Administration Department in promoting coordination within the administrative team of Jammu and Kashmir. He urged upon all officers and support staff to feel proud on the success of their efforts in promoting transparency and efficiency in J&K.
