The Supreme Court on Monday refused to stay inquiry against e-commerce giants Amazon and Flipkart by the Anti-Competitive Commission for alleged Competition Law Violations, stating “Big Corporates like Amazon and Flipkart should be subject to transparency and inquiry.”
However, the bench led by Chief Justice N.V. Ramana and also comprising Justices Vineet Saran and Surya Kant, granted four more weeks to e-commerce giants to comply with the order for joining the investigation.
Earlier on July 23 this year, the High Court of Karnataka had upheld the Competition Commission of India’s decision to conduct an investigation through its Director General into whether they had entered into anti-competitive agreements in violation of the provisions of the Competition Act, 2002.
Observing that the enquiry initiated by CCI cannot be crushed at the initial stage, the Bench described the approach of both the e-commerce majors as “an attempt to ensure that the enquiry does not attain finality.”
Difference between a divorce and judicial separation:
Though the grounds for judicial separation and divorce are the same, the two procedures are very different. Some of the difference are as follows:
Parties are still considered to be married even though they are judicially separated but after a decree for divorce is granted the marriage ends and both parties can enter into subsequent domestic relationships with other people.
The process of judicial separation involves only one judgement, but the divorce procedure involves two judgements, one when the petition is filed, and one 6 months post the first judgement.
When hearing a petition for judicial separation, the judges presume that the couple can reconcile and resume cohabitation but while hearing a petition for divorce, the judges are more concerned about the permanent breakdown of the marriage.
Conclusion:-
Judicial Separation can be the first step to a divorce and the last step in an attempt to reconcile the parties so it is an option that every couple seeking to dissolve their marriage should consider. Both these reliefs are granted by the personal laws and enforced by the judiciary to ensure sufficient recourse to parties whose marriages have broken down but there’s still a chance for reconciliation and parties whose marriages have irretrievably broken down.

What is the meaning of the term 'taking cognizance'?
The term 'taking cognizance' has not been defined in Code of Criminal Procedure. When any Magistrate takes cognizance under section 190 (1) (a) Cr.P.C., he must not only have applied his mind to the contents of the petition, but he must have done so for the purpose of proceeding in a particular way as per procedure prescribed in the Cr.P.C., and there after sending the complaint for further enquiry. A magistrate can also order investigations under section 156(3) of Cr.P.C.
What is an F.I.R ?
F.I.R. means First Information Report, made to police, about commission of a cognizable offence, In effect, it amounts to putting law in to motion by giving information relating to the commission of a cognizable offence to an officer in charge of a police station, (which shall be reduced into writing and read over to the informant) and shall be signed by the person giving such information. It is mandatory to give a copy of the first information report (as recorded by police) to the complainant or informant free of cost.
