Real Estate Scams and How to Avoid Them – Part 2

The Tourist Scam

This one is probably one that most fall for, especially if they really want the 'property on sale' or 'property to let'. The masquerading property owner receives a call in own country but says he is touring abroad. He then gives an email from which all communications will be made in his absence. As the unwary customer falls to the trap, he is given an account to make his first deposits or probably the whole amount. In the case of a locked property, the keys are to be sent after the first deposits are made.

Precaution Tips:
• Always seek to meet (physically) and know the owner of the property.
• Never send money before signing a written agreement with the property owner.
• If the it's difficult to meet the 'owner', call off the whole thing immediately.

Request for Personal Details

With nearly every website you visit asking for one or more of your personal details, people now find it almost normal to just submit the details as requested. This has now being embraced by real estate scammers as well. A 'buyer' gives an excuse of being very busy or very far and requests the property owner for personal details including account details that he uses to rob money from the accounts.

Precaution Tips:
• Never give out personal details whatever the case unless you are dealing with popular brands like linked in.
• If the buyer has no time to find out more about what he is buying, well, he's probably not a buyer after all.
• Never provide your credit card verification code.

Investment Seminars and Courses

In the last decade and more so the last five years, 'young millionaires' have increasingly hosted these seminars. It is important to acquire knowledge about investment and entrepreneurship. However, you should be very careful about the organizers. While there are legitimate seminar providers, some of them want to milk money from the gullible and some are there in between.

Looking at the money minters, they organize the seminars and charge monies from small amounts to thousands of dollars. The info provided can be easily acquired through the internet for no fee at all. 'High-Profile' investors attend the seminars and give rehearsed formulas of how they got rich very quickly. Main trick is to convince attendees to invest in their 'high income generating projects'.

Some seminar hosts are however genuine to the extent that they provide legitimate info about investing, giving courses that will earn attendees legitimate certificates. The swindle is in the amount of money they charge, the length of time it takes to complete the course and the quality of knowledge imparted to the attendees.

Precaution Tips:
• Before you attend a seminar, do a research on the hosts. If there is nothing to suggest that they are established, maybe they are not worth your time.
• Enquire about the topics covered during the seminar. Some of these can be easily acquired through the internet or you may have already mastered the topics earlier.
• Never be in a rush to invest in project before you familiarize yourself with it or at least see concrete evidence of its success.

Real Estate Scams and How to Avoid Them.

‘’I have skipped events for the last six years to save enough money to get myself a home. However, now that am ready to make my first purchase ever, I’m afraid there’s no agent or landlord I’ve been able to trust yet.’’ These were the romanticisms of one of the not-very-sure buyers I helped convert into a loyal customer two years ago.

The buyer had met a number of agents and landlords, visited numerous properties on sale, rifled several listings, but had not been convinced any of them were genuine. After engaging him in a friendly conversation I finally summoned the guts to ask him why it was difficult to trust any one of them. My bona fide belief is that at least seven out of ten Kenyan real estate dealers are honest. ‘’I have accumulated these savings laboriously, instead of risking it I’d rather buy a car or continue ‘hiding’ it in my bank account,’’ was the answer he gave me!

By making such a decision, this buyer would have overlooked an appreciating asset and probably bought himself the car. I however managed to connect him to a company I was an affiliate. They got him a house which he bought and today he’s happy with the choice he made.

My encounter with this client inspired me to take a survey of finding out the frauds associated with real estate and how buyers and even sellers can avoid them.

1. Air for Sale Plot for Sale.
This is probably the most malignant form of fraud. A con artist wears the hood of a licensed professional agent and lists a non-existent property.
Stacy recalls how this particular one happened. ‘’The plot looked like exactly what I wanted. The poster – PLOT FOR SALE – at the entrance of the plot cleared all my doubts. Since the area was so prime, I payed instantly to secure it. That was the last I saw or heard of that ‘Agent’ and my had earned 800k.’’ She says sadly.
Efforts to reach and later to trace her ‘Agent’ bore no fruits since all his lines were blocked and the bank account deactivated.
Not all that is shiny is a gem.

There is a case of mutated selling. One person, especially a land owner, genuinely sells one piece of property once, then decides it’s a good way to earn extra cash.

Using the same title, he goes ahead to sell the same piece to several other different unwary customers upto the nth time. If not caught on time, he absconds leaving his naïve victims fighting it out in court, all of them in possession of similar copies of the original title.

Precaution tips:
Don’t be in a hurry. It may seem and sound like a very great deal, but there is some worth in giving yourself time to verify the legitimacy and validity of the ownership documents. Go an extra mile to know the neighborhood. This will cost you time but it is worth it.
Engage Licensed Companies. If your agent or seller is not affiliated to any company, you may need to request a registered company to do an appraisal for you at a fee. Paying a small fee to acquire useful info is much safer and less time consuming than losing your money and fighting it out in court. You would also agree that following up with a registered company is much easier than just any Agent.
Use all the W and H questions. Sometimes asking too many questions sounds like we are being paranoid and judgmental. However an agent who has nothing to hide will be very willing to clear all your doubts by answering the questions you ask. So in case you don’t want to pay for an appraisal, use every opportunity to inquire about things that you feel are not clear.

2. Title Fraud
In the last two decades or so, title fraud has been very rampant in Kenya. I choose to classify it into two.
a. Title/Identity theft
b. Land grabbing.

a. Title/Identity theft.
I’ve been a victim of this once – it taught me a precious lesson. I was about to close a deal with a partially deaf customer when I realized that the documents my client – the land owner had, did not match the acreage of the land he claimed to own, neither were the names on the title same as the ones on his I.D. He kept pushing us to sign the documents fast and to make our initial payments for the processing of the land transfer to begin. But when we insisted about finding out the authenticity of his documents, he stormed out of the office and we never heard from him again.

Evidently my client had tried forging a title belonging to a close friend or family member, only he did not do his homework well. People you let close to you might end up stealing your identity and changing the names on your certificates and property documents to theirs. Or, like in a few cases, eloping with your actual title and using it to sell your property.

The ‘friend’ could decide to borrow you money without actually approaching you. So after forging your title, they apply for a loan or a mortgage through the bank. After pocketing the money they leave you with the burden of sorting the loan with the bank.

b. Land grabbing.
Much of land grabbing cases are either initiated or carried out by those who hold high office, or are very influential in the community. Properties with absent landlords, schools and even land allocated by the government for community benefit may end up in the hands of a gluttonous leader somewhere. The titles are easily changed by paying a small bribe.

Am particularly glad with all the changes being made in the lands ministry. Everything has been digitized, the registry and its procedures are now easily accessible by the public and we can actually contribute to decision making in the ministry. At least now we can rest assured that the managers of our land and the registrars will have no hand in title theft.

Precaution tips:
Of cause a few cases are successfully resolved in court, but why wait till it gets to that point.
Lesson #1: Vet the person you are dealing with
Lesson #2: As an owner, check your ownership documents with the ones in the registry at least once every six months to ensure you are not conned.
Lesson #3: Always thinks twice or more. My fake client above had promised me 5 goats on top of my commission. This was a bait to make me want to rush the transaction. It actually made me think and rethink.
Lesson #4: Be sure to have the documents in your possession and counter-check them before making any legally binding commitments.

3. Overconfidence.
It’s very important to do a research on real estate especially if the investment you are about to make will involve a lot of money. It is however wrong to imagine you know everything and cannot be duped. Scammers con even institutions like banks that are well guarded and with alert staff members.

Precaution tips:
This is where your instincts become very important. Instead of relying fully on the knowledge you have gathered, let your instincts guide you. Whenever you feel unsatisfied, give yourself time to weigh your deal. Ask questions that arise until you are convinced and contented.
