Un centenaire qui a testé, un mandat, des institutions étatiques, des guerres civiles et aux frontières, des occupations militaires, des explosions... beaucoup de décès, drames, larmes, du sang et dernièrement un crime contre l'humanité.

Since its issue, the 1909 Law has been considered the general legal framework of the work of associations in Lebanon; therefore, all non-governmental organizations (NGO's) and associations must comply with it.

This law provides a legal umbrella for organizing institutional work and ensure the continuity of several people's thoughts, positions, and conduct. Thus targeting many public interest thoughts, along with article 13 of the Lebanese Constitution, in order to enhance democracy and translate these ideas into programs such as humanitarian and relief work, environmental, democracy and transparency interests, and many other association objectives.

Article One of the Lebanese Law of Associations stipulates, “An association is a group of several persons permanently unifying their knowledge or efforts for nonprofit objectives”.

All humanitarian work, demonstrated in response to the Beirut explosion on the 4th of August at the Port of must be implemented under an organized association, registered and holder of a notification from the ministry of the interior ( علم وخبر) to avoid accountability, as mentioned in the Article 2: "Establishing an association requires no prior permit but, by virtue of Article 6, notifying the government of its establishment is a prerequisite."

This legal frame allows the NGOs, once established, to receive funds and donations, in order to be able to deliver relief work, or any other help to the targeted persons, respectively with each NGO's objectives.

اصدرت وزيرة العمل قراراً يتعلق بتسوية أوضاع العمال الأجانب المخالفين لشروط العمل والاقامة في لبنان، خلال مهلة ثلاثة أشهر ابتداءً من 31/07/2020.
وجاء في القرار:
المادة الاولى: تسوى اوضاع العمال والعاملات الأجانب، من مختلف الفئات، العاملين على الأراضي اللبنانية على النحو التالي:
أولاً: بالنسبة للعمال الذين دخلوا بصورة شرعية وانتهت صلاحية اجازة عملهم واقامتهم، فيمكنهم التقدم بطلب اجازة العمل، مرفقاً بالمستندات المطلوبة حسب الاصول، وذلك بعد الاستحصال على براءة ذمة تثبت دفع الرسوم المتوجبة عن سنوات التأخير. ويبت بها بناء للنصوص المرعية الإجراء.
ثانياً: بالنسبة للعمال الذين تم استقدامهم من قبل أصحاب عمل وهميين، يمكنهم الانتقال للعمل لدى صاحب عمل آخر.
في الحالة المذكورة أعلاه، تقدم الطلبات من قبل صاحب العمل الجديد مرفقة بالمستندات التالية:
- المستندات المطلوبة للحصول على اجازة العمل وفقاً للأصول، مرفقة بشهادة ايداع.
- مستند صادر عن الامن العام، يثبت اتمام التسوية.
ثالثاً: بالنسبة للعمال الذين دخلوا لبنان بصورة غير شرعية، تقدم طلبات تسوية أوضاعهم من قبل مستخدميهم مرفقة بالمستندات المطلوبة للحصول على اجازة العمل بالإضافة الى شهادة الايداع، وذلك بعد حصولهم على تسوية وضع من قبل المديرية العامة للأمن العام وفقاً للأصول.
وتستوفى الرسوم عن سنوات تشغيل العامل لدى صاحب العمل مقدم الطلب. وفي حال تعذر إثبات عدد سنوات العمل، فيستوفى رسم سنتي تأخير ورسم موافقة مسبقة بالإضافة الى رسم إجازة العمل، سنداً للمادة 23 من قانون موازنة العام 1999.
المادة الثانية : تقدم الطلبات في الدوائر المختصة، وتحال تلك الواردة في الفقرتين ثانياً وثالثاً لجانب وزير العمل، بالتسلسل الاداري، للبت بها.
المادة الثالثة : ترفق الطلبات المذكورة أعلاه، بما يثبت المباشرة بإجراءات التسوية، وذلك خلال مهلة ثلاثة أشهر ابتداءً من 31/07/2020.

The Multilateral Competent Authority Agreement (“the MCAA”) is a multilateral framework agreement that provides a standardised and efficient mechanism to facilitate the automatic exchange of information in accordance with the Standard for Automatic Exchange of Financial Information in Tax Matters (“the Standard”). It avoids the need for several bilateral agreements to be concluded.

Its design as a framework agreement means the MCAA always ensures each signatory has ultimate control over exactly which exchange relationships it enters into and that each signatory’s standards on confidentiality and data protection always apply.

The legal basis for the MCAA (which is agreed at competent authority level) rests in Article 6 of the Multilateral Convention on Mutual Administrative Assistance in Tax Matters (“the Convention”) which provides for the automatic exchange of information between Parties to the Convention, where two Parties subsequently agree to do so.
