On 23 November 2022, the Court of Justice of the European Union annulled a 2019 European Commission classification of titanium dioxide as a carcinogenic substance.

The Court found the European Commission’s 2019 ruling to be a ‘manifest error in its assessment’, as the study the Commission relied upon failed to take ‘relevant factors’ into account.

The EU banned the use of titanium dioxide in food in February 2022, based on scientific advice from the European Food Safety Authority (EFSA). The Court decision does not relate to the validity of the ban."
