How do you determine if you are a tax resident or non-resident in Malaysia in relation to Foreign Sourced Income remitted to Malaysia?

In the Budget 2022 announcement on 29 October 2021, you would have noted that an income tax exemption for foreign-sourced income (“FSI”) received in Malaysia by a Malaysian resident person will no longer be applicable from 1 January 2022. This means that, moving forward, the exemption for this FSI would only be applicable to a non-resident person in Malaysia.

NEW RELEASE: ABSS Payroll v13 (MY)

HRDF is expanding its scope of coverage to ALL INDUSTRY effective 1st March 2021.

Employers with 10 or more Malaysian employees are COMPULSORY to register.

Mandatory monthly contribution of 1% on employees basis salary + fixed allowance by 15th of subsequent month

Newly added industries are exempted from contribution for 6 months. Employers are expected to register by now. Contact HRDF if you have not done so.

Failure to register could be fined up to RM10,000 and/or face imprisonment of up to a year.

Failure to contribute the levy on time will be fined to an amount not exceeding RM20,000 or imprisonment for a term not exceeding 2 years or both AND a yearly interest of 10% will be charged in respect of each day of default/delay in payment.

ABSS Payroll v13 (MY) is now available with the above compliance updates.
