Mahkamah Tinggi Kota Kinabalu membebaskan seorang lelaki tempatan daripada tuduhan mengedar 101.83 gram methamphetamine di Kg. Sembulan Tengah, tiga tahun lalu tanpa dipanggil untuk membela diri.

Pesuruhjaya Kehakiman Amelati Parnell memutuskan pendakwaan telah gagal membuktikan kes prima facie terhadap Al Aznher di bawah Seksyen 39B(1)(a) Akta Dadah Berbahaya.

Al Aznher bin Ahmad, 40, yang berada dalam kandang tertuduh sebak selepas keputusan dibacakan Amelati. Kelihatan keluarganya yang berada di galeri awam turut berpelukan susulan keputusan itu.

Dalam alasan penghakiman ringkasnya, Amelati berkata setelah penilaian maksima terhadap semua keterangan saksi dan ekshibit yang dikemukakan dan selepas mendengar hujahan daripada timbalan pendakwa raya serta peguam bela tertuduh, mahkamah berpuas hati pendakwaan telah gagal membuktikan bahawa tertuduh mempunyai pengetahuan, kawalan dan milikan terhadap dadah yang disembunyikan di dalam sebuah kereta.

Perbicaraan yang berlangsung pada 23 Februari 2023 dan berakhir pada 8 Disember 2023 menyaksikan pihak pendakwaan memanggil 6 saksi pendakwaan dan mengemukakan 19 ekshibit fizikal kepada mahkamah.

Al Aznher didakwa mengikut Seksyen 39B (1) (A) Akta Dadah Berbahaya 1952 dan sabit kesalahan boleh dihukum mengikut Seksyen 39B (2) akta sama yang memperuntukkan hukuman mati atau penjara seumur hidup dan minimum 12 sebatan. Pendakwaan dijalankan oleh Timbalan Pendakwa Raya Rustam Sanip dan Adibah Saiful Bahri manakala tertuduh diwakili Azhier Farhan.

"After giving a maximum evaluation of all evidence adduced at the end of the prosecution's case, the court finds that the prosecution has not adduced credible evidence proving each ingredient of the offence of trafficking under Section 39(1)(a) of the Dangerous Drugs Act (DDA) 1952 which, if unrebutted or unexplained, would warrant a conviction.

"Based on the aforesaid reasons, the court finds that a prima facie case has not been made out against the accused. In these circumstances, the accused is discharged and acquitted without calling for his defence," said the judge.

Safiah Alijang was acquitted by the Special Corruption Court after the court ruled the prosecution has failed to establish a prima facie case.

In his broad grounds of decision earlier, Judge Abu Bakar said the evidence was clear in that the accused was not the person who made the false entry into the NRD’s iJPN system.

Accordingly, he added, the accused cannot be said to “make the false document” and commit forgery.

He said the prosecution also failed to resolve the contradiction of evidence among the prosecution witnesses.

Judge Abu Bakar said in such a case where the prosecution led with two sets of evidence, each of which contradicts and strikes at the other, the court was left with no reliable and trustworthy evidence upon which a conviction of the accused might be based.

Majistret Afiq Agoes dalam penghakimannya berkata kegagalan pihak pendakwaan mengemukakan pertuduhan pindaan dengan menyatakan kandungan secara tepat berat bersih dadah mengakibatkan padah (fatal) kepada kes pendakwaan.

Mahkamah Tinggi Kota Kinabalu membenarkan rayuan Mohd Faizal Mohd Yatim dengan mengetepikan hukuman penjara 6 tahun serta 1 sebatan oleh Mahkamah Sesyen Kota Kinabalu setelah mendapati hakim Mahkamah Sesyen terkhilaf menerima rekod sabitan lampau sebagai keterangan dan dasar yang mencetuskan penggunaan seksyen 39C(1) Akta Dadah Berbahaya 1952, sedangkan jelas sekali bahawa rekod sabitan lampau tersebut gagal mematuhi syarat ketat di bawah seksyen 400 Kanun Tatacara Jenayah dan seksyen 10 Akta Pendaftaran Penjenayah dan Orang Yang Tidak DI-ingini 1969.

“Azhier submitted that Section 10(1)(b) of the Registration of the Criminals and Undesirable Persons Act 1969 (Act 7) specifies that proof of previous convictions can only be admitted as evidence if: the extract is based on entries from the register, and certified by the Registrar to be so extracted.

In the present case, as evidenced from the PCR, it is merely a record prepared by a Registrar of subordinate court,” said Azhier and submitting further that Section 2 of Act 7 did not include Registrar of subordinate court within the meaning of “Registrar”.

He added that Registrar for the purpose of the Act 7 refers to officers appointed by the Yang Di-Pertuan Agong and published in a Federal Gazette under Section 3 of Act 7.

He further submitted that perusal of Federal Gazette P.U (B) 581/2020 did not specify that the said Registrar of subordinate court has been appointed as Registrar or Assistant Registrar of Criminals.

Accordingly, the extract prepared by the said Registrar cannot be taken as an extract retrived from “the register” within the meaning of Section 10 of the Act 7, he said.

“On this ground alone, there is insufficiency of evidence to convict the appellant under Section 15(1)(a) of the DDA and punished under Section 39C(1) of the DDA for it is not established that the appellant had two previous convictions under Section 15(1)(a) of the DDA,” submitted Azhier.

Pendengaran penerimaan masuk sebagai Peguambela dan Peguamcara adalah langkah terakhir yang perlu dilalui oleh pelatih dalam kamar (pupil in chambers) sebelum mereka layak didaftaraikan dan beramal sebagai peguam di negeri Sabah.

Hakim Mahkamah Sesyen Azreena Aziz membebaskan Nor Affandy Jemah daripada tuduhan itu selepas memutuskan bahawa pendakwaan gagal mewujudkan kes prima facie terhadapnya.

Nor Affandy dituduh memiliki dadah jenis kanabis itu pada pukul 11.30 pada 2 Januari 2020 di hadapan sebuah rumah di Taman Jumbo, Jalan Putatan Petagas.

Kesalahan di bawah Seksyen 12(2) Akta Dadah Berbahaya itu boleh dihukum di bawah Seksyen 39(2)(f) Akta sama yang memperuntukkan hukuman penjara antara lima tahun dan penjara seumur hidup, serta sekurang-kurangnya 10 sebatan rotan, jika sabit kesalahan.

Lima saksi pendakwaan dipanggil untuk memberi keterangan semasa perbicaraan. Peguam Azhier Farhan mewakili Nor Affendy.

Justiciability determines whether there is a potential availability of judicial review of the exercise of the prerogative power by the Governor (“TYT”).

In our present context, can the exercise of discretionary power by the Governor to dissolve the Assembly at the request of the Chief Minister be reviewed by the court? In layman’s term, can Tan Sri Musa Aman (“TSMA”) challenge the decision by TYT to dissolve the State Assembly?

The chief complaint by TSMA is that he had the majority to form a new government, but he was denied so. In what manner he was denied? TYT granted request by the Chief Minister to dissolve the Assembly without affording TSMA the right for an audience to present Statutory Declarations proving his majority.

In essence, his right to be heard was violated against the principle of natural justice. Because of this purported violation, TSMA filed an application to review the exercise of the prerogative power by TYT to dissolve the Assembly.

The State Attorney General representing TYT and the Chief Minister may argue that TYT has the absolute power to dissolve the Assembly which cannot be questioned in court of law.

The common law position in respect of whether prerogatives susceptible to judicial review can be found in these two earlier cases; Case of Prohibitions (1607) 77 ER 1342 and the Case of Proclamations (1611) 77 ER 1352. Both cases determined that the existence and scope of a prerogative can be tested by the courts.

In the Case of Prohibitions (1607) 77 ER 134, the claim of King James I that it was his prerogative to hear law suits himself and that he could prohibit the courts from hearing a case depending on his decision to dispose of the case himself. It was held by Chief Justice Coke that it was not part of the royal prerogative to dispense justice and that the right to hear and adjudicate cases belonged to the courts of judicature.

In the Case of Proclamations (1611) 77 ER 1352, the king purported to make a law forbidding the construction of new buildings in London. The court held that the royal prerogative did not include the power to make law. Consequently, the prohibition against the construction of buildings in London was declared invalid.

In the present case of dissolution, when TYT exercised his scope of power to dissolve the Assembly, the extent he exercised his scope of power may transgressed the principle of natural justice. This is owing to His Excellency’s failure to subscribe the prevailing common law convention of extending his invitation for an audience to the leader who commands the majority of confidence in the Assembly.

TYT has no personal power to dispense the requirement of right to be heard hence the natural justice, where the other party should be afforded with the right to be heard and to allow him to make representation of his majority to TYT.

By denying TSMA to make representation of his majority, it would be impossible for TYT to have had exercised his constitutional duty under Article 6(3) & Article 7(1) of the Sabah Constitution. Therefore, this is a fit and proper case for judicial review of TYT’s decision.

If the court made a finding that the decision by the Governor is non-justiciable as per the argument of the State Attorney General, it can mean that an illegal decision -- a decision in breach of the principles of natural justice, a decision which fails tests of Wednesbury reasonabless or proportionality -- may survive to perpetrate unfairness.

In other words, the finding of non-justiciability by the court may allow the survival of a procedurally faulted executive decision.

It would be archaic to maintain that just because a Head of State vests with discretionary power, his decision is immune from judicial review especially when the exercise of the executive prerogative is arbitrary, capricious, and unreasonable and affects the private rights, interest and legitimate expectation of the citizen.

1. Apakah itu Akta Pencegahan dan Pengawalan Penyakit Berjangkit 1988 (Akta 342)?

Akta 342 adalah undang-undang yang diperbuat oleh Parlimen Malaysia berhubungan dengan pencegahan dan pengawalan penyakit berjangkit di Malaysia.

2. Apakah kuasa yang diperuntukan kepada Menteri Kesihatan di dalam Akta ini?

Seksyen 11 Akta 342 memberi kuasa kepada Menteri Kesihatan untuk mengisytiharkan di mana-mana kawasan di Malaysia sebagai kawasan tempatan jangkitan apabila kawasan tersebut diancam oleh wabak apa-apa penyakit berjangkit.

Pengisytiharan kawasan tempatan jangkitan ini membolehkan Menteri Kesihatan mengadakan apa-apa peraturan melalui perintah di dalam Warta untuk menetapkan langkah-langkah mengawal atau mencegah merebaknya apa-apa penyakit berjangkit.

3. Apa itu penyakit berjangkit?

Seksyen 2 Akta 342 mentafsirkan Penyakit berjangkit sebagai apa-apa penyakit yang dinyatakan dalam Jadual Pertama Akta 342.

4. Apa yang dinyatakan didalam Jadual Pertama Akta 342?

Jadual Pertama Akta 342 menyenaraikan 30 jenis jangkitan. Antara yang disenaraikan ialah apa-apa jangkitan microbial lain yang mengancam nyawa.

5. Adakah Covid-19 disenaraikan sebagai penyakit berjangkit di dalam Akta 342?

Melalui pengisytiharan Menteri Kesihatan di bawah Perintah Pencegahan dan Pengawalan Penyakit Berjangkit (Pengisytiharan Kawasan Tempatan Jangkitan) 2020 - P.U(A) 87/2020, Menteri telah mengisytiharkan bahawa wabak Covid-19 sebagai suatu jangkitan mikrobial yang mengancam nyawa sebagaimana yang dinyatakan dalam Bahagian I Jadual Pertama kepada Akta 342.

6. Jadi adakah benar Perintah Kawalan Pergerakan yang diperbuat oleh Menteri ini tidak mempunyai asas undang?

Tidak benar. Menteri Kesihatan dibawah seksyen 11(2) Akta 342 diberi kuasa untuk mengadakan apa-apa peraturan melalui perintah di dalam Warta untuk menetapkan langkah-langkah mengawal atau mencegah merebaknya apa-apa penyakit berjangkit.

Melalui Peraturan-Peraturan Pencegahan dan Pengawalan Penyakit Berjangkit (langkah-langkah di dalam kawasan tempatan jangkitan) 2020 - P.U(A) 91, Menteri telah menetapkan peraturan kawalan pergerakan dan perhimpunan di dalam mana-mana kawasan jangkitan.
