Have you ever thought about how your estate will be distributed? Many people avoid discussing this topic because they are afraid to face it and do not know how to distribute their assets. However, estate planning is something that everyone should look into.

Here are some common estate planning questions in Malaysia:

1️⃣ Can my beneficiaries become the executors of my will?
Answer: Yes, the executor of a will should be someone you trust to handle all matters related to your estate.

2️⃣ Will joint property automatically transfer to me after my partner's death?
Answer: No, the distribution of the estate needs to follow Malaysia's inheritance laws or the will written by the deceased.

3️⃣ Can I leave my property to friends instead of family?
Answer: Yes, you can distribute your assets to anyone you believe is appropriate, including friends and charitable organizations.

4️⃣ What happens if I don't have a will?
Answer: Without a will, the estate will be distributed according to Malaysia's Distribution Act 1958, but unmarried partners, same-sex partners, and unrecognized relationships cannot be statutory heirs.

5️⃣ Is there an estate tax in Malaysia?
Answer: There is no need to pay any estate tax to the government.

6️⃣ When should I start considering estate planning?
Answer: Early consideration of estate planning can avoid many problems and disputes. As your life and financial situation changes, your estate planning should also be updated and adjusted accordingly.

Difference between Will and Trust

Both a will and a trust are strategies set up by the owner of assets to ensure that their family can safely obtain their own assets, but there are some differences in nature.

1. Distribution of assets
Before distributing the estate, the executor of the will must first acquire a certificate of estate management, and check whether the deceased person has any debts. If there are debts, it has to be paid off first before the estate can be distributed according to the terms of the will.
After the assets are entrusted to a trust company, the ownership of the assets no longer belongs to the owner, and the assets will exist independently, not affected by any external factors, and will be distributed according to their wishes.

2. Management of assets
The testator needs to appoint an executor of the will to distribute the estate according to the will. The executor must liquidate and register the estate, and then take good care of the estate.
The property rights of the trustor's assets are transferred to the trust company, and the trust company manages the assets according to the wishes of the trustor. They cannot dispose of the assets arbitrarily, otherwise they will be legally liable.

3. Inheritance of assets
A will is a one-time event. After the beneficiary of the will obtains the estate, they can dispose of the inheritance assets as they wish without being restricted by the will.

The assets of the trust will be distributed according to the wishes of the trustor, and the trust company will manage the assets and allocate them to the beneficiaries based on the trust agreement.

4. Validity of Wills and Trusts
A will can only take effect after the testator has been confirmed deceased, and the beneficiaries of the will can receive the inheritance.
Regardless of whether the trust settlor is alive or deceased, the trust asset will be disbursed to the beneficiaries according to the settlor's wishes to protect the beneficiaries' interests.

5. Freezing of Assets
Before it is confirmed that the testator has passed away and legal documents are obtained to distribute the inheritance, the assets in the will shall be frozen.

As trusts are managed by trust companies, the assets will not be frozen.

Whether it is assets or trusts, both are supervised by the law nowadays, making it a safe and convenient choice to safeguard your assets.

遗嘱与信托之间的区别

遗嘱与信托都是资产原主人为了保障自己的家人可以安全获得自身的资产而设下的策略，不过其在本质上有一些不同。

1. 遗产的分配方式
遗嘱执行人在分遗产之前要先获得遗产管理证书，然后查清已立遗嘱者是否有债务，若是有欠债，则必须先用遗产还清所有欠款，才可以按照遗产的条款分配遗产；资产被委托给信托公司后，资产的所有权不再属于自身，资产将独立存在，不受任何外在因素的影响，都会按照其意志分财产。

2. 遗产的管理方式
遗嘱设立人需要设立遗嘱执行人执行遗嘱的分配，遗嘱执行人需将遗产清算登记，然后好好保管遗产；信托委托人的财产权转给信托公司，由信托公司进行遗产管理，信托公司必须根据信托委托人的意愿管理资产，不能随意处置，不然会负法律责任。

3. 继承遗产的方式
遗嘱是一次性的，遗嘱受益人在获得遗产后，可以随意处置遗产，不会再受遗嘱的限制；信托的资产会依照信托设立人的指示，可以选择一次性发放全部的资产或者是分批发放给信托受益人。

4. 遗嘱与信托的有效性
遗嘱唯有在遗嘱设立人已经确认死亡之后才能生效，遗嘱受益人才能获得遗产；无论信托设立人是存活或者是死亡，都会根据信托设立人以及信托的类型按需求按时发放给受益人以保障受益人的权益。

5. 资产的冻结
在还没有证实遗嘱设立人已经身亡以及获得法律文件以便可以分遗产之前，遗嘱里面的资产将会被冻结；基于信托是交由信托公司进行管理，所以资产不会被冻结。

不论是遗嘱还是信托，在现今都是受法律所监督的，即安全又方便，是保障您资产的好选择。

The [2022 Youth Wushu Competition] sponsored by AG ASIA GROUP has officially come to a successful end!

The Persekutuan Wushu, Tarian Singa Dan Naga Negeri Sembilan organised a [2022 Youth Wushu Competition] at MesaMall in Negeri Sembilan on the 27th of November 2022.

The competition was the first physical competition since Covid-19 pandemic began. It was dedicated to promote youth martial arts for young people to embrace a better sports experience✨.

We were delighted to be the main sponsor of this competition and to witness this group of young blood showing their passion on this great platform😊.
