如果”政府地“影响到你的话,要向谁(哪个部门)投诉呢?

下图解释了一般上的”政府土地“由哪个单位来负责。可是一般人如你和我,如何得知这些土地到底是由哪个”局“来负责呢?
土地局?你知道哪个土地局吗?土地与矿物局(PTG, Pejabat Tanah dan Galian)?还是县与土地局(Pejabat Daerah dan Tanah)?
有时候甚至是工程部(JKR)的土地,或是灌溉排水部(JPS)的土地,森林局的土地等等。总之就是一头雾水!

所以,一般上是投诉去各自的市政府(市政局Dewan Bandaraya,市政厅Majlis Bandaraya、市议会Majlis Perbandaran、或县议会Majlis Daerah),由有关市政府部门确认哪个‘’部门‘’需对所谓的“政府地”负责。有些甚至需要数个部门来共同对所谓的“政府地”负责。

以上的华语,会难理解吗?

这封信从7月就要求了,电话及电邮都没消息。结果前两天寄了一封抄送给新的部长(倪可敏)的信件,第二天就收到了政府有关部门(1)的这封期待已久的信。
果然政府部门就是要等到有人死了才甘愿有所行动的。前两天的信件就是提到上个星期五发生的严重土崩事件。

但是这封政府有关部门(1)写给另一个有关部门(2)的信件,看了后也是火滚!基本上就是把责任推给另一个部门(2)。
我打电话要求(2)回复,他问我是谁?他们只会回复(1),但问题就是(2)没回复(1)啊!!我才要帮忙(1)来问(2)的。

结果如何?我又要写信给(2)投诉。(1)还说政府部门(1)不可能写信“逼”(2)给(1)回复的。

还好,今天突然间全部政府有关单位都派人来“应酬”我了。不管如何,感谢 Nga Kor Ming

明天一次过见完这些政府部门官员。

很多人不了解为何高楼需要等那么多年才拿到分层地契,有鉴于此,我以个人向发展商及清盘师跟进的经验来分享应该如何向发展商(或清盘师)跟进分层产权的申请。
*如果发展商清盘的话,就要看分层产权申请到底在哪个阶段,JMB再根据实际情况来筹集资金以继续跟进。如果连持牌土地测量师 (LLS)都还没委任,就需要先筹集资金来委任了。一般上2acres, 300个单位的LLS委任费用,大概需要一百万左右,越大的土地及越多单位就越贵,分分钟数百万的。这就是最主要的原因吧?没钱就没地契。

1. 先要知道土地在发展商名下吗?是就好。不是的话,先转名。律师费,转名费,印花税等等,够你耗了。除非是 与地主Joint Venture,则另当别论。

2. 发展商/清盘师指定的持牌土地测量师 (LLS) 向马来西亚测绘局(JUPEM) 申请(所有文件必需都到位)项目编号 。LLS必需参考最新的Approved Building Plan并准备Schedule of Parcel/Proposed Strata Plan及计算 SiFUS。

4. 有了SiFUS之后,发展商/清盘师可以向土地局(PTG)申请SiFUS的批准。

5. 一旦 SiFUS 获得 PTG 批准, LLS 需向 JUPEM 申请拟议分层计划证书,certificate of Proposed Strata Plan(CPSP)。

6. 然后JUPEM 会安排官员现场检查,如没问题,签发CPSP。如有问题,会要求重新计算SiFUS及schedule of Parcel, 从No.2-5 开始再重复多一轮的排期申请(同一个项目编号)

7.一旦JUPEM签发CPSP,发展商/清盘师需要以CPSP向PTG申请分层产权。

8. 同时,LLS将准备Certified Strata Plan PA(B) 向JUPEM进行认证。

8. 最后阶段,有了JUPEM 的认证,PTG才会批准分层产权申请。

9. PTG 需要注册和颁发个别的分层地契并移交给发展商/清盘师。

10. 发展商/清盘师才会通知业主们,可以来申请你们的分层地契啦~~

以上的跟进从No.1-10,快的话预计需要4年的时间,慢的话?嘿嘿,7-8年吧。
如果没钱的话,20年也出不来咯!!

The first time in the history that AGM was interspersed with politician, Ms. Syerleena Abdul Rashid, a candidate for the Penang Hill MP, and YB Wong Hon Wei, a former Penang Hill MP and former Penang state ADUN for Ayer Itam, who came to "support" our AGM, and also called on us to "support" the new face. Ms. Syerleena Abdul Rashid, she also took the opportunity to offer help to everyone(provided she win the election)

Also, the first time AGM was halfway through, and all the residents started the buffet with YBs, stopped for 1 hour to "heal the stomach", and then resumed the AGM.

*YBs rushed to the next show around 6 o'clock. It seems that after the nomination, they have to work harder to run all over the place. 🤭

然后也第一次AGM进行到一半全部居民开始与YB们的自助餐,停止1小时医肚子,然后再继续AGM。

YB们大约6点多就赶去下一场了,看来提名后更加要努力跑场了。

The speaker, Mr. David said that MC and JMB can only enter into contract agreement with *service provider* max of 12months.

However, non service provider, for example, bank, business operator(car park/sundry shop/laundry/etc) are not fall under max 12months restriction.

JMB/MC can enter into rental/lease agreement more than 12months between such parties and JMB/MC.

He also shared Lampiran A,B,C for us to let committee, contractor to fill up and sign. For a proper tender procedures.

Especially Lampiran A.
I think better let all committee member to sign it. To make sure they are "clean" by self declared it.

我们是否需要在投资组合中加入“指天椒”资产类别?

最近,一位老朋友找我投资了一个很热门的投资计划,外汇投资。 (根据 1953 年外汇管制法令(ECA),任何人在马来西亚购买或出售外币或进行任何涉及、与或准备购买或出售外币的行为都是违法的,除了授权经销商以外)

那么,我为什么要提出这个话题呢?
因为我注意到很多马来西亚人(或我的朋友)确实通过在国外设立的各种平台参与外汇投资,最重要的是,鉴于从低至每年 20% 到 100% (或更高)的相对丰厚的投资回报!!)

然而,今天我不会讨论外汇投资计划是否“合法”或“不合法”或处于“灰色地带”。

这篇文章的主要目的是讨论外汇投资的“性质”以及与之相关的风险。
我不打算讨论外汇的“典型”风险,如杠杆风险、利率风险、交易风险、交易对手风险、国家风险等(您可以轻松谷歌)

但我想强调“黑天鹅”风险,没有一个专业交易者可以创建一个系统或能够预见到此类事件或可以避免此类事件。

所以,我把这样的投资方案当成是一种“指天椒”资产类别,是对整体投资组合的升华。(就像干冰一样,直接从固态转为气态,不经过液态阶段)

鉴于稳定性,普通投资资产类别有时可能会“无聊”,就像吃一顿普通的饭菜一样。所以有些人可能想添加“指天椒”,以在他们的膳食中添加一些刺激。

归根结底,大家必须明白,“指天椒”还是“指天椒”,你不能一个人吃完整盘“指天椒”吧?这同样适用于投资组合。

在尝试过这种“香料”的刺激之后,请不要“全力以赴”。

Do We need a "cili padi" asset class in the investment portfolio?

Recently I was approached by an old friend to invest into an investment scheme which is a hot topic, Forex Investment. (Under the Exchange Control Act 1953 (ECA), it is an offence for a person in Malaysia to buy or sell foreign currency or do any act which involves, is in association with, or is preparatory to, buying or selling of foreign currency with any person, other than an authorised dealer)

So, why am I raising this topic?
Because I notice a lot of Malaysians(or my friend) indeed involved in Forex investment via various platforms set up abroad, and most importantly, in view of the comparatively lucrative investment return from as low as 20% p.a to 100% p.a(or more!!)

However, today I shall put aside whether such a Forex Investment scheme is "legal" or "not legal" or within "grey area".

The main purpose of this post is to discuss the "nature" of forex investment and the risk associated with it.
I'm not going to discuss the "typical" risk of forex like leverage risk, interest rate risk, transaction risk, counterparty risk, country risk, etc.(which you can Google it easily)

But I would like to highlight the "black swan" risk where none of the expert traders can create a system or be able to foresee such events to be avoided.

That's why, I treated such investment scheme as a "cili padi" asset class, a sublimation to the overall investment portfolio.(just like dry ice, shifted directly from solid into gas, without going through liquid stage)

Ordinary investment asset classes sometimes can be "boring" in view of the stability, just like eating a normal meal. So some people may want to add "cili padi", to add some spice into their meal.

Ultimately, one must understand that cili padi remains cili padi, you cannot eat cili padi alone right? Same applies to investment portfolios.

Don't go "all in" after you have tried the excitement of such "spice".
