时常都有人说：“我还很年轻”、“没钱立遗嘱”、“没资产立什么遗嘱”、’’我都不是有钱人，为什么还要立遗嘱？”

立遗嘱不是有钱人才必须立的。

每个人都会走向死亡，这很正常。可是，没多少人愿意规划自己的身后事。多数人认为，立遗嘱交代身后事是老后才需要做的事。但是，人生无常，有多少人能够安稳度过一生？又有多少人英年早逝？

死亡不只是死者的不幸，更是生者的不幸。先不说日后繁杂的认领遗嘱手续，不立遗嘱还可能造成日后的家庭纠纷问题。所以，只要花点时间立遗嘱，就能解决后人的烦恼。

有好多人觉得奇怪为什么写了遗嘱
子女们还可以争财产？

其实立了遗嘱，还是有可能被挑战(challenge)的。
只是要看立遗嘱条款有没有被挑战的可能

在这个新加坡案例中，联名户口中的四百万被挑战
原因是有子女认为父亲在遗嘱提到所有的资产平分给四个子女
为何这个联名户口，母亲却不交出来。

在这里，不大确定的是他的联名户口是指自己与太太（遗孀）的联名?
还是太太（遗孀）和大女儿的联名户口?

如果是前者，因为新加坡是奉行Joint Tenants, （马来西亚是Tenants in common)
联名的一方将有权继承死去的联名者的户口的
Joint tenants have a right of survivorship.
This means that if A and B own land as joint tenants and if either A or B dies then the interest of the deceased joint tenant automatically passes to the survivor.

如果是后者，那也说明死者已在生前把资产过继给遗孀和大女儿
所以已经不再是他的遗产了，所以其他孩子并没有资格争取。

也许是其他儿女不愿这笔钱最后都给了大女儿吧？
殊不知，大女儿为两父母照顾最多。但是自己的双眼却被利益蒙蔽了~

如果要避免类似的纠纷，最好还是立个人信托
因为这样比较能保密，而且其他受益人并无法挑战已过继至信托者的资产

无论如何，这样的新闻还是让人感到唏嘘
母亲已88岁，她所获得的资产再不久这也会成为子女们的资产
但却因为“贪”或者“不平”的心选择与母亲对薄公堂
为子孙造成不良的示范！

A revocable living trust is an amazing tool that can really serve your family well. If you fund it! Setting up a trust is not the same thing as funding it.

If your loved one set up a trust, they probably went to the lawyer who drew up the documents, and they signed them, and I'm sure the lawyer told them what they needed to do (even to the point of writing it out for them), but then never get around to it.

Why does all of this matter? Because anything that was not put into the trust before death will go through . One of the main reasons to make a trust is to avoid that, so you are wasting your money on legal documents if you don't follow through! An unfunded trust is not worth the paper it is printed on.

When you created a trust for yourself or even your family, you will be preparing the deed that transfers their home into the trust and actually file it with the court on their behalf so at least you know that part is complete. You also give them very clear instructions including what language to use when changing financial accounts.
