FAQs on real estate investments:
Beware of the word “CLEAN TITLE”.
You can only call it clean title IF:
✅ Owners that appear in the title of the property are still ALIVE & CAN SIGN documents
✅ NO disputes attached in the title AND “certified true copy” of the title.
Please take note of the “AND” because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.
✅ All real estate taxes are paid on time. Always request for latest real estate tax clearance.
✅ The owners are married (on or after 1987) The property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.
✅ The property estate taxes are not yet paid, the property cannot be called “CLEAN”.
✅ Magkaiba po ang real estate tax na binabayaran ninyo annually at ang estate tax (BIR FORM 1801) You only pay estate tax if the owner in the title ay deads na. Penalties (like big penalties) apply for late filing.
Public service lang po 🙂. Ang estate tax clearance po is NON-NEGOTIABLE. Kailangan talaga syang e file at bayaran whether you like it or not, pag nadeads ang owner na nakalagay sa title. Yep di mo siya matransfer without paying it (kaya nga may amnesty para dun sa matagal na di nattransfer, naextend yun btw)

Per Revenue Regulations (RR) No. 11-2024, the following deadlines have been extended:
1. The submission of the Inventory Report on Unused Official Receipts/ Billing Statement/Statement of Account/Statement of Charges Converted into Invoice/Billing Invoice has been extended until JULY 31, 2024.
2. The reconfiguration and system enhancement of Computerized Accounting System (CAS)/Computerized Books of Account (CBA) with Accounting Record (AR) adjustments has been extended until DECEMBER 31, 2024. Any extension must be approved by the concerned Regional Director or Assistant Commissioner of the Large Taxpayers Service (LTS), which shall not be longer than six (6) months from December 31, 2024.

EXTENDED AND EXPANDED!
The Estate Tax Amnesty deadline has been extended to JUNE 14, 2025, while its coverage has been expanded to deaths on or before MAY 31, 2022, under Republic Act (RA) No. 11956.

A search warrant proceeding is, in no sense, a criminal action or the commencement of a prosecution. The proceeding is not one against any person, but is solely for the discovery and to get possession of personal property. It is a special and peculiar remedy, drastic in nature, and made necessary because of public necessity. It resembles in some respect with what is commonly known as John Doe proceedings. While an application for a search warrant is entitled like a criminal action, it does not make it such an action.

Maari pa ring gamitin ang mga natitirang Official Receipts (OR) hanggang maubos ang mga ito, kahit lumagpas pa ng December 31, 2024. Ang mga Inventory Reports o Notice na kailangan sa transitory provitions ng Revenue Regulation No. 7-2024 ay maari na pong ipasa sa email. Ang mga pagbabago na ito ay alinsunod po sa Revenue Regulation No. 11-2024 at Revenue Memorandum Circular No. 66-2024 na may layunin na mas padaliin ang paglilipat sa bagong sistema na buhat ng Ease of Paying Taxes Act.
Sinisikap ng BIR na padaliin at pasimplehin ang iba't-ibang mga regulations, sistema, at mga proseso mula ng maisabatas ang EOPT. Kasabay nito ay ang ating walang sawang pagpapayaman ng kaalaman ng mga taxpayers sa pamamagitan ng mga EOPT Roadshows. Dumayo na po ang mga lider ng BIR sa Metro Manila, Cebu, Davao, Koronadal, at Pangasinan para makapagbahagi ng kaalaman sa mga taxpayers. Dumagsa ang libu-libong mga taxpayers, tax practitioners, at mga negosyante para maging updated sa EOPT.
Tuloy-tuloy po nating lilibutin ang iba't-ibang mga bayan para makapagdaos ng EOPT Roadshow, ito po ay bahagi ng ating programa para sa taxpayer education.
