Lawyer suspended for notarizing document while signatory was abroad

WORK SUSPENSION: All courts nationwide suspend work 𝘀𝘁𝗮𝗿𝘁𝗶𝗻𝗴 𝟯:𝟬𝟬 𝗣.𝗠. on Monday, September 23, 2024, in view of Proclamation No. 60, s. 1992 declaring the last week of September every year as Family Week and Proclamation No. 326, s. 2012 declaring the fourth Monday of September of every year as “Kainang Pamilya Mahalaga” Day.

"In all criminal prosecutions, the accused shall be presumed innocent until the contrary is proved.

The presumption of innocence is rooted in the guarantee of due process, and is safeguarded by the constitutional right to be released on bail, and further binds the court to wait until after trial to impose any punishment on the accused.

It is worthy to note that bail is not granted to prevent the accused from committing additional crimes. The purpose of bail is to guarantee the appearance of the accused at the trial, or whenever so required by the trial court. The amount of bail should be high enough to assure the presence of the accused when so required, but it should be no higher than is reasonably calculated to fulfill this purpose.

Thus, bail acts as a reconciling mechanism to accommodate both the accused’s interest in his provisional liberty before or during the trial, and the society’s interest in assuring the accused’s presence at trial."

Family peace cannot be promoted by ruthlessly depriving some members of their inheritance. Deprivation of this kind may even be the source of avoidable hostility and alienation.

In a landmark decision, the Supreme Court revisits the "iron curtain" rule governing the inheritance of illegitimate children (now referred to as non-marital children).

Article 992, NCC, should be interpreted to take into account other circumstances, such as (1) birth and (2) family dynamics.

The Court acknowledged that, despite their lack of control over their circumstances, non-marital children face consequences such as:

1.) those born as a result of their parents' refusal to marry; or

2.) those born because one of their parents is under the marriageable age; or

3.) those born because their mother was a victim of sexual assault. (R**e victim).

In other words, the Supreme Court overturned the presumption that "non-marital children" are the product of illicit relationships or are automatically placed in a hostile environment created by the marital family.

To be clear, the Supreme Court [did not abolish] the infamous "iron curtain" rule. Instead, it determines whether the "non-marital child" is the result of circumstances beyond the child's control, all of which are in the child's best interests. (Emphasis ours).
