Are you planning to sell your home and purchase a bigger place? It sounds like you can use the help of a real estate broker…or is it an agent? Does it really matter what they’re called or who you call? Apparently, it does.
Don’t assume that any real estate professional will do when it comes to choosing someone to represent your best interests. Though the terms are interchangeable, it doesn’t mean they’re the same. There are some significant differences between the roles of the various professionals, in addition to the different requirements for using particular titles.
Before you enter into a real estate transaction of any kind, let’s get to know the differences between a real estate broker and an agent.
A Real Estate Broker is:
Licensed
A real estate broker has passed the Real Estate Brokers Licensure Exam administered by the PRC. Thus, a broker is licensed to conduct a real estate transaction between a buyer and a seller and must be present in every transaction where real estate agents are involved.
Independent
A real estate broker can work independently or can hire a real estate agent.
Rarely involved
Brokers rarely engage personally in real estate transactions. A broker either manages an office for a large company or is a business owner.
More educated
Generally, a real estate broker has more education than an agent. A broker is required to have graduated from a 4-year college course and has to undergo more extensive education in relation to business management.
More paid
A broker doesn’t have to split or share commissions as is required of agents, who usually can lose up to half of their commissions in brokerage fees.
Dealt with more responsibilities
The broker takes on essentially all legal responsibility for any real estate transactions done by himself or any agent who works for him. Within the brokerage, the broker handles additional financial and management responsibilities required to run a successful real estate business.

An agent is an accredited salesperson but is not a real estate broker. An agent is required to undergo education pertaining to real estate law and ethics.
Dependent
An agent works for the real estate broker and can’t complete a real estate transaction without the broker’s oversight.
Personally involved
An agent is the person that you as a consumer will encounter in the transaction. An agent prefers the job of working directly with buyers and sellers.
Educated
An agent must complete at least 2 years of college or training courses and seminars in real estate brokerage. An agent is very experienced can amass as much or more real estate knowledge than a broker since they’re in the field more often.
Less compensated
An agent is not entitled to demand or receive a fee, commission or compensation of any kind from any person, other than the duly licensed real estate broker who has direct control and supervision over him.
Loaded with tasks
Basically, an agent’s tasks include showing homes or commercial properties to prospective buyers, finding properties for prospective buyers, studies and keeping abreast of the real estate market and acting as liaison between seller and buyer and sometimes helping a buyer secure financing.
A Broker-Agent is:
A licensed professional that performs the duties of a broker, as well as an agent’s. They have the option of working in the field or in an office. A broker-agent arranges transactions between a buyer and a seller from start to finish including all the paperwork that comes with the process of buying or selling a property.
A broker-agent receives a commission once the deal is executed.
In short, a broker is the person that runs the real estate office while an agent is the person who works directly with the consumers in the transaction. But which one is better? Technically speaking, both brokers and agents can represent clients in purchasing and selling a home or property.They both can search for available homes in a numerous listing services, show clients homes, market a house and form real estate contracts.
If you want someone that will do all the work for you from the confines of an office, you may hire a broker. All your concerns about real estate legalities will be answered since a broker has a more complete knowledge of real estate law. How to Check Land Titles in the Philippines and Spot Fake Ones in 30 Seconds

Despite all the regulations put in place to fight scammers and con men in the Philippine real estate industry, there are still a lot of cases being reported where unsuspecting victims fall for fake land titles. For example, just recently (March 22, 2015), Inquirer reported on a land scam syndicate which already has a number of victims who lost their money by buying properties with fake titles.
To avoid getting yourself into a similar problem, your first line of defense is a short and quick check of the land title that is presented to you. There are very specific characteristics of authentic Philippine land titles. If one or more of these are missing on the title that is presented to you, then you know you’re dealing with scammers.
Ms. Ruby Valdez, one of the land registration examiners from the Land Registration Authority of the Philippines, shares with us these items which you can check for in 30 seconds or less.
PHYSICAL QUALITIES
The papers used for authentic land titles in the Philippines are supplied by the Banko Sentral ng Pilipinas. These papers are physically unique from all other kinds of papers that you can buy from stores. Here are the things you should look for:
The texture is similar to that of a bank check
It has a faint watermark that says “LRA“
If it’s an old title (before the newer e-Titles being used today), the color of the paper is light yellow.
If it’s an e-Title, the color should be pale straw.
Tiny fibers and dots should be noticeable
And if you could use a UV light, these fibers should fluoresce or shine slightly when subjected to UV light.
CONTENT
Below are the items you should look for in the contents of the title you are checking:
If it’s an Original Certificate of Title (OCT), it should indicate “Judicial Form No. 108-D” at the top.
If it’s a Transfer Certificate of Title (TCT), it should indicate “Judicial Form No. 109-D“
The serial number label (SN No.) should be in red color, while the digits should be in black for the owner’s duplicate.
The last two digits of the page number in the upper right hand side should correspond to the last two digits of the TCT number.
The red/blue border should be slightly embossed and not flatly printed.
For e-Titles, all entries should be computer encoded and printed, unlike the old versions which were manually type-written
The seal on the lower left hand side should be dark red and does not blot when a litle water check is done.
Signatures:
for Judicial OCT, it should have 2 signatures present – the Administrator and the Registrar; while for TCT, only the signature of the Registrar is present.
For Administrative Titles: one signature from a PENRO or CENRO officer and another from the registrar.

Precautions That Should Be Taken During Earthquake
EARTHQUAKES
One of the most frightening and destructive phenomena of nature is a severe earthquake and its terrible aftereffects. An earthquake is the sudden, rapid shaking of the earth, caused by the breaking and shifting of subterranean rock as it releases strain that has accumulated over a long time.
For hundreds of millions of years, the forces of plate tectonics have shaped the earth, as the huge plates that form the earth’s surface slowly move over, under and past each other. Sometimes, the movement is gradual. At other times, the plates are locked together, unable to release accumulated energy. When the accumulated energy grows strong enough, the plates break free. If the earthquake occurs in a populated area, it may cause many deaths and injuries and extensive property damage.
During an Earthquake
Drop, cover and Hold On. Minimize your movements to a few steps to a nearby safe place and if you are indoors, stay there until the shaking has stopped and you are sure exiting is safe.
If Indoors
DROP to the ground; take COVER by getting under a sturdy table or other piece of furniture; and HOLD ON until the shaking stops. If there isn’t a table or desk near you, cover your face and head with your arms and crouch in an inside corner of the building.
Stay away from glass, windows, outside doors and walls, and anything that could fall, such as lighting fixtures or furniture.
Stay in bed if you are there when the earthquake strikes. Hold on and protect your head with a pillow, unless you are under a heavy light fixture that could fall. In that case, move to the nearest safe place.
Do not use a doorway except if you know it is a strongly supported, load-bearing doorway and it is close to you. Many inside doorways are lightly constructed and do not offer protection..
Stay inside until the shaking stops and it is safe to go outside. Do not exit a building during the shaking. Research has shown that most injuries occur when people inside buildings attempt to move to a different location inside the building or try to leave.
DO NOT use the elevators.
Be aware that the electricity may go out or the sprinkler systems or fire alarms may turn on.
If Outdoors
Stay there.
Move away from buildings, streetlights, and utility wires.
Once in the open, stay there until the shaking stops. The greatest danger exists directly outside buildings, at exits and alongside exterior walls. Many of the fatalities from the earthquake occurred when people ran outside of buildings only to be killed by falling debris from collapsing walls. Ground movement during an earthquake is seldom the direct cause of death or injury. Most earthquake-related casualties result from collapsing walls, flying glass, and falling objects.
If in a Moving Vehicle
Stop as quickly as safety permits and stay in the vehicle. Avoid stopping near or under buildings, trees, overpasses, and utility wires.
Proceed cautiously once the earthquake has stopped. Avoid roads, bridges, or ramps that might have been damaged by the earthquake.
If Trapped Under Debris
Do not light a match.
Do not move about or kick up dust.
Cover your mouth with a handkerchief or clothing.
Tap on a pipe or wall so rescuers can locate you. Use a whistle if one is available. Shout only as a last resort. Shouting can cause you to inhale dangerous amounts of dust.
