DEFINING “CLEAN TITLE”

You can only call it Clean Title IF:

⭕ Owners that appears in the title of the property are still ALIVE & CAN SIGN documents

⭕ NO disputes attached in the title AND “certified true copy” of the title.
Please take note of the word “AND” because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.

⭕ All real estate taxes are paid on time. Always request for latest real estate tax clearance.

⭕ If the owners are married (on or after 1987) the property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.

⭕ If the property estate taxes are not yet paid, the property cannot be called “CLEAN”.

“SEC. 39. Penal Provisions. Any violation of R.A. 9646, including violations of this IRR, shall be meted the penalty of a fine of not less than one hundred thousand pesos (P100,000.00) or imprisonment of not less than two (2) years, or both such fine and imprisonment upon the discretion of the court. In case the violation is committed by an unlicensed real estate service practitioner, the penalty shall be double the aforesaid fine and imprisonment.

In case the violation is committed, by a partnership, corporation, association or any other juridical person, the partner, president, director or manager who has committed or consented to or knowingly tolerated such violation shall be held directly liable and responsible for the acts as principal or as a co-principal with the otherparticipants, if any.”

Why should you take this seriously?

Let me try to make the penalties clear for everyone:

Any violation: Php100,000.00 or imprisonment of not less than two (2) years, or bothViolation is committed by an unlicensed real estate service practitioner: the penalty shall be double (that would mean Php200,000.00 or imprisonment of not less than four (4) years, or both!)

Be very careful!

Just be very careful when someone tells you to do something related to real estate as you might be breaking the law. When in doubt, don’t be afraid to ask questions, and use good old common sense. Besides, I believe the RESA Law and the RESA Law Implementing Rules and Regulations or IRR is fairly easy to understand.

Ever since the RESA was signed into law last year, whenever I meet with other beginning real estate investors, I often end up harping about its implications on activities such as selling other people’s properties, which I believe has become illegal if done by those who are not duly licensed and registered real estate professionals.

There is simply no excuse for anyone to be ignorant of the RESA Law and how it affects everyone doing just about anything related to real estate.

What is a broker and what is an “agent”?
All brokers are considered as agents, but not all agents are brokers.

A “broker” is someone who holds a broker's license. And an “agent”, on the other hand, can be a licensed broker or a licensed salesperson who works under a broker's authority.

Some reasons why you should only deal with licensed real estate professionals:

1. Dealing with a licensed real estate professional, actually gives you the security because you can file for cancellation of his/her license if he/she had done any malpractice. However, if you’re dealing with unlicensed “agents”, in cases of malpractice, you cannot file for cancellation of his/her license because they don’t have a license in the first place.

2. A licensed real estate professional have an office and/or a professional organization where he/she belongs so you know where to find them. Also, their license card is a definite proof that they are eligible to handle real estate transactions with regards to the law and taxation. On the other hand, when an unlicensed real estate “agent” ran away with your money, you’ll never know where to find him/her because he/she doesn’t have an office or any professional organization. And since an “agent” doesn’t have a license, he/she can’t show you any professional credentials that can prove that he/she is knowledgeable enough for the said real estate transaction. Also, because he/she doesn’t have a license, you don’t have information about him/her, so it’ll be hard to go after them if in case a malpractice has been done.

3. Dealing with a licensed real estate service practitioner gives you the security because they have this code of ethics, legal standards, and professional standards in dealing with their clients. In other words, they cannot be involve into any dubious practices such as, giving misleading information, loan-shark-deals, providing fake property titles, bogus real estate appraisals, phony property mortgage processing, forgery, fake ID’s, fake registered owner, fake registered spouse, fake Special Power of Attorney, tampered Extra-judicial Settlement of Property, inaccurate calculation of taxes, dubious squatters’ settlement, and many more. Also because they are licensed, they are confident in dealing with lawyers, assessors or any professionals that are needed in a real estate transaction.

4. And lastly, it is illegal to deal with unlicensed real estate agents in the Philippines simply because dealings with them are punishable by law according to Republic Act 9646. The said law is meant to prevent the practice of “colorum” agents and also property sellers who are still patronizing to the so-called freelance illegal property agents to avoid paying taxes and proper commission rates.
