I saw this photo below posted anonymously a few weeks ago. I fully agree! I've never said โThatโs not my jobโ to any of my bosses. But I'd say I was probably more selfish than altruistic during the earlier years of my career. I must admit that back then, helping the organization, or helping others for that matter, wasn't really top of mind. My learning was.
I worked for 10 different companies since 1980 until I retired in 2018. Early on, perhaps towards my third or fourth year of working, I realized that my job description just "boxed me in". I found myself wanting to do tasks that wasn't in my JD, maybe because I'm a person whoโs easily bored without variety. While I was earning P777 monthly, it wasn't the measly salary that was making me unhappy -- it was the job itself. It was clear to me that if I stuck to what my JD said I should do, I would stop learning. That would be a huge problem for me, because I've always been a voracious learner, even now at this ripe old age of 66.
So I simply asked my boss for new tasks. Mind you, I didn't ask him for more work -- I asked him for NEW work. Doing more of what I was already doing would just continue to bore me and probably make me leave for another organization. Fortunately, my boss was open-minded and he gave me a variety of new job assignments, many of which were at a "higher level".
I left my first job after seven years. Many said I stayed too long. But I enjoyed my stint because of the new responsibilities I had every year, thanks to my boss. Even if my salary didn't change much, I didn't mind, because I felt the trade-off was worth it, i.e. all the learning compensated for the lack of financial rewards.
After my first job, I developed a mindset that I should "shred" my job description in all companies that would hire me in the future, which I did, figuratively. In all nine companies where I eventually worked, I merely signed my JD without looking at it (well, just glancing at it). Instead, I asked both my boss and my subordinates "What do you think I should do here to help make this company a better place for everyone?" In short, to hell with my JD.
I think it paid off. As I moved from one company to the other, all my interviewers were awed that I could do tasks beyond the duties and responsibilities of the job candidate they were looking for. When I was officially a Training Officer, I helped the Recruitment Department interview job candidates, even if they had ample personnel to do interviews. That made me officially the Recruitment Head years later. And while officiallylooking after Recruitment, I asked my boss to cross-post me to Labor Relations, which eventually made me land the post of Vice President of HR years later.
At one point in my career, when I was invited to join a large bank, the Chairman of the Board asked me during the interview, "Why do you represent your company in the NLRC? Your bank has lawyers to handle that?" I replied, "I asked for it. I would feel incomplete as an HR Head if I wouldn't have hands-on exposure in locking horns with all those labor arbiters and lawyers of employees I terminate. I requested our Board of Directors to appointment me as Attorney-in-Fact, so I would have the formal and legal authority to defend the company in the labor court without the assistance of a lawyer." The Chairman hired me and gave me full jurisdiction of labor cases, as in, HR (and not the Legal Department) had the final say in any employee-related labor issue. In fact, my corporate rank was even 2 levels higher than the Head of Legal, who was a lawyer (I am not a lawyer; I never went to law school).
I'd like to believe that the mindset of going beyond your job description also enabled me to commanded a higher price. I recall that I never accepted an initial job offer of any company. I always negotiated and 80% of the time, I got what I wanted, which was much, much higher than the initial job offer. In my mind, a company with adequate financial resources will move heaven and earth if they really like you. That's why it was a deliberate strategy of mine to target large local and multinational companies in the last 20 years of my career. Billion-dollar companies will never be limited by salary scales if what you can bring to the table is too value-adding for them to ignore.
A good number of employees I've met have little appreciation of the concept of investment. Fortunately, I was a banker for 22 years and this taught me to invest, not only in financial instruments. I treated "new responsibilities/no salary increase" as an investment -- defer the rewards now for better rewards in the future. It was totally fine if my boss gave me work beyond my job description without giving me a corresponding increase in pay. Now, don't get me wrong. Everyone should be paid for what they're worth. But the banker in me knew that investments are not a "here and now" thing. ๐๐ป๐๐ฒ๐๐๐บ๐ฒ๐ป๐๐ ๐ฎ๐ฟ๐ฒ ๐ฝ๐ผ๐๐ฒ๐ป๐๐ถ๐ฎ๐น ๐ฝ๐ฟ๐ผ๐ณ๐ถ๐๐ ๐บ๐ฎ๐ฑ๐ฒ ๐ผ๐๐ฒ๐ฟ ๐๐ถ๐บ๐ฒ. I decided to learn all I could in every job, even if my boss didn't pay me for the additional responsibilities. I knew it was an investment. I knew that one day, I could leverage on that investment and earn more, most probably in another company (that's why I worked for 10 organizations). And it worked as I had planned.
Yes, it sure sounds selfish, perhaps even contrary to that old saying that "HR is a vocation, not an occupation." But no regrets. I learned and earned as much as I could because I knew that one day, I could be more altruistic. And that is exactly why I've spent the last 6 years in retirement trying to help employees -- both HR practitioners and non-HR practitioners alike -- by providing free HR advise, especially to employees seriously aggrieved by their employers. I look back and realize that I would have been unable to provide any sound advice to these people, had I adopted a different mindset, a mindset of "That's not my job". I couldn't have learned the things I know today if I only did things my job description told me to do. ๐

Years before I watched Ramon Revilla Sr.โs blockbuster movie in the 70s, I followed the adventures of the real-life version of gangster Leonardo Manecio, alias Nardong Putik. I read every newspaper article on how Caviteโs Public Enemy #1 murdered countless police officers, military personnel and NBI agentsโฆ and how he got away with it. Legend has it that this notorious criminalโs uncanny escapes were attributed to his โ๐ข๐ฏ๐ต๐ช๐ฏ๐จ-๐ข๐ฏ๐ต๐ช๐ฏ๐จโ (amulet), which he wore around his neck. After all, he escaped from prison, not once, but twice, while serving a 182-year sentence.
I was getting ready for school that morning of October 11, 1971 when I heard my father shout while holding the dayโs issue of The Manila Times: โ๐๐ฐ๐ฅ๐ข๐ด ๐ฏ๐ข ๐ด๐ช ๐๐ถ๐ต๐ช๐ฌ! ๐๐ช๐ฏ๐ข๐ถ๐ญ๐ข๐ฏ๐ข๐ฏ ๐ฏ๐จ ๐ฃ๐ข๐ญ๐ข!โ Almost instantaneously, he turned to me and said: โSee? No one escapes the long arm of the law.โ My father was referring to what he just read in the newspaperโthe end of Nardong Putikโs 20-year criminal career at the hands of the Philippine Constabulary (the former PNP) after they gunned him down while cruising along the boundary of the Kawit/Imus Highway in his Chevrolet Impala. His ๐ข๐ฏ๐ต๐ช๐ฏ๐จ-๐ข๐ฏ๐ต๐ช๐ฏ๐จ and .38 caliber Magnum couldnโt save him from the long arm of the law.
The long arm of the law. That phrase stuck in my head long after Nardong Putik was gone. I found myself using it quite often in the HR profession. The phrase became most useful in the banks where I was HR Head, as I had to conduct never-ending lectures to remind employeesโmost of who were exposed to millions of pesos everydayโthat it wasnโt worth destroying their careers for a few bucks, because in the end, the long arm of the law would catch up with them. And I had no better way to illustrate this point than to show them the front page of a June 2006 issue of the Philippine Star that read: โEX-BANK MANAGER METED 1,228 YEARSโ. Yes, you read it rightโa prison sentence of 1,228 years! Thatโs a branch manager we caught falsifying client documents in 1995. He pocketed over P10 million and was charged with 45 counts of estafa. The sentence came 11 years later. Why that long? Well, the long arm of the law is also a slow arm of the law.
Being caught by the long arm of the law isnโt exclusive for employees who do something wrong. I guess it also applies to employers who do something wrong. Iโve chatted with hundreds of PHRG members who were terribly aggrieved by their employers. The suffered years of anguish until finally, they had their day in court when they decided โenough is enoughโ.
One of them was Cristy (not her real name) who was an HR Manager. Around November of 2021, Cristy consulted me via PM about some people issues in her company. Based on my long chat exchanges with Cristy, I saw she had a keen desire to improve things in her organization. She even attended my webinar, โJudgment Call: Practical Applications of the Labor Code in the Disciplinary Processโ, to gain a deeper understanding of labor relations. But her noble objective seemed to get in the nerves of the big bosses upstairs who were not as upright as her. Occasionally, Cristy would consult me on her own concerns about her companyโs senior management, nothing I felt she couldnโt handle, since I saw her as a relatively senior professional. But gradually, these concerns turned into horror stories. Of course, there are always two sides of the coin. But I was convinced everything Cristy told me was factual and I couldnโt help but conclude she really had a scumbag of an employer. Managementโs actions were truly disturbing.
In early 2022, Cristy informed me via PM that she left the company (I assumed she resigned). I never heard from her again until 6 months later in August, when she sent me a message: โGood news, sir! I won in the NLRC!โ I was a bit stunned, as I never knew she filed a labor compliant against her employer. Apparently, Cristy didn't resignโshe was illegally dismissed. I was happy for her, even if I didnโt know the full details of her case back then. Somehow, I believed her employer did have the propensity to illegally dismiss her, after all the dubious acts they did.
Fast forward to a few days ago, after eight months of silence since Cristyโs last chat message in 2022. I received a PM from her saying: โI won againโฆ at the Commissionerโs level.โ This meant that after the labor arbiter ruled in her favor, the case was escalated to the NLRC Commissioner for reconsideration. The Commissioner affirmed the arbiterโs decision and granted Cristy full back wages plus separation pay (in lieu of reinstatement) plus moral and exemplary damages plus attorneyโs feesโa seven-figure package in total.
While I was overjoyed with the news, my disposition quickly changed after Cristy sent me a copy of the courtโs decision. After reading all the facts, I could not imagine what Cristy went through. I have no words to describe an employer who could do such a thing to an employee, fabricating charges and blaming her for things she never did. I cannot go into details for obvious reasons, but if anyone reads the decision, there can be no doubt that Cristyโs life was deliberately ruined by this employer. They destroyed her! Cristy was able to present a plethora of evidenceโdocumentary proofโshowing the charges hurled against her were all lies. Sure, you could say that the 14-month ordeal was pretty quick for the long arm of the law, but I am sure that those 14 months felt like 14 years for Cristy and her family.
Cristyโs ordeal may not be over. At the moment, she is still clueless whether her former employer will file an appeal. To those who have experienced this, you know the drill. The losing party can still go to the Court of Appeals to have the case reviewed. And if that doesnโt work for them, there still is the Supreme Court. As an HR Head, cases I personally handled that reached the Supreme Court took an average of 3 years, with the longest spanning 7 years.
Such is our justice system. Ironically, the same justice system that has made popular the saying โJustice delayed is justice deniedโ. Like Nardong Putik, the unjust will surely be gunned down in timeโฆ but often, after a long time. And so, will Cristy and thousands of Filipinos unjustly dismissed by their unscrupulous employers have to go through several more years of excruciating pain in their search for justice?
That question can only be answered by the long arm of the law.
