جناب وزیراعظم پاکستان کے خلاف حزب اختلاف کی جانب سے ایوانِ زیریں میں تحریک عدم اعتماد جمع کروا دی گئی ہے اور اس تحریک پر حکمران جماعت کے ممبران کی طرف سے ممکنہ طور اپنی جماعت کی ہدایات کے برعکس، تحریک کے حق میں حق رائے دہی استعمال کرنے کے امکانات ظاہر کئے جا رہے ہیں۔ ان ممکنات کو دیکھتے ہوئے حکمران جماعت کے ان ارکان کو آئینی طور پر نا اہل قرار دیے جانے کیلئے طریقہ کار پر آج کل کافی بحث ہو رہی ہے۔ قانون کا طالب علم ہونے کے ناطے میں اپنے علم اور سمجھ کے مطابق اپنا نقظہ نظر آسان فہم زبان سامنے رکھنا چاہتا ہوں تاکہ سب کو سمجھنے میں آسانی ہو
آئین پاکستان کی شق نمبر 63 (الف) (1) کے مطابق اگر کسی بھی سیاسی جماعت کا کوئی رکن وزیراعظم کے انتخاب میں، عدم اعتماد میں، کسی آئینی ترمیم کیلئے یا مالیاتی قانون سازی میں اپنے جماعت کے پارلیمانی سربراہ کی ہدایات کے بر عکس حق رائے دہی استعمال کرتا ہے تو اس کی جماعت کا پارلیمانی سربراہ سب سے پہلے اس رکن کو اظہارِ وجوہ کا نوٹس دے گا کہ کیوں نا اس کے انحراف کی وجہ سے اسے کو منحرف قرار دے دیا جائے۔ اس کے بعد اس کی جماعت کا پارلیمانی سربراہ اس رکن کے منحرف ہونے کا اعلان افسر صدارت کنندہ ایوان زیریں کو ارسال کرے گا۔ افسر صدارت کنندہ بھیجے گئے اعلان کو دو یوم کے اندر اندر الیکشن کمیشن کو بھیجے گا جو 30 یوم میں اس بات کا فیصلہ کر گا کہ آیا مذکورہ رکن منحرف ہونے کی وجہ سے نا اہل ہوا یا نہیں۔
ماضی قریب میں ایسا ایک معاملہ پاکستان تحریک انصاف کی رکن ایوان زیریں محترمہ عائشہ گلالئی اسماعیل صاحبہ کے ساتھ پیش آیا تھا جب انہوں نے محترم محمد نواز شریف صاحب کی نا اہلی کے بعد 28 جولائی 2017 کو وزیراعظم پاکستان کے لئے ہونے والے انتخاب میں پاکستان تحریک انصاف کے امیدوار جناب شیخ رشید احمد صاحب کے حق میں حق رائے دہی استعمال کرنے سے اجتناب کیا تھا تو پاکستان تحریک انصاف کے پارلیمانی سربراہ جناب عمران احمد خان صاحب نے شق نمبر 63 (الف) (1) کے تحت 28 اگست 2017 کو محترمہ عائشہ گلالئی اسماعیل صاحبہ کو اظہار وجوہ کا نوٹس دیا تھا اور اس کے بعد افسر صدارت کنندہ کو اعلان نا اہلی بھجوایا جہاں سے معاملہ الیکشن کمیشن میں گیا جس نے 3-2 کی اکثریت سے محترمہ عائشہ گلالئی اسماعیل کے حق میں فیصلہ جس کے خلاف جناب عمران احمد خان صاحب عدالت عظمیٰ گئے مگر وہاں سے بھی فیصلہ ان کے خلاف آیا۔
متذکرہ بالا تفصیلات کی روشنی میں مجھے ایسا لگتا ہے کہ جیسا فوجداری قانون میں ابتدائی معلوماتی رپورٹ (ایف آئی آر) جرم وقوع پذیر ہونے کے بعد ہی درج ہو سکتی ہے، یا دیوانی قانون میں بنائے دعویٰ پیدا ہونے کے بعد ہی دعویٰ دائر کیا جا سکتا ہے، بعین ہی جب تک کوئی رکن اپنی جماعت کے پارلیمانی سربراہ کی ہدایات کی خلاف ورزی کا مرتکب نا ہو، اس کے خلاف کوئی کاروائی عمل میں نہیں لا جا سکتی۔

"There is no cavil to the principal that the revisional court, while exercising the jurisdiction under section 115 of the Civil Procedure Code 1908 (CPC) as a rule is not to upset the concurrent finding of fact recorded by the two courts below. This principle is essentially premised on the touchstone that the appellate court is the last court of deciding disputed questions of fact. However, the above principle is not absolute and there may be circumstances warranting exceptions to the rule as provided under section 115 CPC.; gross misreading or nonreading of the evidence on the record or when the courts below had acted in exercise of its jurisdiction illegally or with material irregularity."
