From July 2024, the minimum wage in Poland has increased again. It currently stands at 4.300,00 zł, with an hourly rate of 28,10 zł. After subtracting social security payments (pension, disability, sickness), health payments, advance payments for income tax, we will get a net amount 3.261,53 zł.

As a result of the change in the minimum salary in Poland, the minimum wage for those who want to apply for a temporary residence permit and work in a highly qualified profession (the so-called EU Blue Card) also increases, and amounts to 10.733,22 zł per month. This is 1.214,00 zł more than the minimum wage for applications submitted in 2023.

New requirements to travel to Europe from 2025*

Starting in the first half of 2025, some 1.4 billion people from over 60 visa-exempt countries are required to have a travel authorisation to enter 30 European countries for a short stay.

ETIAS travel authorisation is an entry requirement for visa-exempt nationals travelling to any of these 30 European countries (https://travel-europe.europa.eu/etias/who-should-apply_en?prefLang=plETIAS-countries)

It is linked to a traveller’s passport. It is valid for up to three years or until the passport expires, whichever comes first. If you get a new passport, you need to get a new ETIAS travel authorisation.

From January 2024, the minimum wage in Poland has increased. It currently stands at 4.242,00 zł, with an hourly rate of 27,70 zł. This means that an employee in general will receive 3.221,98 zł net in real terms.

The next increase is planned for July of the current year and will amount to 4.300,00 zł, with an hourly rate of 28,10 zł. After subtracting social security payments (pension, disability, sickness), health payments, advance payments for income tax, we will get a net amount 3.261,53 zł.

The previous Friday, in cooperation with the Fundacja Pomocy Wzajemnej Barka, trainee attorney - at - law Klaudia Janas ( Kancelaria Gniatkowski), conducted group legal consultations for Ukrainian citizens who arrived in Poland due to the armed conflict in Ukraine.

During the meeting, topics such as the legalisation of residence, conducting business in Poland, and the differences between an employment contract and a contract of mandate were discussed.

The state of epidemiological emergency in Poland is abolished as of July 1, 2023.

In view of the above, it is imperative that all foreigners who have stayed in Poland under covid provisions (extending the validity of visas, residence cards, work permits, etc.), in order to stay in Poland legally, must apply for new permits by July 31, 2023.

Repeal of covid provisions on submission of residence applications, renewal of residence permits, deadline for leaving Poland

The amendment to the Law on Assistance to Citizens of Ukraine, which was signed by the President of Poland on January 25, 2023, provides for the repeal of certain provisions of the so-called "covid Law"

The provisions that were repealed extended: the legal stay of foreigners in Poland, the validity of residence documents (e.g., visa, residence card) and temporary identity certificates of foreigners, the deadline for applying for a temporary residence permit, and the deadline for leaving the territory of Poland and the deadline for voluntary return.

The regulations will be repealed as of August 24, 2023. Until then
you need to take steps to extend the legality of your stay in Poland.

President Andrzej Duda signed into law on January 13, 2023, an amendment to the Law on Assistance to Citizens of Ukraine in Connection with the Armed Conflict on the Territory of Ukraine and Certain Other Laws.

The amendment provides for, among other things.

1) non-initiation or suspension of the deadline for issuing decisions in cases of granting/withdrawal of temporary; permanent; long-term EU resident permits;
2) non-starting or suspending the deadline for issuing decisions in cases of granting work permits;
3) non-initiation or suspension of the deadline for issuing decisions in cases of granting/amending a single residence and work permit;
4) exclusion of the application of the provisions on the inaction of the authority and the duty of the authority conducting the proceedings in the cases referred to above (no possibility of filing reminders and complaints to the administrative courts)

from December 31, 2022 to August 24, 2023.

Further extension of the suspension of deadlines for issuing decisions in cases before voivodes.

The draft amendment to the Law on Assistance to Citizens of Ukraine in Connection with Armed Conflict on the Territory of that State and Certain Other Laws , provides for the extension of the suspension of deadlines for issuing decisions in cases before voivodes regarding the following documents and procedures:

1. temporary residence permits (TRC), permanent residence permits (PRC), and EU long-term residence permits,
2. changes of TRC (issued in connection with the performance of work) or Blue Card,
3. withdrawal of TRC, PRC, and EU long-term residence permits.

In the current proposal, these periods are to be further extended until Aug 24th, 2023 (before it used to ne until the end of 2022).

If the amendment with this proposal is signed by the President, this will mean that it will not be possible to effectively complain about inaction, excessive length of procedures, or violation of a party's right to have a case heard without undue delay in the period until Aug 24th, 2023. If an authority fails to issue a decision within the time limit, it will also not be possible to fine it or order it to pay a sum of money to the complainant.

Office for Foreigners has launched a new website at mos.cudzoziemcy.gov.pl

Thanks to the new portal, foreigners can fill out online application forms for a temporary or permanent residence permit and submit them to the relevant provincial governor. After submitting the application in the Case Service Module, it is currently necessary to print it out, sign it and present a paper version during a personal visit to the provincial office. In the future, however, the portal will fully provide the ability to submit the application electronically.

IMPORTANT CHANGES ARE PLANNED ON THE LEGALITY OF RESIDENCE AND WORK

The draft (dated 18.11.2022) of the Law on Amendments to the Law of 12 March 2022 on Assistance to Citizens of Ukraine in Connection with the Armed Conflict on the Territory of Ukraine and Certain Other Laws, which is currently at the Law Committee stage, provides for the repeal of the provisions of Articles 15z-15z3, 15z6, 15zd, 15zzza and 15zzzb of the Covid Law.

The aforementioned provisions regulate the extension of the validity of residence permits, work permits or the deadline for submitting applications for temporary residence permits during an epidemic state or a state of epidemic emergency.

The entry into force of the aforementioned amendments (the amendments to the Act) will result in foreigners whose residence and work permits have been extended by virtue of the law being obliged to submit the relevant applications for residence permits or work permits within 90 days from the entry into force of the aforementioned Act.

For the time being, the exact date of entry into force of the amendment is not known, but it is worth keeping an eye on, it may appear in the coming months.
