Taxation of Clubs and Trade Associations
The Income Tax Act Cap 332 R.E 2019 outines provision regarding the taxations of clubs and trade associations. For purpose of income tax, the below definitions are provided in the Act.

Member club
- A club of similar institutions where all assets are owned in common or held in trust for the members thereof.
- A member is a person who is entitled to an interest in all of the assets of the club or institutions in the events of it’s liqudation or who is entitled to vote at a general meeting of a club or institution

Trade Association
- An association of individuals who are separately engaged in a specific business, formed to safeguard or promote their business interest.
- A member is a person who is entitled to vote at a general meeting of an association.

According to the Act, the activities of a club, trade association or a similar institution are considered as a business.
As such amount derived from entrace fees, subscription etc from the members are to included in calculating the taxable income during a year of income.

However, if three quarters or more is derived from members the income from that business is excempt from taxation. This exemption does not automatically extends to other types of taxes including payroll taxes, VAT, withholding tax,stamp duty among others, unless specified by respective laws and regualations.

It is important for clubs and trade association to ensure compliance with these provisions so as to be able to determine their taxable income accurately.
Also they must maintain proper record of income derived from members and non- members to facilitate tax calculations.
Furthermore, it is crutial for them to understand the definition provided in the Act with regards to clubs and trade association
