The Federal Trade Commission this morning released an interim report, titled "Pharmacy Benefit Managers: The Powerful Middlemen Inflating Drug Costs and Squeezing Main Street Pharmacies," as part of its ongoing inquiry into PBMs that it launched in 2022. The report refers to the more than 24,000 comments the agency received from the public during its probe, including from many independent pharmacists.

While praising the FTC's findings thus far, we're reiterating the need for further investigation into PBM-insurers (including the FTC's pursuit of information that the PBMs have so far withheld) and for policymakers to and finalize reforms that will rein them in.

"Without question – and as the interim report makes clear – the marketplace has exploded because of countless mergers and acquisitions as well as tactics like patient steering and take-it-or-leave-it contracting," NCPA CEO Douglas Hoey says. "It’s a system that may work for massive PBM middlemen, but it’s anti-consumer and anticompetitive."

House panel passes PBM bill that bans spread pricing, only allows a flat service fee | BenefitsPRO The Delinking Revenue from Unfair Gouging (DRUG) Act would require pharmacy benefit managers that contract with a carrier offering federal health benefits plans to “de-link” the fees they charge insurers from the price of drugs.

‼️NCPA is blasting a move by CVS Caremark, which is defending itself in a federal class action lawsuit by a small Iowa pharmacy, to compel the plaintiff into a one-sided arbitration proceeding. Among other things, the plaintiff, Osterhaus Pharmacy, would have to ante up $50,000 before an arbitrator will hear any aspect of the complaint. “The barrier to entry and the one-sided arbitration rules are obscene,” said NCPA CEO Douglas Hoey. “It’s clearly designed to discourage small pharmacies from filing any complaints.”
