An Important Update on “Touring Agreements” and Maryland Law

A well-known property portal recently announced that it will have a “touring agreement” to be used with buyers who have been acquired through its lead-generation service.

This “touring agreement” is in response to the proposed NAR Settlement, which will soon require Brokers to have written agreements with buyers before “touring” a home. Please keep in mind that we have had buyer agency enshrined as Maryland law since 2016.

After careful review of this “touring agreement,” it is the opinion of Maryland REALTORS® that use of this document does not comply with Maryland law.

Specifically, under the Maryland Brokers Act, showing a home is “providing brokerage services,” which may only be accomplished by entering into a written “brokerage agreement” that establishes the “brokerage relationship.”

We strongly encourage you to discuss Best Practices and any agreements you plan to use with your Broker, to ensure that any forms used comply with Maryland law. Furthermore, before using ANY agreements that do not include compensation, check with your broker and your E&O insurance carrier, as some E&O policies may deny coverage if the Broker/Agent did not receive compensation.

Last Thursday was a monumental day for the State of Maryland in the effort to address our state's housing crisis. Maryland REALTORS(R) was honored to participate in the bill signing ceremony for HB 538, the Housing Expansion and Affordability Act of 2024, with Governor Wes Moore, President Bill Ferguson, Speaker Adrienne Jones and many other legislators and advocates who made this bill possible.

In addition, all four Maryland REALTOR(R) Priority Bills were also signed into law Thursday afternoon, bringing to a close another successful legislative session for our members.

A HUGE congratulations to our 2024 Graduating Class of Leadership Academy. We had a great turnout this past Wednesday as we celebrated all the hard working REALTORS who participated.
