Why did they reject my case?

I can’t tell you how many times I’ve had to look at someone in the eyes and tell them “sorry, but we can’t handle your case”. Although I wish I could help everyone, there are some determining factors that most PI lawyers look for when assessing a case.

1. Property Damage: one of the first things I ask about in regards to a car accident is the property damage. If the property damage is minimal (less than $1,500 or just some scratches), we usually don’t take the case. Why? Because insurance adjusters will almost always argue that there was no mechanism for the injury.

2. Gap in Treatment: if you got into an accident and more than 1 week has gone by without you seeking any medical treatment, I usually don’t take the case. Why? Because insurance companies will argue that you weren’t actually injured since you waited so long to treat.

3. No insurance: if you don’t have auto insurance and you, unfortunately, get hit by someone who isn’t insured themselves, I usually can’t take the case.

Make sure you have Uninsured and Underinsured Motorist coverage.

Uninsured & Underinsured Motorist: This coverage is extremely important. If you get hit by someone who is either NOT insured or inadequately insured, you want to make sure your own policy has the proper coverage to step in and cover your medical expenses if you are injured.

Too many of my clients are hit by someone who is either uninsured, an excluded driver on the policy, or a lapse in coverage. This coverage is vital in those situations! So everyone please take a few minutes to make sure you are adequately covered!
