Little victories are key.

Today, after pre-trial motions, I was happy to report several little [and big] victories to my client ahead of her upcoming trial. Her case for injuries arises out of two separate motor vehicles collisions that both occurred almost 5 years ago.

In this case, the defense disclosed an expert biomechanical engineer to testify about, among other things, how the force of the “low impact” rear-end collision did not cause my client to suffer serious, permanent injuries to her cervical spine.

The biggest victory from today was the Judge agreed to completely preclude this biomechanical expert from testifying and offering any opinion testimony in the upcoming trial.

The Judge correctly interpreted the case law and arguments undermining the methodologies used by the expert and determined that the expert was unqualified, his opinions were baseless and that the testimony was being offered to invite the jury to speculate. Experts are expected to educate the jury so that they (lay persons) can come to and make informed decisions and conclusions. This was not the case here.
