Financial institutions asking you for letters of testamentary?
When a spouse or loved one dies it is common to call banks and see what assets were there and who are the beneficiaries. However, often when you call you are hit with a wall. Representatives from the bank are not supposed to disclose information with a non-owner.
If these representatives are asking for letters of testamentary it may be because there is not a designated beneficiary. These assets would then need to go through the courts and probate. What are the risks of not having a will? 📃
If you do not have a will, your estate will go through probate and the court will determine who will receive your assets, based on state statute. (And importantly...a will alone is not enough to avoid probate.)
⚖️ The courts will generate legal expenses your estate must pay.
⚖️ If you are married and have children from a prior relationship, much of your estate could go to those children rather than your spouse.
⚖️ The assets of a single person who dies without a will could go first to the parents of the decedent, or siblings if the parents are not alive—even if you do not get along with your siblings.
⚖️ If you have a long-time partner, your death could leave that partner in a challenging position since state laws do not recognize unmarried partners.
⚖️ Without a will naming a guardian for your minor children, the court will choose a guardian that you might not favor.
