LAW DAY 2022 - “Toward a More Perfect Union: The Constitution in Times of Change”. The Chattanooga Bar Association was honored to have our U S CONGRESSMAN CHUCK FLEISCHMANN attend to present the CONGRESSIONAL RECORD as our Association celebrates our 125th Anniversary!
Every year, the CBA presents the LIBERTY BELL AWARD to a citizen in the community who has strengthened the American System of Freedom under law. Such service includes: 1) promotes better understanding of our Constitution and the Bill of Rights; 2) encourage a greater respect for the law and courts; 3) stimulates a deeper sense of individual responsibility so that citizens recognize their duties as well as their rights; 4) contribute to the effective functioning of our institutions of government; and 5) foster a better understanding and appreciation of the rule of law. Our outstanding recipient of the 2022 Liberty Bell Award is MAYOR JIM COPPINGER Jim M. Coppinger!!
And our speaker was JAMES D. ROBENALT on “The History of naming a woman to the U S Supreme Court”.

LIBERTY BELL AWARD NOMINATIONS SOUGHT

Each year, the Chattanooga Bar Association honors an outstanding citizen in the Chattanooga area with the “Liberty Bell Award” for public service. Nominations are currently being solicited for the 2016 award, to be presented during the annual Law Day Luncheon which will be held Wednesday, May 4, 2016. All nominations should be received by Friday, April 15, 2016, and send to: Lynda Minks Hood, Executive Director, Chattanooga Bar Association, The Pioneer Building, Suite 420, 801 Broad Street Chattanooga, TN 37402.

The purpose of the “Liberty Bell Award” is to recognize community service that has strengthened the America system of freedom under law. In selecting the recipient of this award, the Chattanooga Bar Association considers such service as including activities which (1) promotes better understanding of our Constitution and the Bill of Rights; (2) encourage a greater respect for the law and the courts; (3) stimulates a deeper sense of individual responsibility so that citizens recognize their duties as well as their rights; (4) contribute to the effective functioning of our institutions of government; and (5) foster a better understanding and appreciation of the rule of law.

This prestigious award, presented annually by the Chattanooga Bar Association, will be selected from nominations received by the awards judges. Lawyers and judges are not eligible for the award; however, all other fields of endeavor are intended for the inclusion, namely education, business, sciences, communications, labor, government, religion, professions and youth organizations.

In February 2016, UTC took 2 teams to Jackson, Mississippi to compete in their regional tournament which was hosted at Mississippi College School of Law. Both teams went 6-2 and were 2 out of the 7 teams that qualified to move on to ORCS (Opening Round Championship Series). This is the 3rd time in UTC history a team has qualified for ORCS and the 1st time 2 teams have qualified. This is a huge milestone for their program.
On March 18 - 20, the two teams competed in the Opening Rounds. Unfortunately, neither of the teams received a bid to the National Championship, but they did break another UTC record! The last time UTC went to this competition, they won 1.5 ballots out of 8. Their Blue team won 2 ballots out of 8 which was very exciting. Their Gold team won 1 ballot and tied on another.

They faced some extremely hard competition, but they are very satisfied with the outcome.

Erika Hyde, an associate with Miller & Martin, was one of three coaches for the teams. Shyloah Bisi, an intern with Weill & Long, is Vice President of the UTC Mock Trial Teams and Captain of the Blue Team.

CSTHEA made it to the finals, where they lost to Montgomery Bell.

May 4th - The Read House

“When the United States Attorney Sued to Remove Half the Tennessee Supreme Court: The Quo Warranto Cases of 1870.”

Tennessee’s government underwent great change and turmoil in the period between 1861 and 1871, as citizens of the state chose sides in the Civil War and, in the case of those who supported the Confederacy, suffered disfranchisement and political disability after the war. In 1868, the XIV Amendment to the United States Constitution imposed political disabilities for certain ex-Confederates. But in 1870, the new state constitution required that the entire Tennessee Supreme Court be elected in August, 1870, and men who were subject to the disabilities of the XIV Amendment were elected as justices. The United States Attorney in Knoxville filed cases in Federal court against the chief justice and two other members of the court as well as the Tennessee Attorney General seeking their removal and the imposition of criminal penalties. This remarkable case does not appear anywhere in the modern history of the Tennessee Supreme Court or the Eastern District of Tennessee, and is the subject of Sam Elliott’s Law Day talk, “When the United States Attorney Sued to Remove Half the Tennessee Supreme Court: The Quo Warranto Cases of 1870.”

Sam Elliott is a member of Gearhiser, Peters, Elliott and Cannon, PLLC, and practices primarily in the field of litigation and representation of local governments. He is a past president of both the Tennessee Bar Association and the Chattanooga Bar Association, and is a fellow of the American, Tennessee and Chattanooga Bar Foundations. Sam has authored several books, essays and articles on Tennesseans during the Civil War era, including Isham G. Harris of Tennessee: Confederate Governor and United States Senator (2010), the co-winner of the 2010 Tennessee History Book Award, and a forthcoming biography of John C. Brown, a Civil War general, post-war governor and president of the Constitutional Convention of 1870.

Law Day, held annually on May 1, is a national day set aside to celebrate the rule of law. Law Day underscores how law and the legal process contribute to the freedoms that all Americans share. Law Day also provides an opportunity to recognize the role of courts in this democracy and the importance of jury service to maintaining the integrity of the courts.

Thank you to Presiding Judge Barry Steelman and to the other judges who participated in our Annual Memorial Service this morning. Thank you to the attorneys who prepared and read the Resolutions; and to the attorneys for your support of all the family members of the deceased. It was truly a celebration of their lives and talents as recited in the Resolutions. As stated by Judge Christie Sell, "Any family member of a lawyer can attest that we are sometimes not the easiest people to love. Like the beautiful and exotic orchids, that we all naturally think ourselves to be, we do require constant care and attention to flourish."
