This is a good example of why USCIS forms ask questions such as military history, history of torture or persecution on Adjustment of Status and Citizenship questions. Once a lie has been discovered, U.S. Department of Homeland Security will arrest and charge those who lie on their forms with immigration fraud, even if they are already U.S. citizens.

Ending the month of August with happy clients. Immigrant Visas issued after a lengthy wait. Administrative Processing that lasted about two years and another were we successfully requested a change relating to Principal Applicant's Family-Sponsored Preferences (From Adult Child of US Citizen back to Adult Child of Lawful Permanent Resident) to use the earlier priority date. Soon, these families will be reunited in the U.S.

The USCIS Tampa Field Office will be closed on Wednesday, August 21, 2024 and Thursday, August 22, 2024 due to facility issues. All interviews and appointments will be rescheduled.
USCIS will begin accepting requests for Form I-131F, Application for Parole in Place for Certain Noncitizen Spouses and Stepchildren of U.S. Citizens on August 19, 2024. The Form I-131F will only be available online which means Applicants must create their own online account with USCIS [https://my.uscis.gov/] in order to apply for this program.

USCIS Publishes Filing Guide for Keeping Families Together | USCIS On Aug. 19, USCIS will begin accepting requests for, using a new electronic form, Form I-131F, Application for Parole in Place for Certain Noncitizen Spouses and Stepchildren of U.S. Citizens.
This is why attorneys advise clients who have either TPS, DACA, Asylee status, or in the process of Adjusting or Asylum, against traveling to Puerto Rico or Alaska without first obtaining Advance Parole.

I-751 Approval. Case filed back in October 2022, and approved in July 2024 without any requests for additional evidence or interview. USCIS website indicates processing time of 33 months, and this case was approved in 21 months. Hopefully USCIS will approve these cases in the future with faster times.
The White House issued a memorandum on the Deferred Enforced Departure for certain Lebanese nationals who are present in the United States, deferring removal for 18 months.

This month, Secretary of Homeland Security, Alejandro N. Mayorkas announced the extension and redesignation of Yemen and Somalia for Temporary Protected Status for 18 months, from September 4, 2024, to March 3, 2026 (Yemen) and September 18, 2024 to March 17, 2026 (Somalia), due to country conditions in Yemen and Somalia that prevent individuals from safely returning.
The redesignation of Yemen for TPS allows an estimated 1,700 Yemeni nationals (and individuals having no nationality who last habitually resided in Yemen) who have been continuously residing in the United States since July 2, 2024 to file initial applications for TPS, if they are otherwise eligible.
The extension of TPS for Yemen allows approximately 2,300 current beneficiaries to retain TPS through March 3, 2026, if they continue to meet TPS eligibility requirements. This extension and redesignation does not apply for anyone who was not already in the United States on July 2, 2024.
The extension of the TPS designation for Somalia allows approximately 600 current beneficiaries to retain TPS through March 17, 2026, if they continue to meet TPS eligibility requirements. Current TPS beneficiaries who wish to extend their status through March 17, 2026, must re-register during the 60-day re-registration period from July 22, 2024, through September 20, 2024, to ensure they keep their TPS and employment authorization.
The redesignation of Somalia for TPS allows an estimated 4,300 additional Somali nationals (or individuals having no nationality who last habitually resided in Somalia) to file initial applications to obtain TPS, if they are otherwise eligible. They must have established residence in the United States on or before July 12, 2024, and have continued to reside in the United States since then (“continuous residence”).

The extension of TPS for Haiti allows current beneficiaries to re-register to retain TPS through Feb. 3, 2026, if they otherwise continue to meet the eligibility requirements for TPS. Existing TPS beneficiaries who wish to extend their status through Feb. 3, 2026, must re-register during the 60-day re-registration period from July 1, 2024, through Aug. 30, 2024.
The redesignation of Haiti for TPS allows additional Haitian nationals (and individuals having no nationality who last habitually resided in Haiti) to file initial applications for TPS if they were continuously residing in the United States on or before June 3, 2024.
Furthermore, the Department of Homeland Security recognizes that not all re-registrants who apply for a new EAD may receive it before their current EAD expires and is automatically extending through August 3, 2025, the validity of certain EADs previously issued under Haiti’s TPS designation.

Kicking off the month with another I-130 Approval by a petitioning US Citizen for their parent, that shouldn't have taken over a year. Hopefully USCIS will speed up the processing time on these cases in the future, after they increased the filing fees.
I wish USCIS didn't need over a year to approve an I-130, but at least we can now proceed with the National Visa Center.

To qualify, an immigrant must have lived in the United States for 10 years as of Monday and be married to a U.S. citizen. If a qualifying immigrant’s application is approved, he or she would have three years to apply for a green card and receive a temporary work permit, shielded from deportation in the meantime.
Senior administration officials said they anticipate the process will be open for applications by the end of the summer. Fees to apply have yet to be determined.
