Probate is the process that courts use to enforce the provisions of a Will and deal with any disputes regarding the decedent’s estate. Its purpose is to make sure the deceased person’s debts and taxes are paid and that assets are transferred to the people who are entitled to inherit them.
Without the proper estate planning and legal documents, probate can be a complicated, time-consuming process where your wishes may not be fully carried out.

Shared parenting is shared legal custody. Another name for shared parenting is “joint custody.”
In a shared parenting arrangement, both parents must consult with each other before making big decisions regarding their child. These big decisions are typically educational decisions, medical decisions, and decisions regarding the activities in which the child will participate.
Shared parenting does not necessarily mean both parents will have equal parenting time with their child. The parenting time schedule will depend on what is in the child’s best interest in your specific case.
As you go through the difficulties of a divorce, give yourself permission to feel and function at a less-than-optimal level for a period of time. The divorce process takes time to heal, regroup, and re-energize.
Allow periods where you are not as productive on the job or where you may not be able to care for others the way you’re used to.
Life will eventually get back to normal, although “normal” may be different from what it was in the past. Do your best to stay positive, take care of your physical and emotional needs, and get support when necessary.
Divorce is a difficult, painful time. Some people choose to air their grievances on social media as a way to vent.
But what you put on social media could end up haunting you during the divorce proceedings.

Mediation is a private process where a neutral third person, called a mediator, helps disputing parties discuss and try to resolve their issue outside of court.
The mediator does not represent either party as an attorney or advocate. The legal mediation process is not the same as a court case where a ruling is handed down that parties must follow. If the parties cannot come to an amicable solution during mediation, then the dispute may escalate to a court case.

If you are conscious and capable of making decisions, your living will cannot be put into effect. A doctor will need to make the determination that you are permanently unconscious or terminally ill, and a second doctor has to agree.
Discussing your living will and your wishes with your doctor ahead of time can help ensure your needs are met.
It’s easy to focus on the negatives when faced with changes like divorce, losing a job, or the loss of a loved one. And that may make it hard to cope with what lies ahead.
One way to make things a little easier is by writing down the positives this change has brought. It may be hard at first, but once you start seeing little glimpses of light beyond that dark tunnel, it will help you to stay positive.
Think of things like you got a chance to meet new–or connect with old–friends. It’s made you more aware about self-improvement. You’ve learned new ways to make it through a hard time.
Change presents us with an opportunity to grow, and you can help accelerate that growth process by being aware of the positives.
I structure each mediation based on the individual case and the parties’ preferences. If you do not want to be in the same room as the other party, I am able to effectively mediate between separate rooms.
Typically, I start mediation with the parties together, then I will separate the parties from time to time depending on their requests and what I think is most likely to facilitate the negotiations. I also mediate cases effectively by Zoom if you do not want to be in the same location.

Divorce is difficult. There’s no way around it. Whether you are deeply considering divorcing your partner or are already in the process, you need to remember to be kind to yourself. Accept your feelings, whatever they may be.
While it may not be easy, take a break and show yourself some self-compassion. Don’t view your marriage as a failure; rather, view it as something that is no longer positively serving you and your partner.
And remember, you have legal rights and options when it comes to ending your marriage. The more you know, the better decisions you can make.
You may still need a will to capture any asset that may not have been transferred to the trust during your life. A will can ensure that assets are transferred to your trust.
Assets that are not in your trust and that do not have beneficiary designations may still be subject to probate.
