BREAKING: The Biden Administration has announced the date for the release of the DACA rule. The goal of publishing this rule through the federal regulatory process is to strengthen DACA protections in the face of litigation that seeks to end the program entirely.⠀

A few key dates to note for community members: ⠀
⠀
1. The rule is not yet published, it will be published on 8/30. Today was just an announcement of the unpublished version.⠀
⠀
2. The rule will not go into effect until 60 days from 8/30 (about the end of October).⠀
⠀
3. Individuals cannot use this new rule to apply for DACA at this moment.⠀
⠀

⚖️ Today, a federal judge in New York DENIED a request to process pending initial DACA requests ❌ ⠀

While this decision is deeply disappointing, DACA recipients and community members should remember:⠀
⠀
1) This does not change the current status of DACA. Individuals eligible to renew can and should continue to renew. USCIS will not process initial DACA requests submitted. Those who would be eligible to apply for the first time should consult with an immigration attorney to get an eligibility screening.⠀

2) This decision does not change the pending litigation before the 5th circuit court and a decision on this case has not been issued.⠀
⠀
3) The administration has the power to help these applicants - and it should act.
