Meet our newest feline client, Ellie. Ellie was a purchased by a consumer from a private hobby breeder; but when Ellie arrived, she was very, very sick. The consumer reached out to the private breeder to enforce her rights to reimbursement under Florida Statute 828.29 and be reimbursed for a mountain of veterinary bills- but the breeder turned a blind eye. Pet stores and breeders owe you a duty to sell you healthy pets and have a strict warranty under Florida law- which cannot be modified to offer less protections via their own contract. Our least favorite kind of animal case in Florida is that in which an animal is subjected to and suffers in a #hotcar . Very unfortunately, the eight month old bulldog puppy in this case did not survive. Besides the legal ramifications for the trainer involved in this matter, we wanted to share with you the five steps you need to follow in order to shield yourself from liability if you break someone’s window to get an animal out of a hot car. 1) Can the animal exit themselves? If not; 2) Do you have a reasonable belief that the animal is suffering? 3)Call 911 first; 4) Use no more force than necessary; and 5) Stay with the animal in a safe spot near the car until the police arrive. Florida is one of 14 states that has laws providing protection from lawsuits or charges for people who try and rescue animals or children from hot cars, so follow these steps and don’t let an animal suffer or die that you can save!
