Assault has many defenses. You may have acted in self-defense, defense of others, or defense of your home or property. Witnesses may be lying or mistaken. You may not have threatened immediate violence. You may have lacked the ability to carry out the threat. You may have made the threat in jest or with words only and no overt act.
Stay safe on the road with these defensive driving techniques! Always anticipate the unexpected and be prepared to react quickly.
In every conversation with you, the claims adjuster has one goal: to save the insurance company money. Once you understand this goal, you can protect yourself from adjuster double-talk and get fair compensation for your injuries. If you have questions about negotiating a personal injury settlement, we can help. Call us for a free consultation.
Real or not, these “red flags” will lower the value of your personal injury claim if you can’t overcome them. Insurance claims adjusters are trained to scour your medical records for “red flags” that suggest you’re not really injured; or you’re not as injured as you say you are; or that some other event (that the insurance company is not responsible for) is the true cause of your injuries. We can help you present a complete and accurate medical record and get fair compensation for the harm that was done to you. Call us for a free consultation.
To get an assault conviction, the prosecutor must prove each of 6 these elements beyond a reasonable doubt: 1) you threatened to inflict physical harm on another person; 2) you intended to frighten the person; 3) you had the apparent ability to carry out the treat; 4) the threat included an overt act; 5) the threat made the person fear immediate harm; (6) the fear was reasonable.
Open container laws limit the possession and consumption of alcohol on public streets, sidewalks and other public spaces. The purpose of these laws is to enhance public safety by reducing the likelihood and number of alcohol-related incidents and injuries, including drunk driving and disorderly conduct. These laws vary from state to state, and local laws may differ from one county to another. Open containers of alcohol may be banned entirely or the law may restrict the places where an open container is allowed.
Open container laws limit the possession and consumption of alcohol on public streets, sidewalks and other public spaces. These laws differ from state to state and, often, from county to county; but, in general, an “open container” of alcohol is: (1) Any container without a lid (e.g., a Solo cup); and (2) Any container on which the seal has been broken. This includes, e.g., an uncorked bottle of wine and an open pop-top.
No person “shall be compelled in any criminal case to be a witness against himself.” This is the Fifth Amendment privilege against self-incrimination. It means that you can’t be forced to take the witness stand during your criminal trial. You may choose to remain silent. Here are 4 reasons why remaining silent is the wise choice in most cases.
Here’s a list of four things you should expect from your criminal defense attorney.

The “reserve” is the amount of money the insurance company has set aside (or “reserved”) to settle a claim. A reserve is established at the outset of a claim, but it can be (and often is) adjusted and re-set as new information about the claim becomes available (through your medical records, witness interviews, the police report, etc.).

In a personal injury case, “damages” has two meanings: (1) the harm you have suffered as a result of the injury accident, including economic harm (e.g., medical bills, lost wages) and non-economic harm (e.g., physical, mental, and emotional pain and suffering); and (2) the sum of money you may be awarded in a personal injury lawsuit.
