Considering a Contract for Deed to purchase your home? Here's why you might want to think twice.
A Contract for Deed might seem like a straightforward way to buy a home without a traditional mortgage, but it's crucial to understand the risks involved. Unlike conventional home buying, where you gain a deed and ownership rights immediately upon closing, a Contract for Deed only gives you a deed after most or all of the payments are made, potentially years down the line. The deed remains in the possession of the seller.
Here are a few reasons why this might not be your best option:
1. Lack of Equity Protection. If you miss payments, not only could you be evicted, but you might also lose all the money you've already invested. Unlike with a mortgage, there's little to no protection for the equity you build up over time. If you decide to buy another house, you have no equity built up to use as a down payment on a home purchase.
2. Hidden Liabilities. You could be inheriting the seller's debt problems without knowing it. If the seller has liens against the property or falls into bankruptcy, your right to the property could be jeopardized.
3. Less Legal Oversight. Contracts for Deed are less regulated than traditional mortgages, which means less oversight and fewer protections for you as the buyer.
4. Interest Rates. Contracts for deeds often have extremely high interest rates.
Always consult with an attorney before entering into any agreement. Protecting your interests should be your top priority when buying a home.

A man sued his ex-fiancé for keeping (and selling) the $32,000 engagement ring he gave her after they decided to end their relationship before marrying. (Hattaway v. Coulter).
The suit was based on unjust enrichment. That is when someone holds money or something of value that in good conscience belongs to someone else, or if it is obtained through mistake or fraud.
The Alabama Court of Civil Appeals held that an engagement ring is a conditional gift, and if the condition of marriage is not met, the gift must be returned. Unjust enrichment applies in this case because the man’s fiancé claimed she threw it away in the intracoastal waterway in an attempt to hide that she sold it.

.05 blood alcohol content DUI?
Yes. There is a common misconception that a person’s blood alcohol needs to be above .08 for a charge of DUI. Code of AL § 32-5A-191:
(a) A person shall not drive or be in actual physical control of any vehicle while:
(1) There is 0.08 percent or more by weight of alcohol in his or her blood;
(2) Under the influence of alcohol;
..(There are 3 more but they are beyond the scope of this post.)
So, regardless of a person’s BAC, if the officer believes they are under the influence to a point where they cannot operate a vehicle, they can be charged and convicted of DUI in Alabama.
Imagine a person smells of alcohol during a traffic stop and the officer asks them to step out of the vehicle and they stumble on the way out because of nerves, an injury, or some other reason. During the field sobriety tests, there is a lot of noise and they misunderstand the instructions. The officer can arrest them and charge them with DUI under AL § 32-5A-191(a)2 regardless of what they blow on the breathalyzer.
