This type of deed make it a clear that the transaction is intended to affect community property rights and is used by spouses or domestic partners to change property from separate property to community property (by adding the spouse or domestic partner's name to the deed or from community property to separate property (by removing the spouse or domestic partner from the title, often because of a divorce.).

Good morning...let's talk about an AFFIDAVIT OF CAREGIVER:

"An AFFIDAVIT OF CAREGIVER is a legal document that allows a person who has minor children living with them to act as a substitute decision maker for the child.

The CAREGIVER can use the AFFIDAVIT to enroll the child in school or get medical care for the child. The AFFIDAVIT is based on California law and the CAREGIVER must sign it under penalty of perjury.

The AFFIDAVIT is not a legal guardianship and the CAREGIVER should inform the school and other agencies if the child stops living with them."

Do you have a parent that will be absent from their child/children's life for a short period of time and need to be able to make decisions as being able to enroll in school or see a doctor?

* Maybe mom/dad are traveling for a period of time?
* Maybe parent(s) will be incarcerated for a period of time and a guardian, like grandma has to step in?

"A CONSERVATORSHIP is when a judge appoints another person to act or make decisions for the person who needs help. The person the judge appoints is called the CONSERVATOR. The person who needs the help is the CONSERVATEE. A judge can only appoint a conservator if other less restrictive options won't work."

Its a hard realization when some are facing being incarcerated, but its a reality people face every day.

Caregiver's Authorization Affidavit, are also known as Power of Attorneys.

With this you are not giving up custody of your child, its a temporary power of attorney to allow your loved one handling the care of your child, to make medical, educational decisions for your child, for you while you are temporarily away.

WHAT IS NEW THIS MONTH: Not a lot of people are aware that grandparents ALSO have rights in the state of California, which means you can file paper work to get a custody order to enforce those visitation rights. (ASK ME for more information)

These both are services that cost thousands $$$$$ with an attorney but LDA's can make it affordable and possible.

There are so MANY other things that LDA's can help with and we are reasonable and inexpensive and happy to help.
