As Connecticut lawmakers celebrate their legislative "victories" may the reality of our dead women and girls sober their celebration. Once again the Connecticut Republican Party and the Connecticut Democratic Party failed the domestic violence victims who did not make it out alive. For three years, their mothers and families have begged for legislative change to CT criminal code. This year 33 Senators and Representatives from BOTH SIDES OF THE AISLE proposed legislation to define intimate partner murder in criminal code. Why? Because neither Felony Murder or Murder include a past pattern or conviction of domestic violence or intimate partner abuse, violations of protect orders, and or coercive control nor does it address a homicide committed during an act of intimate partner abuse or domestic violence. Making it extremely difficult for families to receive justice in our criminal court system. The proposed bill was NEVER heard. The judiciary committee said they will only consider their own proposals. How is that "representation of the people"? Survivors of homicide are your constituents and yes - you've reminded them again that to you they and their murdered loved ones have little value. The families asking for this law are not the hypotheticals you argue on the floor, they are real and live this nightmare. It's ridiculous when you have one side that thinks it knows it all and the other side that thinks it knows it all and both are incredibly INCORRECT! You won't listen to the ones who know it best, the constituents in your communities left suffering. So at midnight - as you celebrate the end of session, remember the dead women and girls, their mommas, children, dads, sisters and brothers. Before 14 more women are killed and their families face the devastating realities of seeking justice in a system that does not value the murder of women by men who they have a relationship with.

Current criminal law in Connecticut makes it difficult for prosecutors to charge perpetrators of intimate partner killings with murder. This is because it simply does not account for the patterns of systematic violence that often precede the ultimate acts of murder. Rather, the current legal framework gives these perpetrators a way to avoid a murder charge by claiming that they acted in the “heat of passion”— even if those perpetrators had been abusing their partners for years prior. Avoiding a murder charge often means pleading down to a lesser manslaughter charge, meaning violent killers will often serve sentences shorter than the length of time they had been abusing their victims. This goes against the principles of justice and public policy.

The survivors of murdered women and girls will not stop until their killing is properly addressed in CT criminal code.

"The statement that will haunt me the most is when Brandon Roberts said he couldn't 'just pistol whip her' (referring to my niece), implying that she would eventually wake up and implicate him for all of the crimes he had committed," Delaney wrote. "He chose to silence Emily forever and put a bullet in the back of her head. Protecting himself and his secrets were more important to him. I believe that if this monster knew he would spend the rest of his life in jail with no chance of parole for ending Emily's life he would have made very different decisions that night and my niece would still be here."

Thankful State Representative Raghib Allie-Brennan that we were able to carve out violent firearm felonies from SB 1019 Clean Slate's automatic erasure in 2021. We must continue to reduce violent crime in CT by protecting citizens from becoming and or Hurt people hurt people and the state must intervene through targeted criminal justice procedures that keep repeat violent offenders off the streets and from perpetrating further gun violence. CT's broad-brush approach to criminal justice is failing communities impacted the most. Listen to listen to the families most impacted.

*** Hartford data drawn from 345 gun violence incidents between January 2019 and March 2021 shows that 85% of the suspects arrested for gun crimes had been convicted of gun crimes previously.

Last year, of the 44 people arrested in Hartford for murders or attempted murders with guns, 39% had charges pending from other crimes, but had been released from custody after posting bond. Fifteen percent were on probation. Five percent were on parole. Of those arrested last year, 39% had prior convictions for violent felonies or gun crimes.

In the cases of most victims and shooters, only one or two of their 10 prior arrests prior arrests resulted in incarceration. More than half were dismissed or expunged some other way.

The mayors, working through the Connecticut Conference of Municipalities, are asking the legislature to adopt a 10-point plan that would create a new category of crime — “Serious Fi****ms Offense” — and enact narrowly focused laws to make it easier for courts to restrict the pre-trial release of offenders and return them to prison if they reoffend after release.

“This sends a message that it is not acceptable to continue to be a violent offender and just come home and walk free to cause more harm and danger to the community,” said Loquavia Jones, who lost two sons to gun violence in New Haven, in 2020 and again in January.

“We have to send a message that if you are willing to continue to commit violent crimes you have to pay for that and that sometimes involves your freedom,” Jones said.

“The group that is gathered here today is also here to say that we need to make sure there are more severe consequences for those who are repeat serious offenders, who are engaged in gun violence in our communities,” Hartford Mayor Luke Bronin said. “And to say that if you have a record of serious offenses and you commit a new, serious fi****ms offense, we need to make sure that there are swift and severe consequences. This is about saving lives. This is about making our communities safer and stronger.”

Among the group was Deborah Davis of Hartford, who spoke for Mothers United Against Violence.

“This proposal, these ideas specifically, are so important to us,” she said. “Because we want to make certain that individuals are not back on the street. We are supporting every proposal that would alleviate some of the concerns that we have with some individuals being able to come back out so quickly.”

We are asking lawmakers to add Intimate Partner DV Murder to Criminal Code; Under Murder so that States Attorneys can charge Intimate Partner Murder for what is is Murder and not Manslaughter.

Our legislation will give prosecutors a way into the conversation about the control, violence, physical or otherwise, that led up to, and likely contributed to that ultimate act of violence, by rightly classifying that ultimate act as murder.

And it’s also important to continue to broadening protections for domestic violence survivors and/or victims in statutory law, because reporting statistics have historically been so low, especially when it comes to acts like psychological or emotional abuse and coercive control (i.e., threats or intimidation), and any sociological study will tell you that these sorts of patterns almost always escalate—and frequently, once the abuses in a relationship escalate past a certain point, there’s little to no chance of it being reported.

So legislation that specifically recognizes the abuses that have been reported by the victim is one way to add weight to the voices of those who are suffering those abuses.

The courts must have the tools to prosecute the killers to the fullest extent of the law, allowing survivors some semblance of peace while serving as a deterrent to abusers.
