Westlaw Journal’s “SCOTUS Spotlight” featured litigation partner Mark Lezama’s comments on the Supreme Court’s ruling in Vidal v. Elster.
In its decision handed down earlier this year, the Court found that the Lanham Act’s “names clause” is constitutional and upheld the Patent and Trademark Office’s decision to bar the trademark “Trump too small” from being registered.
Commenting on the ruling, Mark said: “In this decision, the slim majority expanded the realm of cases in which ‘history and tradition’ decide a constitutional question. With this decision elevating the importance of this analytical approach favored by Justice Thomas, we can expect attorneys to increasingly litigate competing views of history when arguing constitutional questions—even in the IP context.”

In a recent World Trademark Review article, Knobbe Martens partner Jonathan Hyman, offered his perspective on recommendations outlined in the Copyright Office’s latest report addressing the need for digital IP legislation.
Hyman, who co-chairs the firm’s advertising, media and entertainment practice group, discussed protections against “deepfakes” and why it is more important than ever for legislation to address rights of publicity and other IP rights.

In the latest installment of their Law360 column on recent noteworthy Federal Circuit decisions, Knobbe Martens partners Jeremiah Helm and Sean Murray analyze the outcome of Amarin Pharma Inc. v. Hikma Pharmaceuticals USA Inc.
The authors explore the Federal Circuit’s reasoning behind the decision, and suggest that Amarin could impact litigation in other industries. “The ultimate result from Amarin is a very permissive pleading standard for induced infringement,” they write. “While Amarin was decided in the context of FDA-approved drugs and generic equivalents, the court expressly noted its decision applied a run-of-the-mill inducement analysis not limited to the specific pharmaceutical regulatory situation.”

A team from Knobbe Martens has secured another victory for Global Shade Corp. in its ongoing litigation against With-U E-Commerce (Shanghai) Co., Ltd. The team successfully persuaded the USPTO's Patent Trial and Appeal Board (PTAB) to hold all challenged claims of U.S. Patent No. 10,669,738 unpatentable in an inter partes review (IPR) proceeding and to deny With-U’s motion to amend the claims. The PTAB's Final Written Decision, issued this week, adopted Global Shade's arguments and canceled all challenged claims.
The Knobbe Martens team representing Global Shade included Marko Zoretic, Nathan Reeves, and Logan Young.
This decision is the most recent in a series of wins Knobbe Martens has secured on behalf of Global Shade before the PTAB and in district court.
