People frequently ask me if their employer can retaliate against them for hiring a lawyer to represent them in class action lawsuits. However, the answer is simple: it is illegal in California for employers to retaliate against current or former employees who have sued or filed a complaint against them. As a result, employers cannot legally fire, demote, harass, or discriminate against you for hiring an attorney to draft a demand letter, filing a lawsuit, or reporting workplace violations.

Have you ever heard someone tell you, β€œif you quit your job, you can’t sue for wrongful termination”?

Let’s talk about it!

It's a widespread myth that resigning from your job automatically prevents you from filing a wrongful termination lawsuit. However, under California law, employees who resign because of a hostile and unbearable work environment can still sue for constructive discharge.
