A. Researching your GC beforehand
1. Registration. Your general contractor (“GC”) must be a registered contractor. Otherwise you forfeit your right to file a lien against the owner’s property. Go to the website of the Department of Labor and Industries (“L&I”) at the beginning of each project to confirm that your GC is a registered contractor. You do not have to keep checking the L&I website every day during the project. You only have to check once at the beginning. If the GC’s license is suspended in the middle of the project, that will not affect your lien rights. What matters is that the GC is registered at the time that you start your work. If you are a second tier subcontractor, you need to verify that the first tier subcontractor that hired you is a registered contractor, but you do not need to verify that the GC is registered.
2. Lawsuit History. You can obtain information about all lawsuits (past and present) filed against your GC’s bond by viewing the GC’s profile at L&I’s website. You can also obtain information about all lawsuits filed against the GC and its owner(s) by accessing the Washington Court’s webpage (www.dw.courts.wa.gov). If there are present claims against the GC and/or its bond, that means your GC may be in the middle of a major cash crunch and the risk is higher that Peter (you) will be robbed to pay Paul (a more pressing creditor).
3. Newly formed company. Is your GC a newly formed company? Is it a reformation of a previous company that went out of business? Is this a GC that keeps darting in and out of different business forms and companies? You can obtain this info from L&I’s website and the Secretary of State’s website. To get the corporate information, first get the GC’s UBI number from the L&I website and plug the UBI number into the corporation search page at the Secretary of State’s website. If your GC has had other associated business ventures, you will see this list labeled “other associated licenses” on the L&I website. You can also do a search on L&I’s webpage for the business owner by first and last name. This will provide you a list of all businesses associated with that particular person and the status of that business (e.g. expired, active, etc.).
