Excerpt: Majority opinions for the U.S. Courts of Appeals for the Fifth and Sixth circuits followed suit in denying the Department of Education’s requests to stay orders blocking the Aug. 1 enactment of Title IX rule changes, however, two judges have emerged as the first to side with the Biden administration’s gender-identity mandate provisions.
“The Sixth Circuit has telegraphed that the expansion of Bostock v. Clayton County’s definition of s*x discrimination into other areas, including Title IX, is likely dead on arrival or at least in for a substantial uphill battle,” Hamill said. “Whether the panel that gets the case on appeal will conclude similarly remains to be seen, but the reasoning on the request for a partial stay is, in my opinion, significant.”

Additionally, the committee participates in the College Bound Experience, assisting youth with shopping for college necessities, and conducts legal presentations to educate them about their rights and responsibilities.

Earsa Jackson is quoted in the National Law Journal’s FTC Oversight of Franchisors Should Be on Case-by-Case Basis, Franchise Lawyers Say.
“I don’t see that there is any widespread industry attempt to impede discussion with governmental agencies,” said Jackson, a Clark Hill member. “The concern with the broad brush is putting the entire industry in one basket when there might be only some isolated issues.”
The FTC’s concerns could be addressed “on a case-by-case basis,” she added.
“The brands, at least the ones that I work with, their goal is to have a good relationship with the franchisees,” Jackson said. “Those that are in it for the long term realize the value of having a good relationship and dialogue with their franchisees.”

"We really must start looking at cybersecurity from a resiliency perspective. And we must change the way that we operate. Threat actors know what’s valuable. They know in the US, Social Security numbers are valuable, and in the US, we’ve tied Social Security numbers to everything. So, we until we really stop tying all that information, and we devalue what it is, they’re getting their hands on, they’re still going to see value in it,” said Melissa Ventrone, a former US Marine Corps intelligence specialist who is the head of the Chicago law practice Clark Hill’s cybersecurity team, and a specialist in ransomware recovery.
“On this concept of resiliency, if we could come up with a concept that enables or helps in the healthcare space. Let’s say a hospital gets hit by ransomware, are there facilities that we can set up that they could plug into almost immediately to continue providing the care and when they’re back up then it gets transferred back over?"
“If you have a business, you should be required to have this resiliency concept. So, if something does happen, then you can still continue to operate, provide services to consumers, customers, and businesses. It should be mandated.”

“A patient crosses the line from merely annoying to worthy of termination when the patient or their family member threatens the provider or staff with violence or exhibits threatening behavior; the patient participates in drug diversion, theft, or other criminal activity involving the practice; or the patient exhibits inappropriate behavior or s*xual misconduct toward the provider or staff,” Schmeltzer says. “If, after speaking with the patient, they refuse to follow the treatment plan, discontinue medication or therapy regimens prior to completion, or repeatedly cancel follow-up visits or fail to keep scheduled appointments with providers at the practice, then the patient’s actions also warrant termination from the practice.”
