What are Administrative and Temporary Roadblocks?

Administrative Roadblock: Defined as any measure taken by police to control traffic at a specific location for a lawful purpose other than checking vehicle occupants or responding to an emergency. This could involve DUI checkpoints, license and registration checks, or collecting data for traffic studies.

Temporary Roadblock: Established for specific reasons like apprehending wanted individuals or controlling traffic near an accident scene or potential hazard.

What are the Requirements for Each Type of Roadblock?

Administrative Roadblock:

Clearly visible from at least 100 yards in both directions.
Marked entrance with a large, illuminated "Stop" sign and a flashing red light.
Warning signs with the words "police stop ahead" placed at least:
¼ mile away in rural areas.
700 feet away in urban areas.
Illuminated with bright lights to attract attention.
Temporary Roadblock:

Visible from at least 100 yards in both directions.
Marked entrance with a clearly marked emergency vehicle with flashing lights.
Cones, flares, or similar markers to channel traffic and warn of the roadblock at least 100 yards before entry.
Additional markers 200-400 yards before the roadblock to warn of potential hazards.
Important Points for Drivers:

It's illegal to proceed through either type of roadblock without following police instructions.
Obey all directions from officers at the roadblock.
Penalties for failing to stop at a roadblock can range from a gross misdemeanor to a category B felony depending on the severity of the outcome.
These provisions don't limit the authority of police officers for regular traffic control measures.
Additional Notes:

A separate statute (NRS 484B.574) deals with situations where drivers ignore roadblocks due to flooding and potentially face liability for emergency response costs.
Provisions are included for situations where drivers make a good faith effort to assist someone in danger during flooding.

School Zones vs. School Crossing Zones in Nevada: Understanding the Difference

Nevada traffic laws differentiate between two areas of heightened caution for drivers: school zones and school crossing zones. While both areas require extra vigilance near schools, the key distinction lies in their location relative to school property.

School Zones (NRS 484B.063):

Defined as sections of streets adjacent to school property.
This encompasses areas bordering the school grounds, likely including sidewalks and streets directly in front of the school.
Increased driver awareness is crucial in these zones due to the presence of children entering or exiting school grounds.

School Crossing Zones (NRS 484B.060):

Defined as sections of streets not adjacent to school property that pupils use while following designated walking routes.
This likely applies to crosswalks situated away from the school itself, along the designated walking paths used by students.
Extra caution is required from drivers as children may be crossing at these designated points, even if not directly in front of the school building.

Remember: Whenever you see signage indicating a school zone or school crossing zone, slow down, be extra vigilant for children on foot, and yield the right of way as necessary. Following these guidelines helps ensure the safety of students on their way to and from school.

Hold Your Horses, Chief Justice of the Peace Cynthia Cruz! Is Nevada's Phone Law Out of Control?
Is simply looking at your phone with the screen OFF illegal in Nevada? A recent decision by Traffic Commissioner David F. Brown, who serves at the pleasure of the Chief Judge, has drivers and lawyers alike scratching their heads and questioning the fairness of our traffic laws. The case is State of Nevada v. Kristina Vadamovna Figurazh, Case No. 23-CI-010814.

Here's the head-scratcher: Commissioner Brown ruled that simply glancing down at a phone, even with a blank screen, can be considered "reading data" under NRS 484B.165, the state's law prohibiting handheld devices while driving.

Whoa, whoa, whoa! Hold on just a second, Chief Judge! This interpretation seems a bit...extreme, doesn't it? Let's dig into why we're not convinced:

- Plain and simple: The law says "reading data," which implies actively accessing and understanding information on a screen. A blank screen doesn't exactly scream "data consumption."
- Lack of evidence: In the case at hand, there was no proof the phone was even in use. Are we criminalizing quick glances at inactive phones now?
-Overreach alert: Expanding the law beyond its intended scope raises serious concerns about due process. Should we all carry legal counsel in our glove compartments, just in case?
-Chilling effect on responsible drivers: This interpretation could discourage folks from even touching their phones for legitimate reasons, like adjusting a hands-free mount or checking a notification. Is that the message we want to send?

We understand distracted driving is a serious issue. But let's focus on the real dangers, not penalizing people for innocent glances at blank screens.

Chief Judge, we urge you to review this decision. Let's ensure Nevada's traffic laws are fair, clear, and focused on genuine distractions, not innocent actions.

These unexpected delays, even affecting some cases finalized as early as 2021, warrant further investigation. With this in mind, I am advising my clients to consider communicating their concerns directly to the Commission on Judicial Discipline. I have drafted a sample letter to assist in this endeavor:

Two up, two down as they say in baseball!

My friend, old school criminal defense attorney (ret.) Dan Markoff, has a great saying: "When the facts are on your side, argue the facts. When the law is on your side, argue the law. But when neither the facts nor the law are on your side, pound your fists on the table and declare that it just isn't fair!"

I didn't have to pound my fists on the table today, but I did win one case by arguing the law and another by arguing the facts. This reminded me of my friend's advice and it was a great result for both clients!

AB116 has given Clark County District Attorney Steve Wolfson the excuse that he needs to ignore his duty to prosecute traffic offenses. As a result, all traffic offenses filed in the various justice courts are now prosecuted by the courts. Despite this unconstitutional and illegal practice, we managed to get two more speeding ticket cases dismissed yesterday.
