I was there when the Twin Towers fell. What I remember the most is the impromptu memorials along the streets. I took my son to the 9/11 Museum at Ground Zero this spring. I was surprising how little he knew and how many questions he asked. We must make sure the next generation never forgets.

Even some of the best Estate Planning Attorneys in the country aren't talking about the dirty secrets of estate planning.
Years of advertising, tradition, and whole armies of attorneys, CPAs, and retirement planners have convinced most responsible Americans that they need to have a living trust.
But the truth is that the “plain old” living trust that most people setup is hopelessly broken.
The first time I realized that the plain old living trust was broken I was shocked. How could so many people be so wrong about the living trust?
The truth is, it's no one person's fault that the plain old living trust is broken.
However, it is everyone's responsibility to educate themselves about the dark side to estate planning.
I've distilled my 17 years as an award winning living trust attorney into this FREE webinar so that you can protect yourself and your loved ones.
It costs nothing and is no obligation, but it could mean the difference between protecting your loved ones or leaving them exposed to a legal blow up.
Happy Groundhog Day!
Sometimes it's really the "pointless" holidays that are the most fun.
One of my favorite movies is Groundhog Day, with Bill Murray. Sometimes I wish I could have a second chance to "redo" a day. Unfortunately I probably won't have that chance, so today's a good reminder that every day counts.
Being prepared for the future is incredibly important, since you'll never get the time back if you're not prepared!
What are some ways you make sure to take advantage of every day?
I get so many questions about what a trust is able to do and how they work.
If there's one theme running through them, it's that there's a lot of confusion about what a living trust is and what they can accomplish.
This is just a brief overview, but hopefully it helps you understand the difference between living trusts and asset protection trusts.
Check out a short article that goes into a little more detail on our website, it's in my comment on this post!

Years ago my grandpa told me, “Gary, never forget that the family comes first.”
Every day that I have practiced law I have tried to remember his words and to put my family first.
I’m pleased that for over 17 years we’ve been able to help our friends and clients to do the same for their families.
Thank you to all of our clients and friends for your trust and support.
Are you related to a famous historical figure?
I've always been interested in family history and after doing some digging, I found out that Mark Twain is my eighth cousin, four times removed.
How cool is that?!
All too often it's easy to get caught up in the day to day stresses of work and life and forget to be grateful.
My ancestors were imperfect but left me with a rich heritage.
I hope I can leave the same rich heritage for my children and (future) grandchildren.
Are you related to any famous people? Let me know in the comments!
Have you properly funded your Living Trust?

At a recent webinar for my Membership Plan Clients, a client asked: "What happens to my trust after I die?"
The process of planning for one's own mortality is never pleasant, but I hope this flowchart can help you and your loved ones understand what the process might be like when the time comes.
While it isn't a detailed explanation or intended to replace competent legal advice, I hope it helps clear up some of the uncertainty for you.
I wish you and your loved ones a happy and safe advent season.

This is so tragic...a man wins $4,000 at a local casino, he tells his friends and family the good news and then he's robbed on two separate occasions and then is murdered.
One of the reasons I tell folks to get planning done is because there are bad people in the world who will take advantage of your beneficiaries if they learn that your beneficiaries inherited money (or in this case won money).
There are other, more sophisticated, ways that people can take your beneficiary's inheritance. I see it all the time.
Boyfriends now want to marry your daughter after she gets the inheritance. Your son is now being threatened with frivolous lawsuits.
Standard living trusts may have the ability to avoid probate (I emphasize may), but it is highly unlikely that they have the power to protect the inheritance once it's in the hands of your beneficiaries.
This is one of the 4 Dirty Little Secrets I talk about in my weekly webinar...Living Trust Secrets Masterclass.
Man robbed twice after winning $4K jackpot, fatally shot in 2nd A man who was shot to death near UNLV on Nov. 9 had won a $4,000 jackpot two days earlier, after which he was targeted in two armed robberies, police said.
It is time.
Many folks think a living trust is going to avoid probate. The truth is...it might. Or it might cause the "Double Probate."
Double Probate is a term I invented to describe a dirty little secret most attorneys don't want to talk about.
It's when you pay the attorney to form a trust to avoid probate. And when you die, your family pays the attorney again...for the probate.
There's a solution to solving this problem. The answer, in part, is that you must provide the proper care and feeding of your trust...
The oldest of the Baby Boomers turning 75! My dad turned 75 last Friday. Here he is on his horse "Snip" who lies down on command. When I wished him a happy birthday my dad said, "And the shadows are growing even by longer as the birthdays fly by." Life is short.
With 71 Million Baby Boomers, it's no surprise that most of my clients are from that generation.
As their attorney, my biggest concern for them is
1. Losing their mental capacity and becoming subject to the "Unholy Circle" of Adult Guardianship Court
2. Bequeathing their children with Naked Assets
3. Avoiding the "Double Probate"
4. Gold Diggers sneaking in and taking over their finances.
This is a photo of my step-mother, Mardi, reading to two of my children in 2009. This was at the early stages of her diagnosis of Alzheimer's Disease. Mardi eventually died of Alzheimer's Disease.
Yesterday, I met with 3 different couples who each had a spouse with the early stages of Alzheimer's. Lucky for them, it was just at the very early stages, so their spouse was still capable of signing a plan.
There is so much sadness and frustration when your spouse or parent gets a diagnosis. Many folks wait too long to do any planning and the disease advances to the point where no planning can be done.
That's when Adult Guardianship Court takes over.
Don't let that happen to you.
This is one of the better discussions I've heard on the Afghanistan issue. It seems like the more we let the politicians divide us, the more dangerous it will be for us as Americans. I believe in taking radical responsibility when I make mistakes. When I mess up and admit it and find a way to make it right, I rebuild trust others may have lost in me. This should be the standard for our leaders as well. But there is no incentive anymore for politicians to take responsibility. That has to stop. It starts with me and teaching my children to take responsibility. If we all did that, think of the massive results we could achieve as individuals, families, communities and as a country. We can do it!
Unmitigated Disaster.
