Absolutely read if your from Texas.

Lawsuit Threatens Tort Reform Noneconomic Damages Cap The bedrock of the medicine-backed 2003 tort reform legislation in Texas was a $250,000 cap on noneconomic damages in medical negligence lawsuits, a balance that the Texas Medical Association helped lawmakers strike between compensating injured patients and keeping physicians out of bankruptcy.

Overmedicating a common practice in Nursing Homes!
It is not uncommon for nursing homes to overmedicate residents to keep them calm. Antipsychotic drugs are often given to residents to stop the agitation that so frequently accompanies dementia or Alzheimer's disease. Overmedication is a form of nursing home abuse.

What are typical duties of an ombudsman?
An ombudsman has the power to investigate and file complaints against otherwise influential organizations or high-ranking officials. They often have the power to request key documents, interview individuals, and order a legal investigation if necessary. If agreed to, ombudsmen rulings are legally binding.

Justice for Marion

This page is about a voice for the elderly in nursing facilities. We want to make changes. Statistics in nursing home fatalities of abuse, neglect and deaths are staggering and horrifying. Forty percent of residents reported abuse. A total of 90% of nursing home patients reported neglect. A typical nursing home reports (many are not reported) 100-200 falls per year. 1800 elders die each year as a result of a fall. Others can be left with severe disabilities, greatly affecting their quality of life.

We want our loved ones that are placed in these facilities to have a voice, to feel safe, have the quality care and medical treatment they deserve. Most of all keep their dignity.

Let’s make changes. We should require more mandatory inspections, more nurses and aids. A voice can make a difference, but we need your stories and your help.

My father, Marion Richardson, did not have that voice. He gave the ultimate sacrifice – his life – as a result to poor care and neglect. HE WAS ROBBED OF HIS LIFE ON THIS EARTH WHICH IS A GIFT FROM GOD.
