Russ August & Kabat's (RAK) patent trial team, led by Marc Fenster and Reza Mirzaie, won a dramatic and total victory on behalf of its client, MR Technologies, against hard drive giant Western Digital, which was represented by Latham & Watkins LLP. Fenster and Mirzaie were assisted by Dale Chang, Brian Ledahl, Matt Aichele, Jacob Buczko, Minna Chan, and Paul Kroeger.

The jury awarded more than $262,000,000 in royalties to MR Technologies for Western Digital's infringement of its patents for increasing storage capacity on disk drives.

In a statement to Law360, Fenster said, "We are very gratified with the jury's verdict. This jury was very technically sophisticated and completely engaged throughout the two-week trial."

The patents-in-suit are U.S. Patent Nos. 9,928,864 and 11,138,997.

Mr. Chang represents clients in high-stakes patent and trade secrets litigation, with a particular focus on trial work. He thrives in high-pressure settings where he is known for quickly identifying weaknesses in the opponent’s case and devising creative strategies to exploit them. Prior to joining RAK, Mr. Chang was counsel at Latham & Watkins, where he litigated patent cases for over 15 years. He also has a Bachelor of Science degree in electrical engineering.

As Judge Albright’s most experienced former clerk now in private practice­­, Mr. Tong looks forward to building a local counsel and patent plaintiff contingency practice.

With nearly a decade of patent litigation and prosecution experience, Mr. Tong brings a wealth of unique insight and technological understanding to any patent team. Mr. Tong has represented companies in numerous patent lawsuits and helped a client secure a jury verdict for hundreds of millions of dollars. He has won inter partes review (IPR) proceedings before the USPTO and matters for both plaintiffs and defendants before federal courts. Besides patent litigation, Mr. Tong has also handled cases regarding thefts of trade secrets and breaches of confidentiality.

Opening a Dallas office near the popular Texas venues in Waco and Marshall allows the firm to better serve its clients who frequently litigate there. Russ August & Kabat Partner Bennett A. Bigman's article, "Warhol, Prince and the Future of Copyright", was published in the 10/6/22 issue of the Daily Journal. The article discusses Andy Warhol Foundation v. Goldsmith and the Supreme Court's review of what qualifies as "transformative" expression under the copyright fair use analysis. The article concludes that courts may face even more difficult questions about whether human expression is needed for protection of original or transformative works as AI-generated content and works created by computer algorithms become more prevalent.
