I am excited to share with you that I recently participated in my third speaking engagement for Lawyers' Mutual Insurance Company. The topic of my speech was "Opening Statements in a Criminal Case," and it was an honor to share my knowledge and experience with fellow legal professionals.
As a criminal defense attorney, I have seen firsthand the importance of a well-crafted opening statement. It sets the tone for the entire trial and can significantly impact the outcome of a case. During my speech, I discussed the key elements of an effective opening statement, including capturing the jury's attention, outlining the defense's theory of the case, and establishing credibility with the jury.
I also shared some tips and best practices for preparing an opening statement, such as conducting thorough research, identifying the key issues in the case, and practicing the delivery of the statement.
It was a privilege to speak to my colleagues at Lawyers' Mutual Insurance Company, and I am grateful for the opportunity to share my insights and experience with others in the legal profession. I look forward to continuing to participate in these types of events in the future.

AV Preeminent Rating Obtained by Vincent John Tucci
Historically the Martindale-Hubbell® Peer Review Ratings™ system utilized an “A - B - C” scale to estimate the legal ability and ethical standards of an attorney. To qualify for an “A” rating an attorney had to be reported as “Very High” in their legal ability and had been practicing for at least 10 years.
A second rating was also given to go along with the “A - B - C” rating and that was a “V,” meaning that the attorney's peers stated they had "Very High" ethical standards. Over the years this transitioned to “AV”, “BV”, and “CV” ratings - with an “AV” rating meaning that the attorney had reached the highest of professional excellence and is recognized for the highest levels of skill and integrity.
AV Preeminent®: The highest peer rating standard. This is given to attorneys who are ranked at the highest level of professional excellence for their legal expertise, communication skills, and ethical standards by their peers.
A suspect’s rights must be “scrupulously honored.” (Miranda v. Arizona (1966) 384 U.S. 436, 478-479 (Miranda).) “To establish a valid [Miranda] waiver . . . , the prosecution must show . . . the waiver was knowing, intelligent, and voluntary.” (People v. Nelson (2012) 53 Cal.4th 367, 374-375.) “Determining the validity of a
Miranda rights waiver requires ‘an evaluation of the defendant’s state of mind’ [citation] and ‘inquiry into all the circumstances surrounding the interrogation.’” (Id. at p. 375.)
When a Mirandized suspect is being questioned by the police, and the suspect at any point says he wants to speak to an attorney, the police cannot question the suspect any further “until counsel has been made available to him, unless the accused himself initiates further communication, exchanges, or conversations with the police.” (Edwards v. Arizona (1981) 451 U.S. 477, 484-485, italics added (Edwards).)
Once a suspect invokes the right to counsel, everything changes; that is, the police can no longer engage in efforts to convince the suspect to speak to them. (See McNeil v. Wisconsin (1991) 501 U.S. 171, 176-177.) This is because “‘a change of mind prompted by continued interrogation and efforts to convince the defendant to
communicate with the officers’ cannot be considered a voluntary, self-initiated conversation.” (People v. McClary (1977) 20 Cal.3d 218, 226-227, overruled on other grounds as stated in People v. Cahill (1993) 5 Cal.4th 478, 509-510, fn. 17.)

Vince can't thank you enough. God has his ways of putting the right attorney for people that do want to change.
