What is the foreclosure process in NY?

The foreclosure process is when the lender sues to recover the property after payments for the mortgage loan, taxes or insurance are not made. Prior to commencing an action, however, the lender must comply with several notices – depending on the borrower resides at the premises or not, or whether the property is vacant or consists solely of land. But generally, the lender’s servicer files a complaint with the state court and simultaneously filing a notice of pendency with the clerk of the county. That notice is served upon the borrower(s) and any occupants of the dwelling.

How does a tax foreclosure work?

Your accrued taxes, interest, and penalties will build up over time if you’re not keeping current with your property taxes. That delinquent amount can then become a lien on your property that can negatively affect your ability to sell your home or refinance your mortgage because liens remain with the property regardless of who owns it. That lien means the taxing authorities can introduce tax foreclosure proceedings (similar to the mortgage foreclosure process) on your house to collect the overdue amounts.
