My client was arrested for carrying a concealed firearm prior to the July 2023 gun law changes in Florida. As soon as I got on the case I filed a Motion to Dismiss the charges because there were several legally recognized defenses to the charge he had. The motion was largely ignored by the Court, so we filed a Demand for Speedy Trial. The case was up for trial on 4 different dates before the State ultimately decided to dismiss the Felony gun charge and file a Misdemenaor, which will also eventually be dismissed. No plea deal. No convictions. The officers in the case should have never arrested my client, but because they did not know the law and because they were being vindictive, they arrested him,and the State rubber stamped a bad arrest. Fortunately, with the right amount of pressure, the charges were dismissed. Gun laws can be very confusing and to make matters worse the laws just recently changed.If you have a gun, contact a lawyer who can tell you how to legally carry it. Don't get advice from Google because there is a good chance it can be wrong. Sometimes we win cases, and sometimes we lose. Today we won and my client was happy. #asilialaw #concealedcarry #gunrights
If you are arrested for a domestic violence offense in Florida, the court will hold you overnight and issue a Stay Away Order, preventing you from going within 500 feet of the alleged victim in your case. That means if you live with the alleged victim, you will have to leave your house unless the alleged victim leaves. You can't communicate with the alleged victim either. That means no snapchat, no instagram, no tik tok, no Facebook, nothing! And no 3rd party communication either. Violating the Stay Away Order can result in you being arrested on an additional offense and your bond being revoked on the underlying case. It is one of the fastest ways to watch your life go down the drain. There are times when you can convince the judge not to issue the Stay away order. That usually occurs when the arrest is delayed, meaning that the incident previous to the date of your actual arrest. That can happen when. There's a warrant for your arrest after the incident and the police took some time to apprehend you. The argument is that you and the alleged victim haven't had any issues since the incident and the incident occurred so long ago that you and the alleged victim have had enough time to cool off. Stay out of trouble!
People often ask me whats the worst case scenario for them after they have been arrested. I always have to remind them that the worst case scenario is that they could be sentenced to the statutory maximum penalty, but that it very unlikely in most situations. What you should instead be paying attention to are your sentencing guidelines. Everyone in state court, who is charged with a felony, has a scoresheet. That scoresheet will tell you what your applicable sentencing guideline range is. Your guideline range is much more relevant than the statutory maximum that you face for your charge(s) because it gives the judge your lowest permissible sentence, often called the bottom of your guidelines. The bottom of your guidelines is where the judge has to start if the judge is sentencing you after you've been convicted of a crime. That is unless the judge has a legal reason to depart below your guidelines. It is possible for you to have a felony conviction and your guideline range be less than a prison sentence. In Florida, if you have ever been arrested for a Domestic Violence case you know that your bondsman wasn't able to just come bail you out. That's because under the law, you're not able to make bail until you sit in for the night and see the judge in the morning. The judge will instruct you that you must stay away from the alleged victim or else you risk being re arrested. Remember that when things get heated, it's what's best to let the other person win and sleep on your couch for the night instead of the concrete slab, in the county jail. The definition of a domestic relationship can be found in Florida Statute 741.28. Generally speaking, the relationship is domestic if the two people are married, related by blood, have children together, or live together, as if a family.

Today we went to trial in Tampa, FL and it was pretty much over before it started. Before we could finish picking a jury the State reached across the aisle and threw in the towel. We didn't get a full acquittal but we got the charges reduced from a 2nd degree felony all the way down to a Misdemeanor.
