Today was a good day. 2 clients, both being held no bond. 2 different Counties. 2 different bond hearings. 2 great results.
I started in Broward County at 9 am, secured a bond for the first, and then drove to Miami for an Arthur(Bond) Hearing at 1PM. After about 3 hours, we were able to secure pre trial release for the 2nd client. His family is pictured here with me.
Support systems matter. Everyone came to court dressed appropriately, and the Judge took note of it.thr family did their part and we did ours!
We bring you yet another case where the State decided they would rather waste time and resources instead of dismissing a case they had no business taking to trial. After picking a jury, the State threw in the towel by not presenting a case or putting on any witnesses. The judge was forced to throw out the case. and 🤜🏽🤛🏽
We went to court this morning, 4 interns deep for a trial that ended up getting dissmissed right before jury selection began. New day, same time wasted because the State doesn't know how to dismiss bad cases before they are forced to go to trial.

All of our previous interns are now law school graduates!! Congratulations to all of you for accomplishing an enormous feat. All of our interns were bad ass Mfers, each of them with a unique set of skills. Skills that will make life difficult for future opposing counsel. I'm proud of you all!!
I hesitate to get new interns because I hold them all to the standard of these past interns! Law students, the bar is high!

CONGRATULATIONS on graduating law school! We are very proud of Justin who used his platform as the FIU Law commencement speaker to hold the establishment accountable for supporting genocide in Palestine.
Many people cheered him on, and many people boo'd him for speaking up against the murder of thousands of innocent Palestinian babies, children, and adults. We, of course, applaud him 1000%. Justin's courage is something that very few people and, even less, lawyers, have. Most people would not risk their careers to speak out for marginalized people. Social engineers like Justin will make our world a better place, they always have. And his courage will be rewarded in the long run.
FIU should be ashamed for cutting off Justin's microphone while he was speaking, because had he been shouting down Palestinians and showing support for Israel, the school would not have censored him. A disgusting double standard and a revelation of the true colors of an institution that is supposed to support First Amendment Speech.
Justin interned with us on and off for 3 years while he was in law school and he has a very bright future! He will serve his clients faithfully and he was fight for the rights of of all people, not just some. Now go and handle business with the bar ⚖️

Last week, I tried a federal case in Miami with and Omar Lopez.
Up to that point, I had never lost a trial where my client had been charged with felon in poss. Of a firearm. I've tried a few where the officers claimed to have seen my clients with guns, and the officers gave chase, and the clients were alleged to have tossed the guns before the officers caught up to them. Beat two just like that and hung a jury on another. In fact, the hung jury consisted of 4 women who were voting not guilty, and the other 2 believed the client was guilty. Those 2 were men, and one was a law school graduate who had not passed the bar yet. The women did not fold, they stuck to their decision, and a mistrial was declared.
In this case, we did not get a chance to ask any questions during jury selection, which is the most important phase of a trial. That is typical in federal cases, and it makes it difficult to guage bias without the ability to question jurors on their background and their thoughts. I think the rules should be changed because of how I interpret the "right to a jury of your peers" but hey 🤷🏽♂️.
This trial also consisted of 12 jurors because we were in federal court, not the 6 that are typical in a State case. After trial, they deliberated for 6 hours. Mid-way through the deliberations, they asked the judge for the next step because they could not come to a decision. The judge sent them back to continue deliberating, and unfortunately, they came back guilty.
I'm holding a lot to the chest because I want to make sure I don't affect any appellate remedies for the client. But I wanted to share the losses with the wins because this job is not all about winning. I try all cases, not just the ones I know I can win. If the client's back is against the wall and trial is the only option, we go to war. And no matter how insurmountable the evidence, the losses stick with me in ways the wins don't. I play them in my head all day, I have nightmares about them, and I constantly ask myself what I could have done differently.
We represent humans that sometimes lose their entire lives over harsh sentencing laws. We gotta do something about it. ⚖️
Today we had a hearing in Federal Court in New York. Last month, our client was picked up in Florida on a 25 year old warrant! He was then transported to New York, which took 3 weeks. He arrived in New York last night and this morning I went to speak with him. I learned that during the 3 weeks he had been shuffled from jail to jail, on his way up to NY, he was never given the opportunity to call anyone to let them know where he was at or how he was doing. The only reason I knew when to arrive in NY for him was because I remained in constant contact with the federal prosecutor on his case to guage when he would arrive in NY.
Because the client had been gone for such a long period of time the prosecutor assumed I might agree to my client's detention until the case was resolved. I told him no and that while I knew bond was a long shot, I could not just agree to lay down. Pre-trial Services recommended that the client be detained because they claimed he was a flight risk.
We argued back and forth in court until 6:30 pm, and the Magistrate Judge agreed to let my client go back out on bond despite him having left the jurisdiction for 25 years. The prosecutor shook my hand after the hearing and admitted that I made great arguments.
We can't disclose the arguments we made until we get them trademarked 😂 Just know that the defense never rests, and if you don't try you've already lost.

Today District Court Judge Martinez allowed Kodak Black to admit he violated the terms of his supervised release and he was given credit time served on his Federal case. Kodak is no longer on Federal Supervised Release and he will be able to bond out on the remaining State cases that he has open. Judge Martinez lectured Kodak and told him that he was concerned about the friends or "leeches" that he spends his time around and he was afraid that the next time he saw Kodak it would be because Kodak either hurt himself or hurt others. Judge Martinez told Kodak that he has influence over people and that he should use his gifts to do good. Kodak agreed.
The Judge in Kodak's state case just reinstated his bond. However Kodak will remain in Federal custody until he deals with the bond issue there and or he resolves the pending probation violation. He has court in the feds on Wednesday

Today we are joining our colleagues and giving back to the community of North Miami! Come out and show support!
Our client will be reunited with his wife and 7 kids after being away from them for 11 months. He was originally charged with Trafficking co***ne and Sale of Co***ne within 1000 feet of a school in two separate cases. Looking at two different minimum mandatory prison sentences and more than 60 years as a potential sentence he hired and we were able to get both 1st Degree felony co***ne charges dropped to 3rd degree felonies and get our client released right before the holidays. The first offer on his cases was 5 years in prison followed by 24 months of probation. Instead of telling him to take the offer we exposed big holes in the State's case and we were able to reunite a family. Happy early Thanksgiving!

Today we were able to close out a case that was very special to us. Our client came to us with 3 open cases and a 25 year Minimum Mandatory sentence. This case was not trial case as the evidence was very bad. We began to look for other ways to gain a favorable outcome. We were able to dig deep into our client’s past and put together a story that encapsulated his rise to athletic stardom and fall to drug sales and addiction. We took that story all the way to the top of the Broward County State Attorney’s Office, spoke with State Attorney Harold Pryor and presented our mitigation packet. Harold, and Assistant State Attorney Jonathan Goodman listened and we were able to negotiate a very favorable outcome for our client who will be home happy! Thank you

Meet our Summer Intern, who just accepted an offer to intern with us for the Fall as well! Courtney Dash has been a tremendous help to the law firm this summer and she will be even better this coming Fall. Courtney is a rising 3L at the University of Miami. Courtney is also on the board of the National Black Law Students Association the largest law student run organization in the country. Courtney wants to practice criminal defense when she passes the bar and becomes an attorney!
AsiliA Law Firm has been retained to represent the family of Travis Turner, a loving son, brother, and friend who was shot dead during a senseless shooting at the VYPZ Lounge in Lauderdale Lakes. A complete lack of security and cameras created an environment that ended in a tragic ending for Mr. Turner. We will fight to ensure that all are held accountable.

Last weekend we cleaned up for the Gala
3 years ago, two Hillsborough County Sheriff's Office (HCSO) deputies knocked on Ms. Percival's door with an ex-boyfriend of hers and demanded they be let into Ms. Percival's home so the ex-boyfriend could take out some of his belongings. The ex-boyfrind did not live at the home, never lived at the home, did not have a key, and was not welcome to come inside. Without any type of court order, the police forced their way into the home, but not before they instructed the key-less ex-boyfriend to kick the door in and to use a drill to drill out the lock to the front door. Ms. Percival called 911 seeking assistance from the deputies illegal actions, but they would not send help or call off their deputies. Alone in her home with 3 men, two officers with their hands on their guns, and an ex-boyfriend who was allowed to rummage through her property and remove things from the home, Ms. Percival thought she was going to lose her life. Before the deputies left, they signaled to each other, and one of the deputies rushed Ms. Percival, 65 years old at the time, kicked her feet from under her and slammed her to the ground. Both deputies crushed Ms. Percival's frame by kneeling and standing on her neck and back until she passed out. When she awoke, she was in handcuffs, and she was being arrested for resisting, calling 911 and battering her ex-boyfriend. While Ms. Percival spent the night in jail, the ex-boyfriend returned to the home, broke in, and stole more belongings from her home. The police never arrested the ex-boyfriend. All charges against Ms. Percival were eventually dropped by the State Attorney.
Last Friday, we filed suit against everyone who owes Ms. Percival a full cup of justice.
