Q&A on due diligence in South Carolina 🧠

First off the core elements of due diligence are:
📅The parties agree the buyer has a certain amount of time to inspect the property and consider whether or not to purchase.
🙅♀️The buyer can terminate the contract for any reason or no reason within the due diligence period.
💵A buyer who decides to terminate will have to pay a termination fee (this fee amount and the time allowed for due diligence will have already been negotiated during original contract offer and acceptance.)
📝 If the buyer terminates for any other contingency listed in the contract such as appraisal, financing or CL100 the fee is not owed.

⚫️If I find things wrong with the property during the due diligence period, what should I do?
-We talk it over and decide whether to present the seller with a request for repairs and/or a credit.
⚫️If I make a request for repairs or a credit, is the seller required to respond during the due diligence period?
-No, the seller is not required to respond.
⚫️If due diligence is about to expire and the seller hasn’t responded to my repair/credit request, what are my options?
-If the seller does not respond or does not respond to your satisfaction and the due diligence period has not expired, you may seek to extend the due diligence period to allow for continued negotiations, decide to purchase the property in as-is condition or terminate the contract before the due diligence period expires and pay termination fee.
⚫️Once the due diligence period expires and we continue with the purchase, what are the seller’s obligations?
-In general, the seller is required to maintain the property in its current condition, make any agreed-upon repairs and tender marketable title at closing.
