On December 12, 2023, after over 5 years of representation and a lot of work, my office and I tried a stand your ground case where my client was found to be immune from prosecution for murder and possession of a weapon during the commission of a violent offense. The client was assaulted in a place where he had a legal right to be. Under South Carolina law, (South Carolina's Protection of Persons and Property Act) a person does not have a duty to retreat if attacked in any place where you have a legal right to be and if there is a reasonable fear of death or great bodily injury to either yourself or another person. You can hold your ground and defend yourself. A person who commits a crime while defending themselves cannot be held criminally responsible for the criminal act. It is so important to understand case law and criminal procedure when preparing for a case like this one. Moreover, it is just as important to understand the evidence while defending these cases.

In this case, my office filed a Grounds and Petition for Immunity and Dismissal believing that my client acted within the confines and parameters of the rules of self-defense based upon the law in South Carolina. Under South Carolina law, a Stand Your Ground motion is a motion normally filed by the defendant to have an evidentiary hearing to determine whether or not the defendant acted in justifiable self defense and to protect them from prosecution if they did. Under South Carolina Law, a defendant is protected from their actions if they can prove they didn't provoke the attack, they believed their attacker would imminently kill them or inflict serious bodily harm and other reasonable persons would have also believed they were in imminent danger if faced with the same situation. If acting in self-defense, it must then be proven the defendant was not engaged in unlawful activity and the defendant had a legal right to be where he was. My client was found to have been protecting himself in an unprovoked attack and cleared of the crimes he was charged with. It is so important to have representation by individuals who will listen to your story and take the law and the facts of your case and zealously defend you.

On June 30, 2023, after 2 and a half years of representation and a lot of work, my client was found NOT GUILTY BY REASON OF INSANITY due to his mental illness. Our client was originally charged with murder, attempted murder, kidnapping, and possession of a weapon during the commission of a violent offense. However, during the crime, my client suffered a psychotic episode. Under South Carolina law, (which is described in the M’Naughten ruling) a person who commits a crime but does not understand or appreciate the difference between right and wrong cannot be held criminally responsible for a criminal act. It is so important to understand case law and criminal procedure when preparing for a case like this one. Nevertheless, it is just as important to understand that clients and their personalities, experiences, and psychology are varied and distinct.

In this case, my office filed a Blair motion and a M’Naughten motion to determine competency. Under South Carolina law, a Blair motion is a motion normally filed by the defendant to determine whether or not the defendant is competent to stand trial. As opposed to a M’Naughten motion, which is to determine whether or not the defendant was competent or sane at the time of the criminal act. While both rulings are related to competency, they are separate and distinct matters that require separate and distinct hearings. A person cannot be tried or punished until they are competent, so if someone is found to be incompetent, they cannot be tried until they are deemed competent to stand trial. For example, someone cannot be put to death when they are declared incompetent. It is important to note that a person can be competent during the commission of a crime and be incompetent to stand trial. Moreover, an individual can also be found to be incompetent during the commission of a crime, or insane, but be found to be competent to stand trial. These variations exist because mental illness, like any other sickness, can be fleeting. Mental illnesses can also evolve and be treated. Often times we ignore subtle indications that our loved ones are suffering from mental illnesses. This case, like so many others, is a stark warning to pay attention to the symptoms of mental illness. I.e., Changes in language, personality, habits, personal care, religious interest, as well as diet.

Mental illness and mental illness awareness should not be something that we as a community, or family, ignore or diminish. Unfortunately, often people who suffer, are suffering alone. And that culture needs to change. Workplace injuries can be tough to handle. When an employee is injured or dies while on the job, they have the legal right to file a Workers' Compensation claim to pursue recovery for losses. The workers’ compensation system in South Carolina provides broad protection to workers hurt on the job. Workers’ compensation covers full- and part-time employees. Workers’ compensation laws dictate any work-related injury arising during the course and scope of employment should be covered. However, many injured workers with valid claims are denied workers’ compensation. Our office can guide employees through the process pursuing full benefits for work-related injuries or conditions.
There are numerous reasons employers and administrators deny claims of injured SC workers. We review the reasons for denial and evaluate grounds to appeal the decision. For instance, failing to notify an employer of a workplace accident within 90 days may result in denial of the claim. In some cases, it may not be clear exactly when an injury developed, especially with repetitive stress injuries or conditions developing from workplace exposure over time. Another reason is the employer may claim the injury was not work-related. The definition of “work-related” under South Carolina workers’ comp law is very broad. Workers’ compensation only provides coverage to employees. Some employers incorrectly classify workers as independent contractors to avoid paying workers’ compensation benefits. If work meets the legal definition of an employee rather than independent contractor, it may still qualify for benefits. Also, employers may claim the injured employee was careless or contributed to the injury and should not receive workers’ comp benefits. It is very rare for an employee to be disqualified from receiving benefits as a result of his or her own actions and are only for instances when the employee intentionally hurts themselves or the cause of the workplace injury was voluntary intoxication. Workers compensation benefits may be obtained for injuries obtained in a car accident while in the course of employment. Benefits may still be received when a workplace accident aggravates or worsens a pre-existing condition. An employer or insurance administrator may claim an employee is exaggerating an injury. An employer or insurer will use the opinion of its choice of to show workers’ comp benefits should not be received or should be minimal. Our office can assert the employees right to request an independent medical examination.
The S.C. Workers’ Compensation Commission governs the workers’ comp system and hears appeals of denials. Our office can assist during the informal conference with an employer representative and the S.C. Workers’ Compensation Commission. If an agreement is not reached during the informal conference, a hearing is scheduled before a workers’ compensation commissioner. Our office presents evidence on behalf of the employee at the formal hearing. The appeal is heard initially by one commissioner. Should the commissioner rule against an employee, a request for a three-member panel of commissioners review the decision can be made. If dissatisfied with the ruling of the three-member panel, employees can appeal to the S.C. Court of Appeals.
The workers’ compensation appeals process can be complicated. There are strict deadlines and a need to present persuasive evidence in accordance with the rules of legal procedure. While having legal representation is not mandatory, appearing without an attorney places the employee at a disadvantage. The employer and/or insurance company will have legal counsel.
Each case has a unique set of facts and the results of previous cases are in no way predictive of a similar result in another case. Knowing your rights under the law is important. We represent clients as individuals and not just names and numbers. Results matter.

My office continues to enjoy success representing our clients. My office represented a client in a civil seizure action trial in Horry County. The Trial Court in Horry County ruled against my client in favor of seizure. My office filed an appeal with the South Carolina Court of Appeals and a brief supporting our position the case should be overturned. Today in a published opinion the Court of Appeals agreed with our position and granted my client a new trial remanding the case for further proceedings. We are proud of this success, happy for our client and satisfied justice was not denied. See the attached Opinion for further details.

Our Story

Ralph J. Wilson Jr. was born in Conway, South Carolina where he attended Conway High School and received the Daughters of the American Revolution Good Citizenship Award twice and was selected to represent Conway High School at Palmetto Boys State. Mr. Wilson also served as the Student Body President at Conway High.

After high school, Mr. Wilson was accepted to the University of South Carolina and was selected for Freshman Council where he received the Mirror Image Award for his work in philanthropy and service. Mr. Wilson was eventually elected by the student body to serve as a member of the USC Senate and was appointed Chairman of the Philanthropy Committee. Eventually, Mr. Wilson became the Director of Institutional Affairs for USC Student Government. Simultaneously, Mr. Wilson Paged for Senator Luke Rankin at the South Carolina State House. In 2001 Mr. Ralph Wilson Jr received a Bachelor of Arts Degree from the University of South Carolina with a Minor in Computer Science and a Cognate in Philosophy.

He then went on to receive his Juris Doctor from Thomas M. Cooley Law School in 2006 where he served as the Thomas M Cooley Law School Student Bar Association Budget and Finance Director for two years and was also elected Student Bar Association President in his final year. Ralph Wilson Jr. was also a member of the TMCLS Leadership Council, and mentored and taught Criminal Law, Tort Law, Secured Transactions and Contract Law for the Student Bar Association and the American Bar Association/LSD. Mr. Wilson was the 2002 recipient of the SBA President’s Award, and in 2006, was awarded the Krinock Memorial Award from Thomas M. Cooley Law School.

Ralph Wilson Jr. is a founder and Managing Partner of the Wilson and Wilson Law Group. Mr. Ralph Wilson Jr. was accepted as a member to the South Carolina Bar in 2007 and was accepted as a member of the Federal Bar in 2008. Mr. Wilson has tried and resolved a myriad of legal issues ranging from criminal and personal injury cases in the State Court to Federal, Civil, and Criminal cases.
