I hear this TOO FREQUENTLY:

"We always thought everything would go to the surviving spouse!!"

Married couples with living trusts: PLEASE have your trust reviewed if it's more than 5 years old. Why? Because it's likely that the estate tax avoidance planning that it contains IS NO LONGER NEEDED and will unnecessarily restrict the surviving spouse's use and enjoyment of the decedent's property!

I offer a complimentary consultation and so do many other estate planners. Take the time to address this while you're both alive so you don't have to go to court after one of you dies.

Williams Automotive at 238 Soscol Ave. in Napa is doing a purge of all their wheelchairs, 4-wheel walkers, shower chairs, commodes, canes, knee walkers, etc. they have a ton of stuff and want most of it gone by Tuesday. They are closed on the weekend. You can just go by and pick it up today or tomorrow before 4:30 pm. Call Ed at 224-9466 if you want them to hold something for you. They have bariatric stuff, too. And some stuff is new, still in boxes.

Friends don't let married friends hold property as joint tenants!

California couples who own real estate: find your deed and check how you hold title. Is it ..."as joint tenants"? If so, run, don't walk, to your attorney to get it changed to community property or put it in your living trust if you have one.

You will lose out on a potentially HUGE income tax savings if you hold title as joint tenants.
